Congrats KevFabi At first I thought your visa was approved or something... lol.. that was too much excitement for me.. good luck on your journey!! hopefully we all get approved soon, but it looks like even mine will take until late October - mid November now.. even my own estimates, VJ estimates, and G&A estimates will all be wrong :crying: I guess all we can do is wait.. calling them through the RFE trick will just slow them down even more.. at least wait about 90 days before something happens on the I-129F...

Guys I'm still waiting for the check to be cleared or the NOA1, or even for the package back...but I cant find any info ...I dont know if it's been lost or they transfer?? I call them every week nobody cant find the package, I just don't know what to do...They keep telling me to wait for 30 days and sometimes 45 ???

Anybody have any advise or have been passing tru this ???

I'm thinking ..should I sent another package with the whole process to Chicago??? maybe with note letter explaining that we sent one and we never recvd anything??? I'm just confuse...I see some members did the same mistake but everybody was successfully transfered to the right place between 16 and 20 days...

First the NOA1 form I-130 never rcvd, them I filed for the I-129 without the NOA1 (already nervous bc of this) and just to complete my lucky we sent to wrong address...It's a lot of presure right now... But really thanks for your advise...

Supernova did the same. Sent on 6/15. It took till 7/11 to get the NOA 1. I would say give it till the end of the month. if nothing, then send another one direct to CSC per the new rules. Not sure about the payment though since it is free after 7/30 so i am assuming there will be new forms / instructions posted.

It's been 23 days that we sent the I-129 to Vermont instead Chicago...my check has not been cached yet and I dont have any info. We dont know if they forward to the right address, or if it's been lost ...We call the #800 yesterday and they can find anything on the system yet. They even told us to wait for 45 days???? It's crazy ...I'm just to depress right now,

I saw one member who did and they cashed her check on 16 days....I'm wondering if anybody is passing for some similar situation..???

PLEASE if anybody did the same mistake I ask u to share with me your experiences...

The questions is can he stay till he get the answer??? lets assume he did not get anything till July,29...Can he stay and wait for the answer? or should he leave...before expired..???

As far as I'm aware, since he has NOA1 he can stay until he has answer. Only overstays past 180 days result in automatic bans.

EDIT - Actually, this post doesn't belong in this folder I don't believe. Your friend isn't marrying or engaged to a USC right?

Hello everyone. I have a question:

My wife sent our I-129F package to Nebraska Service Center instead of sending it to Chicago. I called USCIS call center and representative told me to wait that Nebraska office either will forward it to Chicago or will send back to my wife. Rep. didn't know anything about how long it takes to do this.

So this has happened 2 weeks ago. Does anyone have an idea how long do we have to wait before we get something solid going on? Or do we have to apply for the new one? As you all know it is SOOOOOOO irritating to wait.

Any help would be greatly appreciated.

We are going to have a case number finaly !!

I'm glad you decided to send the I-129...we will be almost the same timelines for I-129, but PLEASEEEEE...dont forget to send to CHICAGO..ehehehe ....i did a mistake and I paying the price now (sent to Vermont_)...

I sent cover letter explaining that we never rcvd the I-797. We sent copy front/back check, copy of I-130 petition, copy of the DHL sign and recvd by them and copy of the online sattus with WAC# as evidence for I-130 filed.

Okay.. I decided to send out I-129F without I-797 NOA1 (I-130)..that still have not rcvd due to backlog or frontlog (whatever the prob is) at USCIS/CSC, computer glitches..etc..etc.. I called USCIS and asked rep if I could include as evidence: copies of cashed & stamped (uscis receipt #)check, usps deliver conf.card, online case status letter. Representative told me this would show as evidence that I-130 was filed, received and have receipt #. Now.. I already had a cover letter prepared (made by agency working with us in Jordan and signed by me) that says I've included (along with fees and other necessary docs).. my I-797 (for I-130 form). Should I re-do this letter or just add a memo explaining that I-797 was stated to be sent out (refer: online case status letter) but never received due to USCIS backlog and receipt system problems. But i have include the following documents (listed earlier). Im not sure exactly what to write and do.. Hope to get some feedback, advice, info.

I'm sure others with give their expert advice but if I were in your shoes, I would just forget about what I sent to Vermont and instead send the same application to correct Chicago address. I hope you have made copies and have duplicates of any originals that you may have sent.

Instead of waiting for them to either send it back to you or forward it to Chicago, in my opinion, it's best to just send another application with fee and everything to the correct address. By sending duplicate application you can't confuse USCIS any more because they are already too confused. The only downside I see is that you will lose the application fee.

Beginning in August, the new instructions are to send the I-129F for spouse directly to the service center anyway. I would simply relax and wait for the receipt. Inspect it closely and make sure it says I-129F for spouse as the "Case Type" in the upper right hand box.

Sorry but where can I find this "Case Type" ....on the application??? I-129? sorry...

On the receipt you don't have yet. as in ...receipt...Inspect it...

There is no "application" yet. The I-129F is a "petition". If approved, it allows the foreign spouse to "apply" for a visa.

I need some help about the waiver process, my entry was denied in April/2007

I was in the US on B1/B2 visa and I've overstayed the last time more then a year.

We got married on February/2007 and before we file for the I-130 we had to leave US back to my country Brazil.

Me and my husband we try to go back to the US April/2007 but they only let him in separating us on nyc airport border, they told us that I must to go back to Brazil so we can start our paper work from there.

My husband is in USA and he filed for the I-130 and soon he will file for the I-129F(spouse).

On my passport, I was stamped on the top of the visa (cancelled) with the annotation 222g and .212(a)(7)(A)(i)(I).

I paid for my own plane ticket and returned to Brazil the same day. The officers told me I'll not be ban for the 3 or 10 years.

On the paper that I have copy says : " I was inadmissible under section 212(a)(7)(A)(i)(I) and voluntarily withdraw my application and return to my country in lieu of a formal determination of her admissibility by CBP under section 235 (B) (1)..."

As we wait for our interview in Brazil, for our I-130 or I-129F (K-3) sometime in the next couple of months, my questions are:

- Does I need a to file for 601 waiver now? and how long this may take?

- My husband has some serious health problems, and he's going for special treatments right now, I was wondering about what else should I do before the interview to don't make any delays anymore.

- If we need the waiver can we start the waiver now?

I really appreciate if anybody is willing to help me out with any information. Thanx

Hi i know what u've been through. I had the same case but i didnot overstay.My passport was stamped with the same violation ( u can check on my posts).withdrew my application for admission and flew back home using my return tiket.with regards to ur question if u would need a waiver as of this moment we wouldn't know unless u get done with ur interview the Consular officer would tell u based on the outcome of the interview. But i could only advice based on my experience I just had my interview last week i was worried sick but God's will i got approved now i'm just waiting for my visa delivery. All i can say is just be truthful and honest on your interview and i'm sure everything will work out just fine. Just as the consular officer told me they favor love as long as your honest and truthful with all ur declaration in all the forms u filled up.Just in case u would need a good lawyer for waivers i would suggest u check on Gurfrinkel.Just keep on prayin because He only knows whats good for us.
