  1. Hello,

    My hubby just got his EAD card for him to work until his visa expires. Of course there is no "fingerprints available" which does not matter cause we intend on filing for his green card soon. My question is what is the process or what do we do since his last name is actually spelled Schäfer in German, but he has spelled out Schaefer in the I-765 when the EAD card has him as Schafer? Maybe this should not be a big deal but I am curious to see what the reprocussions would be if we just accepted this and got him a social security card. I just hate the wait and I am tired of getting different answers from the DHS evertime we have called them for guidance.

  2. Dont give up though. Im a military member too. I had to wait 6 months to get my husbands I-130 approved. I filed the I-129F in the end of May and got that approved on the 31st of October. With HOPs, your spouse will need a visa anyhow to fly in one. But you can claim her as your dependent if you have not done so yet. My husband got his dependent ID in germany. Is Turkey under the visa waiver program? Im not sure if she can visit while her petition is being processed.

    pursuant to 8 CFR 217.4

    I researched it but I really dont understand much of it. All I know is that the immigration officer said that I can file a K-3 and get him here as my fiancee, but now that we are married we persued the I-130 and the K-3. At this time my husband received packet 3 and is about to send it off.

    Im nervous because my husband is about to have his interview scheduled at Frankfurt. Long story short, he came to visit me and marry me under the Visa Waiver Program last year in December. At the Port of Entry in Dallas, the immigration officers questioned his intention in the US. He pretty much told them he was visiting. But that contradicted to what I told the same immigration officer. When the immigration officer called me on my cell, he asked if I knew him and what were our intentions. Honestly I did not know about the restrictions with the visa waiver program or any immigration laws at that time, but I told the officer he was coming to visit me for my promotion and graduation to becoming a Staff Sargeant, we were getting married in Las Vegas and we were going to file the paperwork once we were married so he can legally reside here. Im such a dummy. They denied him entry and he voluntary went back to Germany. A couple of months later I went to Germany and got married to him, claimed him as my dependent although he is not living with me (he has his military dependent ID card) at the moment and I visited him a couple of times last year and this year. I just would like to know if anyone has gone through this and any advice on what we should do. Thanks very much. :help::help:

    Thats weird that they cancel the K-3 cause both my I-130 and I-129F were approved on the same date. But the NVC to this date only received the I-129F and fowarded it to the embassy. And you know, those customer service reps do not know anything. They just read whats on their system. Did you call anyone from the NVC? I would talk to them for guidance.

  6. I am worried about my package. NVC said they sent it out to US Embassy in Ukraine on November 15. Today they is already 27th and still not delivered. 12 days has passed and nothing. The embassy said that they got an electronic version, but not hard copy (without which they cannot send packet 3 out).

    Anyone out there had similar problems (long delivery time)? I hope DHL did not loose our documents. Is it possible, and if they did what can be done?

    You know, the delay could be also due to the holidays. I would call the NVC and ask if they can track that packet and inform them of what the embassy told you. Im sure that they probably also send other cases along with yours to the embassy and track it for incase. Call NVC. They are active until 1100 I think or 1200 eastern time.

    Although you will not be able to persue the K-3 route, at least your petition has been approved :yes: There are reasons why things happen a certain way. For about a year from December 3 2006, my husband was denied entry into the US. That was the worst day of my life. I really had no desire to function. I felt let down by the Department of Homeland Security, whom sent my hubby back to Germany, and is also there to secure the borders of the US. And here I am in the military willing to fight any war that the US has to face, but not able to have the love of my life here with me to give me the energy and willingness to do my job. After a year of waiting, I realize that this distance has made me and my hubby stronger. Not many americans or really anyone can go through this. I think people who give up easily really dont know love or even want it. I want the love my pookie has to offer. And I want to give him all the love I have to give no matter how long I have to wait, even if it will take forever. Its a sacrifice for all of us to go through this process, but persistence and patience has gotten all of us this far. Dont give up and think of your children. They are one day closer to having their dad. You are one day closer to having the love of your life although the finish line seems distant. And I am sure he realizes all the sacrifices you have went through, are going through and will go through for him. Thats LOVE. I beleive in Karma and I beleive for all this time you and me have missed out, we will get ours a trillion fold. (L)

    My hubby received packet 3 from Frankfurt Embassy!!!! He will complete the DS 230 and I guess the other forms he has to submitt so they can schedule his appointment. Just to get this straight, on his interview my hubby will provide the Affidavit of Support that I will send to him? Or does that need to be provided before his appointment? Congrats all and I hope everyone has there loved ones soon. This will be a great way to start 2008! :dance:(L)

  9. Can I be added to the chart too? My I-130 and I-129 F was approved on 31 Oct 07. I received the approval notices in the mail. On 16 Nov 07, the NVC mailed the I-129F to the Frankfurt Embassy. My husband is waiting to receive packet 3. Thank you and good luck to everyone. Hopefully everyone can be with their families before new years or the beginning of the New Year at least :)

    05 Nov 07: I-130 notice recvd in mail after 207 days

    16 Nov 07: NVC recvd case and fowarded to Frankfurt Embassy :yes:

    I've been trying to push this out of my mind during the day. I started to become non functional which is not really an option when I have to raise my three kids and work everyday. I've been praying for peace of mind and patience which I believe God has granted however, my dreams have taken up the extra work of worrying. Every night for the last week I have dreamed of visas, petitions, USCIS, approvals blah blah blah. This morning when I woke up I almost reached for the phone to call my husband and tell him we've been approved. Thankfully I realized it was just a dream before I dialed his number! This whole thing is a real life nightmare.

    You will be approved. It seems that they are working pretty quick with approvals. I was in the same boat as you. Desperate and irritated. I kept calling every once a week to USCIS to see the status of my case. They told me it was still pending, and I had to wait 30 days after the 6 month mark to even inquire and then allow an additional 45 days to even receive a response. Long behold one day after work after 207 days of mailing the I-130, I see two approvals in my mailbox for the I-130 and I-129F. Even though the site still states that they are both pending. Im sure that USCIS does not have time to update their system. Im sure they will surprise you before this year ends. And wait till it goes to the embassy. That part of the process is way to quick I think. Once you get that approval, do your resarch and have your hubby get the police certificates, marriage certificate, pictures, passport and send him your affidavit of support so you two are ontop of your game. Thats where me and my hubby are at. I just want him here. I dont care if we have to spend $1010 and 390 something dollars and file additional paperwork. I hope everything goes well and you are able to have your hubby soon !!!!

    My husband is kind of in the same situation as yourself. He was coming in December last year to be here for my graduation for trainning to become a supervisor and for my promotion. We actually did intend to marry also in Vegas but intended to file all the legal paperwork required for him to live here. He was in the Visa Waiver Program. When he attempted to come through the POE in Dallas, he was questioned about his intentions in the US since they also saw that he was bringing his two cats. Of course we both did not know at the time or read about immigration laws and assumed that he is able to come visit whenever since he has a couple of times before December 2006 to visit me, as long as he does not stay here for over 90 days. He even had a roundtrip ticket and intended to return due that his brother passed away last summer and he wanted to check up on his family while we would process his paperwork! They stamped on his passport:

    My husband bought his own ticket back home and was detained at the Dallas county jail until his flight left since they had no space to detain him in.

    I called back the immigration officer, who called me earlier that day to question if I knew my then fiancee and his purpose in the US, to see if he is able to come to the US after being denied. The immigration officer told me that as long as I file a K-3 Visa he should be able to come into the US to marry me. Screw that. I went to Germany, got married and filed the I-130 and I-129F. I am nervous about his inteview because I am sure that they will question him about that incident, but Im sure that they will understand that we did not know. No one explained to him the Visa Waiver Program regulations and limitations. Any how.

    Does anyone know if we would have to file a waiver to for this? :wacko:

    I read about a post sometime back where a US citizen who was trying to bring there fiancee from the philipines, was put on administrative hold I guess cause when it came time to the medical exam, they saw that the fiancee in the philipines had suicidal scars on her wrists. Im not sure if they were approved yet or what happend, but as long as you dont have scars you should be good to go I think.

    But I agree with the comment before, dont mention about the drugs. But I would figure even if you were honest and did mention to them that you did use drugs when you were young, that they would not judge based on that, since if they were to do a drug test on you, you would not test positive. I wouldnt mention it, but I would be honest about how you and your hubby met. There is nothing to be ashamed about meeting through a chat room community. I have read other posts where couples met online and they were approved and able to come to the US. Im sure that they would not question your relationship as much do that your husband has served in the military and would understand how stressful military life is. But one thing that you might want to ask your hubby and think about, is he claiming through the Veterans Affairs for medical benefits for his PSTD or does he have some type of disability claim for it? They might look into that when they are looking into your hubbys income and stuff. Not that I know, but from what I have researched is that they want to make sure that you will not be a public charge.

    I wouldnt worry to much about or stress over it. I feel depressed too since it is the holiday season and it sucks not to have my hubby. But we are getting close to finally living a life together. Hopefully. I wish you luck and hope that all goes well for your family. :blush:

    My K3 has left NVC on Nov 15 and should have made it to Islamabad, Pakistan embassy by now. I emailed embassy to inquire whether the case is received, no reply yet. My question is that once embassy receives the case what is the next step? Is my wife going to receive packet 3 and send requested docs to embassy then the embassy sends packet 4 with interview date OR my wife gets one packet 3/4 with interview date and she has to take all the documents with her at the time of interview? :innocent:

    I read different things on the site here and wanted to understant the process from this point.

    Im in the same boat as you. On November 16 they sent our I-129F to Frankfurt. I was doing research and from what I understood, is that your wife will receive the packet 3 with instructions and then when she turns in the required documents, then she receives the appointment date. If I were you I would submitt the affidavit of support with your income and tax returns to your wife so she can send that to the embassy. I would recommend that you look at the Pakistan Embassy site for more info. Good luck :) I hope everything goes quick for you and me.

    Im in the same boat as all of you and Im also going for the K-3 rather than the I-130. My husband and I dont care if we have to spend more money and file more forms, we just want to be together. Below is my timeline, so my husband is pretty much waiting to receive notification from the Frankfurt Embassy

    NOA 2 for I=129F: 30 Oct 07

    Received NOA 2 for I-130 and I-129F: 5 Nov 07

    Called NVC for Case # status: 13 Nov 07

    Received NVC letter and case # for I-129F: 16 Nov 07

    So I was wondering, just to get this straight, my husband needs to get police certificates, passport, two pictures, marriage certificate, affidavit of support (from me with tax forms, bank statement with date opened bank and deposits for last year and current amount) and proof of relationship. Is there anything else we will need? I looked at the Frankfurt site just to see. We would love to be ahead of the game :whistle:

    Both my I-130 and I-129F were approved. The NVC already has my I-129F and will foward it to Frankfurt. They have not received my I-130 yet but from what I got from forums, as long as it has been approved, my husband can come here quicker with the k-3, its just that we would have to pay more and file more paper work. The whole purpose of the K-3 is to get your family member here in the US while the I-130 is still being processed. Once in the US the family member has to adjust their status. I think. Can someone verify this?

    Im sorry for the season that you are going through, but I know that this season will pass and make you stronger. I was in a 5 year relationship with an ex which was not really sincere. After we broke up, I did go through my season of depression. I thought no one will love me or even as much as he did (what I thought at the time was that there was only him). I didnt eat, I went from 125 pounds to 94 in two months. I cried. I was single for two years. Im glad I had two years to make my own decisions based on what I am, who I am and what I like. I realized that my ex was never my type and have been blessed to meet my hubby while in Germany. This was not planned at all. I went to Germany to do an assigned job and while doing my job I met him. He worked there and it just all fell into play. You will realize that when someone loves you or desires you, they will do things from their end. Not just you. You wont be the only one trying to impress and romance. She will too :) My advice to the broken hearted is dont look because they will find you. And when you are not looking you are being your self which is what you really want the person to be attracted to. You. Usually when some people are after other people, they are not themselves. They pretend to be someone or something they are not. Take care Craig and I hope this season will go by quick. 2008 is around the corner(L)

  17. :yes: This is the happiest day this year. Its my moms birthday and I received approvals for both the I-130 and I-129F. I cant beleive it. I called the customer service line and the guy upseted me by saying that I had to wait until December 13 to inquire about my case. I was angry. But he told me that the touches I received recently could be that I have been approved but the case worker probably did not update the system. And long behold I check my mail after school today and I just started crying. I just started taking Zoloft for depression. So I guess I dont need the stuff any more. Or do I? I know that this is just half the journey, but I hope the progress follows everyone behind me in line. :lol:(L)(F)

    What fax did you send them? The received date for my case is 24 April for my I-130 but I noticed that on the 30-31October and 1 November my I-129F was touched and then my I-130. They havent touched any case since then so Im kind of curious to know why it has not been approved. Im dying to know what the hold up is but every time I call they say I have to wait 30 days after the 6 month mark to even inquire. Ive noticed other members have been approved. But I hope all goes well for you and all.

  19. You have to create your profile in the USCIS site under "case status online" which will be on the left of the screen and then click on "register". Its your choice if you are the customer or if you want your representative to be able to obtain information but you will enter all your information and email adress and select your case number and clikc on "email on" so you can receive information. But its not really accurate because I have received a couple of touches recently and I have not received any email messages, but when I look in my "portfolio" I noticed the date changes. Good luck with your case.
