  1. Hi - My husband came to the US from Ireland on a K-1 Visa in 2008 & is currently in the process of removing conditions from his permanent residency.

    He is an independent contractor (consultant). Is he allowed to accept contracts from both the US & Ireland/EU or is working in Ireland while he is on a K1 a violation of his visa terms? He would still maintain residency here with me, but may be abroad for several weeks at a time working.

    If someone could direct to me to where I can find this in writing in the Visa paperwork that would also be very much appreciated!

  2. The info provided is a little confusing. You applied for AOS(sent it to the Chicago Lockbox?) but they sent your application back to you for wrong signature...then you corrected it and sent it back to them, and now they're supposed to be sending it back to you, but you haven't received it back, and you're not sure where its at? Am I understanding this correctly?

    So have you reveiced a NOA1 for your applicaiton...i.e. do you have a case # for your AOS application? Has your payment check been cashed? If not, how are you trackink this application, to know that it has been send back to you again, after you initially corrected it and re-sent it? When you re-sent the application, did you use certified/return receipt mail? Do you have confirmation of that delivery?

    I'm sorry for all the questions, but your post is a bit unclear, and I'm not sure that the "get an Infopass appointment" bandwagon is appropriate quite yet.

    Infopass for what? It sounds like OP hasn't even gotten his NOA1 and case # for his application, so there would be nothing to reference at an infopass appointment.

    Yes - your summary of our situation is correct!! (sorry if it was confusing). We never received an NOA1 (nor have they cashed the check), although USCIS did confirm that they received our corrected application over the phone. They said, however, that another error was found & that is was being sent back to us. What little info we do have about our case is from squeezing it out of the "customer service" reps. My husband & I think we found the error in our packet yesterday - I missed line 10 on the I-864...grrrr.

    The main problem is that we have NO idea where our application packet is. USCIS is saying it was mailed out on 3/28, but we have yet to receive it. Unfortunately (yet not surprisingly) USCIS does not track the packages they mail out, so they don't know (or aren't telling us) whether the packet is lost in the mail or at USCIS.

    We made an Infopass apt for the 19th so hopefully we get an answer there. In the meantime, I think we are going to reassemble our packet with our corrected forms and a cover letter explaining the situation. If our application is truly lost by USCIS (it happens - I understand) this is probably what they would have us do. I'm hoping this works & we can make some progress soon. My wonderful husband is getting bored not being able to work!!!

    Thanks for the advice...I'm all ears if anyone has anything else to add!

  3. I am in the USCIS blackhole & need some advice.

    I originally filed my AOS/EAD/Advance Parole applications on 3/3/08. The applications were returned to me 2 weeks later as I had put a signature in the incorrect box (as a preparer instead of as the applicant...rats!) I promptly sent back my application with a new (correct) form on 3/17/08. I called 7 days later only to find out that they were again returning my application - but they would not tell me why. I have yet to receive my rejected application in the mail!!!

    I have called multiple times only to hear the same robotic answer: please wait 30 days and an inquiry will be placed. So I did that & now they are telling me to wait another 30-45 days from April 28th until I call back. This is ridiculous! I sent in my corrected application nearly 8 weeks ago & they can't even tell me if they know where it is.

    I asked today if I could just refile using a copy of my NOA2 - at first the guy said NO NO NO....then when I asked what I was supposed to do & if I could talk to his supervisor he said "Do whatever you want & No you can't talk to my supervisor because he won't tell you anything different than me".

    I am ultimately frustrated. I don't even know what was wrong with my corrected application...I completed it using VJ & a book on Fiance Visas.....

    Does anyone have any advice? I am getting desperate!

  4. My fiance just got his K1 visa on Thursday (YAY :)) & he is planning to travel here in a few weeks. We have done some reading and he plans to fly through JFK to get the work stamp.

    Our plan is to marry and file EAD/AOS immediately - it seems that EAD takes about 90 days - and that he will be allowed to work continuously.

    Is this work stamp from JFK hard to get? Do they give it to everybody? What do you have to do to get it?

  5. I am USC about to be married to a non-US citizen and we are planning to possibly live abroad for a couple years. Is this the visa we would file for as we eventually plan to settle in the US?

    We actually filed for a K1 in May and are waiting for his interview, however, a job opportunity has come up that could take us both out of the states for a few years. Since we will be married, will our joint assets count towards the support form? He will be bringing in the majority of the income while we are away - will it count against our application if I, as the USC, am not gainfully employed? I can't believe I am almost through one process & am thinking of scrapping it to start all over again... :wacko:

    I hope my questions are clear - my head is rather wrecked at the moment! Thanks for any advice/input in advance!

  6. My fiance & I are still waiting for his interview to be scheduled, but are trying to plan ahead :) If he is lucky enough to get an EAD stamp is it valid for 90 days or just until we are married? So, if he got stamped & we were married & filed for AOS shortly after his arrival, would he be able to legally work for the 90 days after his arrival?

    For some reason I was under the impression the EAD would not be valid once we were married.

  7. Anyone know if there is a way to track when or if it has arrived to the Manilla embassy?

    I read in a previous post that you can call the State Department (202) 663-1225. The menu takes a while to wait through (I was hold for 18 minutes yesterday) so give yourself plenty of time & patience when you call. The lady told me it will take 6-8 weeks for it to reach Dublin which I'm hoping is bologna. My file left NVC a week ago, so I am going to try calling the embassy directly tomorrow. I'm hoping I can get some info without calling this number again :)

  8. Our petition was recently approved and we are currently waiting for our case to arrive in Dublin so that my fiance can arrange his medical. Out of curiosity, what all do they do at the medical? Is there anything he needs to bring besides his shot records? I know detailed instructions will be provided in packet 3, but if there is anything he can prepare for in advance we'd love to know!

  9. I'm not sure if I just changed a setting or if the format for VJ forums has changed. I used to be able to scroll through all entries & responses to topics, but now they are all condensed and displayed rather strangely on the screen. Is this an intended change? If so, I'd like to vote it goes back to the way it was. I'm normally not resistant to change - but it was much easier to find info that way.

    If it is just something that I have done on my end, can someone please tell me how to fix it? Thanks!

    I'd like to add that whoever administers this site is doing a great job!! :thumbs: :thumbs:

  10. WOOHOO!!! I just called the embassy in Romania and they have our petition! It just arrived so I was able to stop them from mailing it. Florin will go in today at 1pm to pick it up. I'm hoping that he can give them the checklist immediately...I am PRAYING they will give him an interview date! I am so excited! :dance::dance::dance: I don't think I will be able to sleep tonight!

    Alright!!! Congratulations MusicGirl!! I called this morning & our case was mailed out to Dublin yesterday! We are going to see if we can do the same thing- call the embassy and pick up our packet instead of waiting to have it mailed. Good Luck on getting an interview ASAP - keep us posted!!!

    Teresa - glad you were able to reschedule, hope things work out for Eric and he finds something soon. Alan finally got a call in regards to the police certificate, it's been issued (YAY!) so we can finally get moving again.

    KTJett - not sure about scheduling now, Alan waited until he had Packet 3 before he scheduled his but I think as long as you know what doctors it's fine. Heck the sooner you can get all of this D-O-N-E the better. Keep us posted! :thumbs:

    Since Alan is in Dublin, I wonder if he can hand deliver his Packet 3 & schedule his interview at the same time :idea: ...wow - you guys are so close now!!! He will be here in no time!!!! Let me know how the scheduling of the interview goes in Dublin...I hope they are speedy!!

    i am thrilled but no details yet because his sis had to pass the good news online as hes in london celebrating with no way to contact!!!

    That's excellent!!! I can only imagine how RELIEVED you must be. What a long journey it's been, ey?

    Just to give a ray of sunshine to everyone.... after the NVC gets your case, it MOVES SO FAST!!!! The NVC sent out our case to the Consulate in London on Oct. 30, they received it in London on NOVEMBER 1 AND..... sent out our Packet 3 on Nov. 1 as well!!! :wacko: SUCH a welcome change from all the months spent THUMB-TWIDDLING waiting on our NOA2.
