  1. Most people here do it on their own. But its really your choice. If you don't have any complications, taking the time to understand the process and doing it yourself is most rewarding.

If you do decide to use a lawyer. Do your research. Immigration lawyers tend to be more familiar with work visas. You want to find someone who has handled K-1 visas or family visas. Rates vary, but it can be anywhere from $500 to $3000, depending how much they do for you and where they are based. That would be in addition to the regular paperwork fees.

If you do hire a lawyer...INSIST that you review the document fully before they submit it. Check for typos! My lawyer asked me to sign the application and my social security number was a mistype on all forms!!! Make sure you have a copy of the packet too. I paid 800 dollars for the services.

  2. Bush signed the law, but in order for it to work, Brazil will have to enroll in the program, and wait to be approved for it, it will also have to change it's reciprocity law and stop requiring visas from americans.

Don't count on the VWP program for Brazil anytime soon, my guess it will take at least a year for it all to come to reality, if it does come, since the law Bush signed is for country with 10% or less of denied visa applications in the consulates (the bigger the number of illegals, the more they deny) and Brazil has currently 13% of denials.

Also, it's visa fraud to enter US with intentions to marry and stay if you already know it beforehand and are aware of the laws.

Did it say anything about Argentina?

  3. Thanks everyone...hopefully they won't ask too many questions. Not that I mind, it's just really not their business.

My lawyer recommended that the letter say that you are a full time employee, working 40 hours or more per week, permanant hire, and the hourly wage or annual salary and starting date. USCIS can extract your annual salary from that. That's what my letter said and it was like 4 sentences total. I told tmy employer it was for proof of income for a financial requirement and they did it for me no problem. As far as they know it was for a car loan or something.

    Regards,

  4. Thanks!

I understand 100% that I could get a RFE anyways, I just want to make sure I am not missing something. Something that someone else might have done as well when they filed. :)

I submitted photos of when I went to Argentina in June 2006. That is winter there as opposed to summer here. I guess if I was in shorts and sunglasses on the beach it would arouse suspicion for example hehe.

  5. Thanks for the tips!

    Anyone else have any comments?

Passport stamps and photos should be mostly enough as long as the coincide with the dates you claim to have spent together. I don't have any receipts of spending money there, only the passport stamps, photographs, and copies of the boarding passes. I am hoping no RFE.

  6. Thanks for the quick responses... Does someone have the phone number I can call???

I hope these bastards don't reject the doggone application. Is it too much to ask for someone to send and email or even call me and say, hey you forgot the check, send to address etc etc...???

There has got to be a a better way...

1-800-375-5283...Follow RFE prompts. Dont' stop until you talk to a person.

  7. so if I sent my K1 to the Nebraska SC, which then forwards it to CSC...who actually issues me my NOA1? Does NSC send me the NOA1 and then forward it to CSC....or do I wait for them to forward to CSC and they issue the NOA1?

We sent our application to the Nebrasla SC and my NOA1 actually came with the statement "Your application is being processed at the California Service Center"....So I suppose that it came from CSC. Don't worry much about it. It will get processed somewhere anyway.

  8. Hello All,

I'm confused. I keep reading an original signature is required on the biographical form. In this post I mentioned that our lawyer filled out and signed it for my fiancee. My fiancee's signature is not on the form.

Also the letter of intent was a faxed copy including my fiancee's signature. I emailed the document, she printed it signed it, and faxed it to me.

My lawyer also I think only mailed one copy of each biographical form I think.

I'm about ready to send new original forms to my fiancee for her to sign and mail back. I don't know whether I should rush it by express mail, get it back, and send it in with my application to avoid an RFE or should I just do normal mail and keep it on hand for an RFE. Should I attempt a pre-emtpive strike or just wait and see if there's an RFE. I don't want to delay our case :(.

How much longer would an RFE delay us? Also, I know this is silly but does anyone have the proper and updated address to send additions to your case file? I have seen different addresses. We originally filed with the Nebraska Service Center and it was transferred to the CSC. So I assume we mail to the CSC directly now (NOA1 said it is at CSC). But I have read also that I should send it to NSC and it will be forwarded. So confusing.

    Thanx,

    Charlie

  9. Hello all,

In the last month or so my "Based on timeline data, your I129f may be adjudicated as early as" for our I-129f has climbed from August 1st to now Sept 28th. Anyone else experiencing this? My NOA1 was on 06-07-07. Sent the application in May 17th to NSC and was redirected to CSC. It was last touched on 07-07-07 (not sure if touched before that).

She is from Argentina. Does anyone think it will be possible to be together before Thanksgiving or at least Christmas?

Is CSC taking longer to process now?

  10. Hello all,

A lawyer prepared our K1 visa application. The lawyer printed the G-315A and filled it out for my fiancee' (The form was confusing for her). In the signature of applicant box the lawyer signed her name and wrote "For (Fiancee's name)".

Also, for the letter of intent. I typed out a version and my fiancee' scanned, signed, scanned, and emailed back. Is that going to be a problem that it is a scanned copy of the signed document?

I'm wondering if I should just go ahead and have my fiancee sign everything and mail it to me for snail mail in case for an RFE. Does anyone think this will cause a problem. If there is an RFE how long does it delay your application?

    Charles
