    Received an NOA in mid May and received a document regarding a lack of medical exam. But we noted that those will be brought in during the interview. Since then we have not received anything else.

  2. I recently mailed my papers in and I stated explicitly on the cover letter that the medical would be submitted at a later date or brought in at the interview.

     

    We didn't include it due to wanting to get the packet in faster and not having to look for a doctor that might be closed.

     

    I mentioned it on the cover letter because I did not want USCIS to think it might have gotten lost in the mail or something like that.

  3. For an update for future reference, I sent in 12 months of monthly summary (not itemized) statements  of my savings and checking accounts and itemized statements of the shared checking accounts.

     

    The monthly summary statements were redacted in the format described above with only the last numbers of the account shown. The itemized shared checking statements had the full number shown.

     

    After closer reading of the instructions I am not even sure the asset info is needed if you are above the 125% poverty line. It is not completely obvious so I included it anyways. We shall see what happens. Will update accordingly.

  4. Greetings! I am currently filling out the paperwork for my wife to adjust status and am having some frustrations with the i944 and the info it is asking for.

     

    I have filled out the i864 for my wife and am well above the 125% poverty guidelines so I do not have to include asset information. Yet since my wife and I are living together I am included in her household, whose assets the i944 is asking for.

     

    She does not have any assets except the shared checking account we opened up several months ago. I will include the 3 months of itemized statements for this account. The rest of the assets listed are in my name. Mainly my 401k, savings, and checking account. So basically the i944 has turned into a document about my financial assets -_-. 

     

    I really do not like the idea of sending the government 12+ months of my savings and checking statements given the amount of sensitive information they contain that they simply do not need to know and haven't required on the i864. My idea is to send them 12 months of account summaries (rather than itemized statements) with the account numbers redacted in the xxxxxxNN format (the last two numbers visible). Has anyone done this? Will they just send me an RFE if it is not acceptable? It seems like they wouldn't care given that they do not require this information on the i864. I imagine the form is just poorly written and they are not expecting the sponsor to be in the petitioner's household.

     

    Given how new the form is, I wouldn't expect solid answers, but thoughts would be appreciated.

    If your fiance leaves the US, then she can't have preconceived intent to AOS when she returns. At POE, preconceived intent to AOS with the J-1 is 100% illegal.

    Them coming here MIGHT be an option that we would have to discuss further. But for various reasons we both feel uneasy about that option.

     

    With her current J1 in the Au-Pair program, she no longer has any vacation days so leaving to go see her parents and returning is not an option. The next time she leaves (either Feb. or Mar. 2020) her visa will have expired. Hence the K1 application now as she will need a visa to re-enter the country with. With current processing times it would put the wedding in August or September sometime.

    She is in the US right now on a J1, we met back in May. We are going the K1 route because her parents want to meet me before we get married. This really complicates things. She will go back to the Netherlands in March at the end of her visa here. I will go over there at the end of April.

     

    Otherwise we would just get married in March and do AOS.

  7. Hello, I have been filling out the I129F and getting the documentation in order for the past two weeks. It has been pretty stressful since there seems to be so much information scattered around that conflicts.

     

    Here are my questions regarding the I129F and supporting evidence.

     

    1) The instructions say to put N/A for any question that does not apply to you or NONE when it asks for a number you don't have. It tells me to not leave anything blank. So for example, when it asks how many children my fiance has, I am to put NONE or when it asks for my A-Number, I put NONE since I do not have one. I also put N/A for the preparers section, ect. Essentially I have nothing blank in my I129F, putting N/A or NONE wherever there is a blank (even in the state / province sections). Am I understanding this correctly? Will it hurt to have these there?

     

    2) For the evidence of having met for the past two years, I currently am using a word document to organize the pictures from my phone and I have dates, location, and names of persons in the pictures typed under each picture. Is this acceptable? I have read differing accounts. Some people do glossy prints, others do printer paper. Am I correct in thinking this is not that big of a deal as long as you have pictures showing that you have met and they are captioned? The instructions are vague so I think this gives a lot of freedom in how to do this. I am tempted to just go do glossy prints from Walgreens and send them in also along with the word doc, but I like the idea of sending in only printer paper for a neater application.

     

    3) My fiance is currently in the US on a J1 visa. There is NO two year residency clause in her J1. Will this be an issue when applying for the K1? She has to return home next March.

     

    4) Do I really need to have a 'love letter' type of explanation for the circumstances of meeting explanation? Or can i just give the plain facts and leave the rest out?
