Sorry if I wasn't clear, but my parents are US citizens as of 2018, and I was thinking of filing under their name (if something like that is possible and the existing I-130 p.date can be retained)
F3: Married sons and daughters (any age) of U.S. citizens.
F4: Brothers and sisters of adult U.S. citizens

Bottomline: Would you recommend changing the filing category from F4 to F3? If so, what happens to the original priority date?
Situation:
- US Citizen Brother filed for Sister living in India in May 2011, Married + Two Kids
- Parents became US citizens in 2018
- F4 Priority date as of Aug 2023: 22FEB06
- F3 Priority date as of Aug 2023: 01MAR10
What would happen if we apply for a change of category at this point (F4 to F3)? Would approval be any faster or does the priority date gets reset? Kids are turning 21 but are protected under CSPA for now.
Please share your thoughts. Thank you.

I assume you think the 12 years of processing so far is enough to protect your children under CSPA. The problem is that the visa bulletin is not under linear progression - that is, the months as years do not progress with current months and years. Right now the wait for F4 India is about 18 years. In 5 years time, the wait can balloon to 20 years or 25 years. Or it can stay the same or reduce.
The longer USCIS takes to process the I-130, up until when a visa number is available, the better.
Thanks for the feedback. I have no issues for waiting for I-130 approval up until the point visa number is going to be available. As all of you have pointed out it is wise thing to do!
I was just curious about normal processing time 😁
Once I-130 is approved, does it get transferred to Indian Consulate and they calculate the CSPA age when priority date is current?
if it is taking about 16-18 years, I think we might be looking at 2027-2029 way things are going right now. That means eldest kid will be about 28 year old.

sorry.. what I meant was California Service Center I130 processing time has recently dropped to 80 months, (previously if I recall it was like 120+ months) hence I can initiate the case inquiry.

Yes.. kids are turning 21 soon so I expect CSPA will allow to subtract I-130 approval time from their age. Did I get that correct?

Anyone here who is waiting for next step on I-130 f4 approval? Priority date is June 2011(country India) and only thing we have heard is NOA1 - receipt back in 2011. It has been one long silence since 2011 but recently I noticed California has dropped I-130 processing time and case is eligible for a follow up. I'm wondering if any one from 2011 has heard anything back from USCIS in recent time. It appears that total processing time is close to 13-14 years so earliest I expect any movement on the case is 2024.
Any thoughts, Suggestions?

Finally, after FingerPrint date of 10/21/2016, Interview was scheduled as of yesterday.
"On July 13, 2017, we scheduled an interview for your Form N-400"
Those of you who applied last year (2016) and still awaiting for interview date really doesn't need to be panic. Based on system changes last year, given my last name is bit longer and quite a few folks stuck in background check based Oct fingerprint date - I was hopeful for things to fall in place at the right time. I did consider reaching out senator after 1 year of filing date but it wasn't a pressing need. If my previous data crunching is accurate about 15% applications were delayed (or slow to process) due to unidentified issue with the system and/or manual review.

Thanks those who did little bit of data mining. I picked up 70 cases close to mine and figured about 8 cases are still under Fingerprint Scheduled status. Out of 8 cases, 7 are dated October 4th, 2016 and 1 dated October 11th, 2016. Now I wonder if USCIS/FBI ran into some Fingerprint check issue on/around October 4th??

Yes.. I think at this point don't have much option but to let it play out. Only other thing I can think of recently we had to apply for her Indian passport to be renewed as it is expiring soon... but local authorities in India suggested it wasn't related to passport renew. (already received renewed passport)
If there are other similar names on FBI radar certainly it make sense to vet as much as possible.
Hope we will get some clarification soon... fingers crossed!

My wife applied for US Citizenship (N400) in September 2016 after being GC holder for about 9 years. Her status online is still Fingerprint Scheduled - which was completed in October 2016. She is permanent residence of US, ever since she migrated to the states. Her current non-us passport has address of country of origin - India. To my surprise, recently, local authorities in India approached my parents (Who luckily happens to be in India for few months) in reference to getting Police Clearance Certificate for immigration purpose.
This is extremely surprising as what may have caused USCIS/FBI Name Check process to lead all the way back to India. Needless to say, her records are clean (minor traffic violation). I certainly have faith in US Government processes but I have no idea what to expect from Indian authorities because we don't live there.
anyone else who applied in last year or so has observed change in process? In my extended family almost everyone is naturalized citizen and USCIS never asked for Police Clearance Certificate.

I-130 sent to VSC on 22 March 07 - case transfered to CSC 19 May 07 and got an approval email today dated 07 Jun 07.
looks like CSC is getting things back in place.

Applied for IR-1 on March 26 and I received today (May 21st) an email stating my case is transfered to California Service Center!! anyone on the same boat? any idea how long it will take from here to get NOA2 and an Interview date??
Looks like VSC is slow because of H1B processing.

It's kind of a stupid question, but who calculates CSPA age and whether it is applicable for the derived beneficiary or not? NVC or local consulate? or does the petitioner/primary beneficiary need to prove/fill out a forum?
