  1. Sorry but I am full of questions and I apologize if I'm not souding coherent. From what I understand, I can't cancel the I-485 because it is technically his petition, correct?? However, once the I-864 has been cancelled, it makes the I-485 obsolete, correct? Also, what about his I-765? Will that still be valid for the rest of the year? I am pretty sure that I can prove fraud, so what will happen to him and how quickly will it happen?

    You are correct... you can not cancel his I-485 but once you have withdrawn your I-864 he will no longer be able to do AOS.... as he will not have a valid claim to AOS then his EAD will be revoked and he will no longer be Employment authorized...

    Any info that gets passed to ICE, it will be up to them what they do... no one can tell. but you will no longer be responsible for him even if he stays illegaly in the US...

    This isn't entirely correct. Although the submission of the I-485 is the alien's, it is only made possible by way of the approved I-130 petition and a viable marriage. The I-130 is the US citizen's petition and can be withdrawn at any time, upon request, and most certainly when the US citizen alerts USCIS that the marriage is no longer viable and that she suspects fraud, and believes that she will be able to demonstrate that to USCIS.

    She should request that the I-130 and any other endorsements she has made for her alien husband (to include the I-864 and the pending AOS I-1485) be withdrawn. She should do so in writing, to both the Service Centre and the local office and mail them both requesting a return receipt and IMMEDIATELY (so as to reach them before any approval notice might be mailed). Once the AOS case has been approved revocation of PR becomes a little more diifficult.

    He came on a K-1 so we didn't file an I-130. So my only chance to stop the petition is the I-864 I believe.

  3. I am sorry to hear this has happened to you.... Once you have your written request to cancel make a infopass appointment at your local office and talk to a immigration officer.... they will be able to contact CSC for you and they can pass on any information to ICE if needed... good luck and stay strong.

  4. Didn't think I'd be one to post this topic but here I am. My husband is cheating and we haven't had our AOS approved yet. There is no chance at reconciliation-I am quite sure I was used for a GC. To top it all of I'm also 8 weeks pregnant. I won't be the first or last to raise another child on my own.

    What addresses do I send the requests for canceling the I-864 and can I cancel or send a letter with my concerns about the fraud for the I-485? I am not thinking clearly and tried to do a search but between tears and anger, I can't find the right addresses.

    Please help.

    The AOS was transferred to CSC. Do I send the cancellation to CSC?

  5. I wonder if they count the original receipt date or the date it was received in California.

    Either way, I'm sure we have a while to wait. :\

    I'm pretty sure they go by the receipt date on the NOA. Mine says March 16th. And guess what? I got a touch on September 19th!!! That's the first one in five months! I had been completely ignoring the USCIS status page because it had become disheartening, so it came as a complete shock when I logged in and saw that they'd been working on my application after all. The only problem is that now I'm wondering if I'm going to be sent an RFE or if they're actually going to send me a greencard. Or maybe they're just going to stick it back in a drawer again for another 5 months. sheesh. :bonk:

    I called the USCIS 800# to ask about our AOS since it's been over 6 months (just for grins and giggles) and the recording specifies that you should call and check on your case after 180 days from the time it was transferred to CSC. I thought it was 180 days from the NOA1 but they say on the recording 180 days from the tranfer date. :( I only have 118 days more to go.

    That is exciting! I understand the worry, but stay positive and hopefully it will be the good kind of touching.

    :dance: OMG!!!! CONGRATS! You must be in shock!! You've waited how long...1 year and 1 month now??? You've got to be dancing on the ceiling!! :dance::dance:

  8. Congratulations! I'd be dancing like a fool for joy if I were you. :yes:

    In one way yes it does suck that you ended up wasting money for the EAD and AP because your GC arrived soon after they were approved, but the fact that you only had to wait less than 3 months for the whole AOS process far outweighs that inconvenience as far as I'm concerned.

    You must have been transferred to CSC if you were approved without an interview. Your USCIS online status should have let you know when that occured. Why you didn't have an interview is really a big mystery to everyone. There doesn't seem to be any rhyme or reason to who gets interviews and who doesn't. But consider yourself lucky that you didn't have to worry about having an interview.

    With a 2 year conditional GC, you have to start the lifting of conditions in 1 year and 9 months.

    The stamp in your passport is sometimes given at the interview if they are approved as a temporary kind of GC until the actual one arrives in the mail. Since you didn't have an interview, you won't get a stamp (and sometimes at the interview they still don't give you the stamp).

    Again, Congratulations on a very speedy AOS approval!

    I was under the impression that this was not normal - but from reading your posts I see that is is.

    Today marks day 103 so I guess it'll be normal to wait longer.

    I did call USCIS last week but the IO was SUPER rude to me - and refused to talk to me because my husband wasn't there. Soooo, I'll have to call back when we can do 3-way since my hubby goes to work early everyday.

    Is his name probably stuck in an FBI name check?

    Our senator's office said that we were in preliminary security review which I guess could mean just about anything. I'm guessing it was name checks that he was stuck in.

    Does anyone have any info on the steps that the AOS goes through once it is sent in? So does it have to pass through a preliminary set of name checks before they decide to transfer it or give an interview date? Then it gets transferred or an interview date and the name checks continue? I'd love to read more information (especially about name checks) if anyone knows of any about the AOS process.

  10. They are starting a little late. From conception to birth is technically over 9 months. These babies will likely be born after June 12th.

    But aside from that, can you imagine everyone leaving work that day and walking to your cars KNOWING that everyone is going home for that purpose? How do you say goodbye that day? "Hey! Have a good one!"

    And then there are those people that have no SO's. They've got to be thinking, "Great. I'm the only one that won't be getting any tonight."

  11. Our case was at MSC for 123 days and then we were transferred to CSC. Our senator's office said that we were still in preliminary security review during that time. I was starting to really wonder what was wrong with our case because the majority of people are only at MSC for about 6 weeks or so. I found out that I wasn't the only one that waited longer than that so I didn't feel quite so out of the ordinary.

    You will get that transfer or interview notice!

    I guess we'll just sit back and be patient for a while. If we don't hear anything in a couple months, we'll inquire and then apply for Advance Parole if needed. Is that only for one trip or multiple trips? We planned on finally taking our honeymoon in January in Jamaica, then visiting his family in February.

    Darn it! I thought this was your post that you received the GC approval. :) Fingers crossed for the next post.

    I wondered about the 6 months timeframe too. But then figured it didn't really mean a hill of beans anyway.

    For the AP, you can check if you want it for one trip or multiple trips (I dunno why anyone would check only one).

  13. Just curious about any conditions that AOS can be approved w/out interview?

    I m filing AOS from F-1 student and still waiting for the approval. :dance:

    An IO at our infopass said that they are sending K-1 AOS's to CSC without an interview because they just recently were interviewed in their home country. This was the IO that was able to verify to my IO that there are AOS's being sent to CSC and being approved without an interview (she laughed when I said that cases were being approved without an interview). I could swear that there are other cases besides K-1's being sent to CSC without interviews, right? I think they make up stuff as they go. :whistle:

    The good news keeps coming today. I just got an email that our AOS has been transferred to California. I don't know if that is good or bad but all I know is THANK GOD we heard something and it will be nice to not have to worry about an interview. I was sure tired of wondering why our case was still at Missouri! WHEW! :dance:
