  1. Do we have to file with in the 90 days of her K-1 visa of Feb 9th?

No, you dont have to file within the 90 days, you just have to get married in 90days. You can file whenever you please :) But of course, as others have recommended, the sooner the better.

We didn't file until a couple months after the I-94 expired (see our timeline below), it took us a long time to find a civil surgeon to do the I-693A that wouldn't charge us an arm & a leg.

Thanks for your help guys but my girl did get a paper from the embasy that says we have to file with in 90 days after getting married. Just wanted to know if anyone else heard of this also.

Are you sure it said to file in 90 days, not marry?? That would be weird, because the embassy has no authority to tell you what to do (file) on US soil.

Yes I am sure the paper was a Q & A sheet of what you might want to know and it was from the US embassy. It answers mostly every question you might have about what to expect when you get to the USA. It came in the mail with her visa.

  3. It means that the approval expires after four months. But the CO can extend it if it takes more than 4 months to be interviewed. This can be done automatically, but I think some VJers had to call the embassy and made sure that they extend it. I would call if I were you, just to be in the safe side.

Anyway, you have nothing to worry about. It happens all the time.

Just call and make sure they do that.

    Good luck

I am not sure what you mean the dates say 05/07/2007 to 09/07/2007 May 7 is the date they cashed my check and started working on my K-1 Notice date is 9/17/2007 witch is 10 days after? I have made the interview at embassy already and it was made on 09/09/2007 and interview will be on 10/23/2007. Are you saying I have to call them about this NOA2 and its dates? This doest make sense to me, I thought you only need the NOA2 for your change of status after you get married witch would be way after these dates shown on NOA2.

  4. Hi all don’t know if this helps any but I really think that it a little messed up now at USCIS and it may look like they are getting things handled. For what its worth here is a recap of what happened to me.

    1. Filed in May and got a May 9th and received an NOA1

    2. Waited and waited like everyone else and received one touch on June 12th. Believed it is because I changed my address.

    3. Waited again and heard nothing all the way till Aug 29 when I received a letter from NVC saying that I was approved and paper work was on its way to embassy. Letter was dated Aug 17. I was very confused at this point and called USCIS and they said I was not approved and it was pending still and would not give me any info even after I gave them the KEV# approval from NVC telling them it was approved. Confused and really worried now.

    4. Called the NVC and found out that my paper work was at embassy on Aug 22 and waiting for interview and still USCIS said I was not approved and pending when I called.

    5. At this point I called embassy and made interview date and got one for Oct 23rd and we are all ready to go. I was afraid to call USCIS because they still have me as pending and was afraid that my SO might get here and some computer would say OH no you are not approved and not let her in to the USA so I called USCIS again and told them they must have a real problem and someone must look in to it now. They did and asked me many questions.

    6. I received finally an e-mail from USCIS saying that I will receive a letter or an RFE soon this was on Sept. 14 but it said nothing about an approval.

    7. After that I now sit at home this week and I have received 3 NOA2 in the mail, yes I am very happy but all I am saying is keep up the faith and try and hang in there. It is not us I just think that what all the things going on right now and all the increases in fees that they are really screwed up at USCIS and the government workers that we talk to have know idea what is really going on. I talked to many people after theses mistakes and still really could not get a good answer till I received the 3 NOA2. All that tells me is someone is covering there ### and they know they messed up. GOOD LUCK to you all and hope things are going to get faster for you all.

  5. Still # 10!

Hope all are doing well and you all get you NOA2 soon. I called about my NOA2 and they still think its pending and trying to figure it out. They said that they may be able to correct this and should within 30 days. Mean time I booked my SO interview Date on Oct 23. Called the embassy with the approval Case # that they gave me from NVC. So keep up the hope and maybe some of you are approved like we where and USCIS dos not even know it. Really only thing you need the NOA2 for is after you get married and have to apply again for change of status. If the embassy has your approved case # and paper work that’s all you need for now to get the interview for their visa.

  6. The only thing i do ...I check the USCIS website like 100 times a day...i thought that i would get an e mail or that any time that they touch it would show a touch...DONT tell me that they are not even reliable with the touches or the emails.. ....this is getting worse and worse

Who doesn't check USCIS wesbite like 100 times a day!!! Jeez!!! I'm going crazy with this waiting game! Last week I called USCIS, they give me the same info that is online, your case is still pending and bla bla bla. This girl told me that I have to wait 6 months...I'm like...what???? 6 months???? starting from...????? And she said, " Starting from today". And before saying no f*cking way, I've been waiting almost 4 months and you're telling me to wait 6 months more.....I hung up! She gotta be freaking kidding me. That can't be possible.

I would love to have that kind of job, answer the phone and give cases status information that is on the screen! Heh heh.

Anyways, let's see what this week brings!!!!

    --MIRLA.

It's 6 months from your NOA1 date after that they will research it for you. But look at my posted even if they research it they still have know clue. My girl will prob. be in the USA and they still will say no approvel.

  7. DOS = Dept. of State. DOS phone number 202 663 1225 ( press 1, 0, 4, 3, 0 ). However, if you don't have your embassy case # they may not be able to assist you. It sounds like you have a situation just like the poster udlike2no2.

Thank you for the DOS # I just called and they where great. Gave them the Case number that NVC gave me and she said I was approver NVC received it on Aug 15 sent it to Kiev on Aug 16 and Kiev received it on Aug 22 and sent Packet 3 out to her already. OMG #######. Yes I am happy but I feel bad for everyone else that this system is so messed up. USCIS is still saying I am not approved and now they are waiting for NVC to fix the data in the system as long as they here from them that I am approved so I can get the automatic NOA2 sent out. Dam I could have sent my income info if I would have know this. She will probably get the packet 3 like today or tomorrow. GRRRRRRRRRRRRRRR. Good luck guys USCIS seems like they are the ones that are totally F$%&ed up.

  8. Ok can not get threw to NVC they say they are open and there reps are all busy and hold on? Than it recycles you again threw the prompts and dos it all over again than says call back and hangs up GRRRRRRRRRRRRRRRRRRRR. I am on hold now with USCIS and the 1st person you talk to really is just a phone buffer to answer questions on helping people with forms and paper work. When she looked up my case she told me it’s still pending. After I said I have a letter from NVC saying approved, she than said hold on and when she came back said she was connecting me to customer service. ####### I thought I was talking to customer service. Now I am on the phone with 2nd person and he is telling me the same thing they do not have an approval for me but he said if NVC gave me the Case # than I must be approved. The guy is now telling me there data in the system may not be up to date so as far as he is looking at I am not approved and he is going by what the computer screen is saying. I have to get in touch with NVC and ask them because if it was sent they will have the real paper work and I can’t get anyone on the dam phone OMG this is unbelievable. Someone try because I can’t get threw and they will not put me on a hold to wait for someone, it just says call back later. 1-603-334-0700

This is worst than the dam 4 month wait lol all I can do is lol because if I don’t I am going to freak. And we are now paying f@#&ing more money with the fees going up GRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRRR

    RRRRRRRRRRRR!!!!!!!!!!!!!!!!!!!!!!!

  9. I don’t know what happened but I called VSC on Friday with RFE trick and got the same thing you all get 6 month wait and can’t tell me anything. 4 days later I receive the letter post marked Aug 31 and letter inside from NVC dated Aug 17 saying they are sending papers to Ukraine embassy for interview. So I must have been approved some time around Aug. 5 to the 12th. No emails no touches and today it says on the website that it’s still pending. For all I know it sat on someone’s desk till they got back from Vacation and it might be setting on a desk in the Ukraine right now. My girl will call them today because she is all ready. I went throw this 3 yrs ago but it was smooth and had NOA2 in 22 days. You know how Government workers are and it sucks but it has been like that forever. The wait is one thing but not telling you anything is worst. I will call both places today and keep you all posted.

  10. Hi all

Well I think I know what the hold up was on my case. I received today when I got home a letter from the NVC saying that we were approved and is being forwarded to the embassy in Kiev. The approval letter had my old address on it and had a date of letter Aug 17, 2007 and was in a regular hand written envelope send out on Aug 31.

I was touched on June 19 and that is right around the time that changed my address. The NOA1 is May 9. So It has been sitting around but who cares I have it now. Still don’t have the NOA2 but it looks like the letter might be in Kiev this week so can make her interview. All in all they skipped right to the NVC and interview and never received a NOA2. Yes I am very happy but this puts a new twisted on the guessing game on ####### are they doing out there and how long is it going to take. The answer is no one really knows so all I have to say is sit back don’t worry and wait. I personally just gave up and said it is what it is.

Not sure what to update my time line is cuz i still dont have the NOA2 but NVC sent it to Kiev. NOA2 must have been before Aug 17?

Good luck to you all that are still waiting and will keep you posted.

  11. Congrats for the people who got approved!!!!

I just checked the processing times at vermont, before it said february 13 not it says 6 months  WhaT? I don't get it.

Petition for Alien Fiance(e) K-1/K-2 - Not yet married - fiance and/or dependent child 6 Months

    --MIRLA.

I think it's USCIS's easy way out. This is madness!

I just called VSC, using the RFE Trick, No help :( They told me they don't check case status there...haha! It seems that the RFE Trick doesn't work for me....Can you tell me what is the first thing you say to the person who answers the phone!?!?!?! haha! Maybe I'm saying something wrong.

After that, I called USCIS, since they updated the website and now it says 6 MONTHS, they told me it is going to take 6 months from today......Whatever, I'm done with this.....It is really annoying and sometimes I just want to give up and forget about all this.... :crying:

    --MIRLA.

THIS IS REALLY GETING OUT OF M*^*@# F%#& HANDS NOW. SORRY BUT I AM SEEING NOTHIN BUT RED RIGHT NOW.

  12. Check this out:

2006 NOA2s issued by VSC to VJ members

    January: 26

    February: 40

    March: 36

    April: 30

    May: 5

    June: 2

    July: 50

    August: 67

    September: 39

    October: 44

    November: 24

    December: 31

Notice the BIG slowdown in May and June 2006. VSC had a reputation of turning out NOA2s in under 30 days, and they typically did this throughout 2006, with exception of the massive slowdown in May and June that you see there, during which time it seems likely that almost all the I-129f adjudicators were transfered to other work. Whatever other big workload it was eventually eased up, and a sufficient number of workers were again reassigned to I-129f duty in July. Shortly following were massive numbers of approvals very quickly (July/August '06 saw an incredible 13 VJ members approved per week [Mon-Fri]--This August [2007] it's been only a little over 3 approvals per week...), and the backlog cleared up quickly. By September 2006 NOA2s were typically going out in under 30 days once again.

The point is this: These occasional slow-downs (like the one we are in now) ARE historically precedented. And they are followed by floods of NOA2s :D

So be happy everyone, for the September (and October) tidal wave of NOA2s is near at hand! :D

2007 NOA2s issued by VSC to VJ members. Notice the same slowdown in June as last year.

    February: 24

    .

Sorry, but I am fairly certain that the 2006 slowdown was caused by a one time event when the new IMBRA regulations came into effect and impacted petitions that had already been submitted.

Although it is pleasant to imagine that there is an army of adjudicators about to be unleashed on K1 petitions, I do not believe there is any evidence to substantiate the theory that the slowdown in 2006 was caused by ajudicators being "transferred to other work".

There are way too many variables and way too many unknowns for anyone outside of USCIS to predict with certainty what processing times will be over the next few months. Given that 2006 was impacted by IMBRA and in July of 2007 we had a major price increase and a reconfiguration of service centers, I think it is almost impossible to use 2006 processing times to predict what will happen moving forward in 2007.

Everyone has their theories, but the truth is no one outside of USCIS knows what is going to happen over the next couple of months. We all have to wait, hope for the best and see what happens.

Maybe all these theories could be right or could be wrong who knows. All I know is in May of 04 I filed and was approved in 22 days. So for me this is not normal because I guess I was spoiled. Now going on 4 months of waiting and knowing it will be at least 1 or 2 months after approval not to much will get me excited at this point The more I look the longer it takes I am now at the point of out of sight out of mine and the time goes much faster than watching the pot that never boils. My SO and I have decided to think of it as the past is gone and today is the very first time we filed and VSC only takes about 3 weeks to get approved like it was in May of 04. So now it’s like starting fresh and we are excited again knowing it will only take 3 weeks and we just started our Journey. So there isn’t any sense in thinking about anything else because it is what it is. Good luck to you all.

  13. im sorry, but this is flippin ridiculous!!!!!!!!

its half way through august and we have only had 7 approvals this month...at this rate i will be approved in roughly februaryyyyyyyyyyyyyyyyyyyyyyyyyyyy

i know that i am not even close to getting my NOA2, but i mean move it already!

Tell me about it its been 96 days for me know and I have done this before in 2004 same time frame and was apporoved in 22 days this is getting out of had. Its only a 90 day visa and after that we have to do it all over again what BS. We have millions of people walking over our borders and us tax paying US citizens cant even get a simple K-1 visa which was ment to be faster to help loved ones be together

    Sorry just venting.

  14. Just was looking for some options and I know Ill get some here. :help: I just found out from my SO today that I put the wrong Date of birth of her 15 yr old son. I Put 1972 instead of 1992 which will make him 35 and not 15. :crying: This isn’t so bad except it makes him 1 yr older than his mother. There are no supporting documents that are required for a child on the I-129F so i am not sure how this will affect the process. They will need this information for her son at their interview I know. Wonder if they will let that go till then or what maybe a RFE saying why is there a 35 yr old in the child column? Oh well what’s done is done. I have her sending me a copy of his birth cert and translation doc’s now just in case we get a RFE. I just hope that is not way its taking so long now. :(

  15. Idont know whats going on but i was toched on 6/12/07 and i think it is because I had a address change at that time but i have had nothing know no touches no NOA2 and they NOE1 says May 9. Its like they just stoped everything.

Personally I think you are due for you noa2 anyday. There are 8 early May couples 5/1-5/12) left IF I counted right. Im sure you are just right on the edge of getting yours. Hang in there. I'd say if you are approved in the 100 days that the last few have been....Yours may be in the next two weeks. Good luck

God I hope so thank you.
