We did send in a copy of our DL and a copy of our medical insurance card that had both of our names on it. I will go ahead and make another copy of this and send in. I guess that was not enough evidence So I am thinking of doing this....
Copy again of DL, health insurance card
Letter of explaination about mortgage and utilities
2010 copy of tax return (wasn't done when submitted in Feb)Filed jointly
Copy of my wife's W2 from 2009 and 2010 (she did work for a short time). These show our address with her name.
Go ahead and send copy of front page of 2008 and 2009 tax returns filed jointly
***I did not submit the entire tax return, just a copy of the first page....should I have copied the entire return?
My question is if the evidence is not sufficient do we risk a rejection or would they have us submit to an interview first?
Any other suggestions?

Hi everyone...We need some help
We got married in 2008 and got the 2 year greencard. Filed for the adjustment of status in Feb. We submitted pictures, affadavids from family, tax return, etc.
We got an RFE back for Financial Records and Residence proof. They want accounts that reflect both our names.
Here's the problem... We do not have any joint accounts. My wife did not have any credit so all the utilitis, mortgage, car loans, etc are all in my name (Charles). It was just easier since her credit was nonexistent.
I also just retained sole ownership of our checking account and savings. My wife did open a checking account of her own but it has since been closed for insufficient funds. She doesn't work and she was content to let me handle finances and generally we just bought things together (or I would give her cash to spend).
I do have a car insurance bill which states my wife's name as a driver which does list her as a driver on our insurance...however the insurance policy itself is in my name.
I did just add her name to the checking account and electric bill but the letter says to give evidence "FOR THE PAST 2 YEARS". I don't want to submit this as evidence as it can easily be shown the changes were made after the RFE. I also have a life insurance policy that I just added her to be beneficiary (the policy was from before we were married and I didn't know I forgot to update the beneficiary until checking now for evidence)
We just simply do not have any evidence to give....how should we handle this?
Also there was a request for evidence for residence to prove that both of us live at our house. Again this asks for utility bills and etc and we don't have any of this. Any help?
Will this lead to a denial or an interview?
We don't have a problem with going in for an interview as we are a married couple, reside in the same house and always have. Would an additional affadavid from a family member stating we live together help?
We have to avoid this being DENIED! HELP!!

wow you are lucky!
did you do something special to skip the interview? i mean, your package must have been perfect so they dont ask you any further information. what kind of evidence of bona fide marriage did you give them?
Thanks for all the congrats! I will get our timeline updated this weekend.
We sent it in late August after getting married in July. The only evidence we included was the marriage certificate from the state and a copy of our marriage application. That was it. No other evidences.
We were a K-1. For our original application for K-1 we had phone records, plane boarding passes, passport stamps, letters dating back from the start of our application. The usual stuff.
Oh, we mailed it to Chicago but it got transferred to CSC.

Hello all,
We got an email today from CRIS as follows
The last processing action taken on your case Receipt Number:
Application Type: I485 , APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS
Current Status: Card production ordered. On January 26, 2009, we ordered production of your new card. Please allow 30 days for your card to be mailed to you. If we need something from you we will contact you. If you move before you receive the card, call customer service. You can also receive automatic e-mail updates as we process your case. Just follow the link below to register. If you have questions or concerns about your application or the case status results listed above, or if you have not received a decision from USCIS within the current processing time listed*, please contact USCIS Customer Service at (800) 375-5283. *Current processing times can be found on the USCIS website at www.uscis.gov under Case Status and Processing Dates.*** Please do not respond to this e-mail message. Sincerely, The U.S. Citizenship and Immigration Services (USCIS)
Does this mean we were approved without going to an Interview? Card production ordered means it is on it's way?

Hello all,
My wife has her advanced parole and is about to travel to argentina on Friday. We married on the K-1 visa before her visa expired. However, we didn't file for the AOS until about a month after her visa WOULD have expired. Is there a problem with her being out of status for a month between when we married and when we filed the AOS?
Has anyone had any problems with an AP and not getting back into the USA? Last thing we want is to abandon our application.
First of all, the K1 visa becomes invalid once the foreign fiancé enters the US - it's expiration date means you have 6 months to enter the US. It is the I-94's expiration date that becomes very important. You must marry before that (the I-94) expires (hopefully you did). If you file for AOS within the I-94's expiration date, your status is protected - outside that date puts you in Out of Status.
At any rate - you've filed your AOS which puts you in Pending Status and the AP will allow your wife to reenter the US. There should be no issues - she should (of course) take both copies of the AP, her passport and, if name changed, copy of your marriage certificate. (Some may advise, and it can't hurt, to take a copy of the AOS NOA1.)
P.S.
Her I-94 expired on August 3rd. We married July 28. We filed for the AOS on August 28. There won't be a problem with being out of status for that month correct?
Thank you so much.

Hello All,
Sorry to post this and sorry if it is a repeat topic but we need some information ASAP.
I was under the impression that the advanced parole document, which we have, is all my wife would need to return back to the USA after going home to visit. We married before her K1 expired, but filed for AOS about 5 weeks after it would have expired.
She is leaving Friday to go to Argentina for 6 weeks. Was she ever here illegally? Is she going to be denied entry? CAN she be denied entry because of this?
We are worried. Please help.

Lets say for instance, some crazy reason I am not allowed back in! what do I do? what are my rights?!!!!!!!!tHANKS!!
I think your husband has to file a spousal visa petition and go through the process of getting a K3 (or CR1) visa to enter the US. It's like starting over...fees, months of waiting, interview at Embassy in your country, medical exam, etc.
Some people just don't want to risk that if they think there is reason they could be denied....like the overstay.
My wife and I married with our K-1 visa before it expired. We did not file for our AOS till about 5 weeks after her K-1 visa would have expired. Does this constitute in any way an overstay with the difference between when the K-1 WOULD have expired and when we finally filed our adjustment of status application?
My wife has advanced parole and is leaving soon. I hope she can come back? Any reason why she wouldn't?

I use Vonage to talk to mi amor in Argentina. For us it's only 1 cent per minute though.
To Trinidad is 14 cents per minute. I don't know what your past rate was though. That's in addition to the 24.99 Vonage charges per month though.

So she can still come here without her vaccination record and we can get them all tested or redone here?
-
Hey all,
We got our NOA2 and my fiancee is looking for her vaccination records. Sadly, she isn't able to locate them (although we will keep trying). Her records from her former doctor are also probably lost as well (he isn't practicing anymore and the practice is gone).
What happens if she doesn't have a record of her vaccinations for the medical interview? Should she redo her vaccinations before the interview? Once we are married she will be on my insurance and she can get them here too if we wish.
I read it's not required for the medical exam but from what I hear from others they want this at the medical exam. Anyone else have experience in something like this?
Thanks,
Charlie

Hello all,
Yes I've read the guides.
We just got our NOA2 on October 8th. I'm just curious what to expect next. How do I get the information after this to fill in our timeline (NVC left date and arrive date etc). Does it go pretty quickly through NVC to the embassy?
Does our case number change now? How do I get this information.
-
wow. as far as i remember you and your (ex) fiance have a lot of public drama going on (all the time).
wasn't there something that you didn't believe that he filed the I-129 bc you thought the case-number was a fake?
ohwell, i guess you guys are just dealing with things differently.
Amen....I've seen her post alot of stuff like this. Then she goes away for a while and comes back again.

Hey! Charles and Karina were approved today (filed 05-18) That´s great! Congratulations
So maybe they aren´t having a day off after all...or how else is that possible? Anyway, my crazy hopes and suggestions are: the rest of May filers should get approved this week, June filers the next week and since there are less June filers then the week after they should start July filers
Yeah it's strange. I noticed that the date received is the day to count from. NOT the NOA1. It takes between 140 and 150 days from the day they received it appears. We were in 142.
Thanks for the congrats. Everyone else has to be getting close. Get on the edge of your seat when you hit that 140 day mark since mailing it. Until then try not to stress.

You might have to pay more for the heavy luggage maybe. I work with guys who are engineers and they travel all around the world and domestically with a luggage case filled with tools. So they gotta allow it. If it's overweight though might have to pay more.

I bet there will be a whole flood of NOA2s. Consider this...maybe VSC is not updating the website or sending out the NOA2 notices. Maybe they have already been processed but they are lagging behind in getting the word out. Stay optomistic...I bet it's coming soon for all you VSC filers! Who knows what's going on.
It took us 142 days from the say we mailed it to be approved. We were approved Monday 10/08 from CSC.
-
Congratulations!!!
It's good to be back home and on VJ I was away for the weekend and when I walked into my house a couple hours ago I thought I was going to see some approvals from VSC, including mine and still nothing!
I'm at 5 months today
Come on VSC!!!!
What's up with VSC????? Everything I see is CSC for like the last month. Does anyone know what is going on with VSC? I hope all VSC filers get approved soon. They need to get the ball rolling!

Just so people don't wonder....all of our touches were because of a typo error and my calls asking about this. If we wouldn't have had this issue we would have had no touches at all except being approved out of the blue. Everytime I called and asked about the typo was a touch and a touch the day after or as a result of a letter received (which we got a letter from USCIS about on a touch date also). Our NOA2 came out of the blue with no immediate touches.
So those of you with no touches don't worry. They don't indicate an approval is near. An approval can come with no touches at all until approved.

APPROVED!!!!!
We were approved yesterday! I can't believe they were working on Columbus Day!
We were approved 146 days from filing, 140 days from our NOA1 date...
CONGRATS!!!!!! US TOO!!!! Columbus Day! An easy day to remember and a day of meaning. I'm glad we were approved on this day!
Congrats

WE WERE APPROVED TODAY. OCT 8th.Hi Charlie and Kary!
Congratulations! Felicidades!!
Soon you will be together, this is great!
So, I just have a little question: How you received your approval?
By e-mail, letter, USCIS website?
Just curious!
Abraços!
Ali
Received by email by CRIS. We didn't have a problem not receiving our NOA1 or with the website not updating. I know some people had problems with this but it was a smooth sail for us minus the wait.
-

I guess not. We got an email saying a notice was mailed today. Thanks everyone. I know more are soon to come!

mmMM with all those touches, and at 140 days...mmm...I think I smell a NOA2 coming your way
and you'll see, after that, time flies like an arrow, you won't have time to think about this long wait before she's there
How are you guys holding up? it's such a test going through this wait, but I'm sure you will pass it with flying colors
Saludos,
Caro
We're doing well overall. She gets nervous sometimes about leaving everything there behind for going so far away but I imagine everyone does. We speak almost everyday either by internet or telephone. It would be great if we can get our interview before the end of the year. After the interview she wants to wait 2 or 3 months to prepare by leaving her job, socializing with her family and etc before leaving. At which point I'll come again and we'll travel back together. We both are excited though. The long waiting is ending soon
Regards,
Charlie

Thank you so much everyone for the useful information!!
We did submit a copy of our Driver's licenses with shared addresses...I guess it wasn't enough
I am planning to submit this:
Copy again of DL, health insurance card
Letter of explaination about mortgage and utilities
2010 copy of tax return (wasn't done when submitted in Feb)Filed jointly
Copy of my wife's W2 from 2009 and 2010 (she did work for a short time). These show our address with her name.
Go ahead and send copy of front page of 2008 and 2009 tax returns filed jointly.
Copy of my wife's closed bank statement showing her address.
Trying to get copy of medical expenses and account tie in
Trying to get a statement from driving school for her and tie in checking account paying for it.
If they feel an issue is not resolved do they typically straight up deny application (this is unbelievably scary)? Or do they typically then request an interview to sort out details?
