  1. So I'm an F1 student, my I-20 expires at the end of the year when I graduate. Also worth to mention I just moved from Texas to Virginia so I guess by law I should change my DL asap. I have an EAD and I know I can renew my driver license now. I also just got my interview date notice in the mail for the first week of January (Interview will be in Virginia). So I wonder is it better to wait to renew my driver license with a green card? On my current DL it says limit-term so I wonder with a green card will my DL  be valid for a longer term?

     

    Another things I am considering is, when will I get my new DL in the mail during this holiday season? Will it be in time before my interview? I need a government photo ID for the interview appointment so what would happen if I were still waiting on the new DL?

     

    Another thing worth to mention is my DMV appointment is tomorrow (I had to wait for 2 months for this appointment). I just got the interview notice letter yesterday so this all came short notice!

     

  2. Hello everyone, I am interviewing for a job that requires to be US citizen or PR. I have an EAD so technically I can work. It's just I am not sure how to explain the situation to the employer? I am married to my husband who is a US Citizen so it's just a matter of time before I get my green card. Has anyone experienced this before? 

  3. If you're November 2019 filers and especially in Houston, Texas please give me some updates on your cases. Have you got your interview yet? What's the online status of your forms?

    I filed last November in Texas and it's been almost a year but interview has not been scheduled for our case yet!! I'm freaking out right now. I haven't received any RFE, I just renewed my EAD successfully and just got the new card.

    I have a few questions, I hope someone can help me :(

    1. I have received the EAD card in January, my I-485 online status says "Case is Ready to Be Scheduled for An Interview" for months, my I-310 only says Case was received, is this normal? Is it supposed to say Accepted by this point?
    2. On USCIS website it says the processing time for I-310 is only 6-8 months and the current receipt date processing is already for March 2020. Should I submit an e-request for outside of normal processing time?
    3. My lawyer just told me it's a mess in Houston and it is currently taking a lot longer, is this true?
    4. Since I've been living with my husband in Virginia, my lawyer said I have to update my address and he will transfer my case to Virginia to process because he thinks it's much faster here compared to Houston. Which service center would handle my case then? And is it faster here than in Houston?
    5. What happens after my case is transferred to Virginia? Is the waiting time reset back to 0 again??

  4. So I'm a graduate F1 student. I got married, filed for AOS last October. I got my combo EAD and have been working part time during this summer. Our AoS is pending, we're waiting for an interview date. I'm still an F1 student and Fall is going to be my last semester for my graduate program. I've just applied to an on-campus job as a teaching assistant, too. I wonder, 

     

    1. Can I keep working my off-campus part-time job during the semester with my EAD while maintaining F1 status?
    2. Can I work my part-time job (off-campus) and the TA part-time on-campus job with my EAD while still on F1? Would this make me lose my F1 status? 
    3. I don't mind losing my F1 status if that's what it takes to work 2 jobs, but if that's the case, do I need to let my school know?
    4. If I'm allowed to work full time during the semester with my EAD, do I need to tell my school?

     

  5. When I applied for my F1 visa at my home country in October 2018 they already took my fingerprints on the day I had the interview with the Consular officer. USCIS website says fingerprints are valid for 15 months. I just got married and my application was sent on October 30 this year. Yesterday I just got all 4 receipts for my application. I'm waiting on the biometric appointment letter.

     

    Will I still have to go in for fingerprints again in this case? How can I find out?

     

    I checked the status of my 4 forms on USCIS website and they have not mentioned anything yet regarding the biometric appointment apart from they only have received my fingerprint fee. I've heard for some people who didn't have to take fingerprints again, the fee will not be refunded so there is no way to tell yet.

     

    I dread to know when my appointment if I have to redo it because I will be out of town for the whole Winter break, is there any way I can find out ahead of time? I called USCIS but they were not able to answer me.

    Literally my thought right now with my case as well. The legal assistant made several typo errors on my application. I've paid them the first out of three installment of their fee and I'm not satisfied with such sloppy job at all. some good things came out of it is probably the lawyer's advice for us. I wish I had found this forum sooner, I could have done a much better job filling out forms than this *_*. Our situation is a bit peculiar. I'm on F1 for grad school and just got married to my husband who is a PhD student in a different state so we won't be able to live together for another year. That was why I felt like we needed the help of a lawyer who is actually very reputable with a high successful rate where I live. Another thing I'm on the fence about just going on handling the case by ourselves is at least with the lawyer, he's accountable for when something went wrong on his part, which already did 😕 and he knows the system well so his knowledge and experience should help better than none...Again really I hope for something better to come out in the future here

    It was denied because they did not properly answer the RFE for tax returns/tax transcripts which is a big mistake.  

    I hope that's the case. My lawyer office made several small errors in my application, the most concerning one is wrong ssn (repeated digit in the middle leaving the last digit out) for my husband on form I-864 so I am really nervous about this. Like, what if they think we used a fake ssn or if the ssn belongs to someone else and the info doesn't match...wouldn't it make my husband illegible to be my sponsor? I'm not sure about this but so far I've heard that I-864 will be processed with I-485 which will be handled separately from I-130 (my husband's ssn here is correct) so pretty much the only way they know of his correct ssn is by looking at his tax transcript. I've been asking around and it looks like the consensus opinion is it's not much of a big issue and should not affect the progress. The lawyer said to correct it at interview or unless there is an RFE issued otherwise he wouldn't want to risk delaying the application. I've checked USCIS website online about e-request to correct typos but they don't have the option for I-864 available for me to do so.

    You have to just hang on an wait for the letter. Yes we all have seen denials of I-485 some are small errors. Seems USCIS is really flexin their muscles. I just had a friend denied because she submitted the account transcripts after an RFE to submit more financials.
    Her husband got the letter to appeal or leave country within 30 days. They choose leave within 30 days she will refile for him later (He had things to do back in his country anyway and couldn't leave before).

    I just hope your lawyer truly sent what was needed and didn't do a lawyer thing and omit wand hoped for an RFE (lawyers are famous for that. Thinking USCIS always will send RFE when they need something.

     

    Just be patient wait for letter.

    Do you know what those small errors were that led to denials? I noticed that you're in Houston, is your friend's local field office in Houston too?

    Yes, She does, i informed her yesterday about the denial and she was surprised as well, she said for the most part denials are given after an interview, but I was looking over the petition she sent to USCIS and I found about 5 small errores, from date of births to country and city names, Im not sure if its because of that I am still waiting on a letter and so is she. 

    Oh my goodness! This makes me scared now. I hope that is not the case...My application has some typo mistakes too.  If your lawyer also receives updates on your case then you didn't miss any letters from USCIS. Are the mistakes in I-485?

     Please keep us updated.

  10. Update:

    My lawyer replied back. He said it should not cause any issues in processing the application so the best option for now is to wait till interview to correct or if they notice and send RFE, otherwise the application is mostly based on the relationship of the marriage, and my husband's status as a US citizen. I've been asking on forums and seems like the consensus opinion is this is minor, I hope it is really the case.

    Once you have the notice, you can followup with the receipt # on the USCIS website or any app that keeps tracks of your applications. But 3 weeks is kinda borderline late to receive the notice. It usually takes mostly 2 weeks from the time USCIS receives your application. I got the text update 3 days before i got my notice in the mail.

     

    USCIS uses usps to send out the notice and there have been reports of usps loosing the notice but in your case I am guessing you must have filled out the concurrent I-130, I-485, I-765 and I-131. So, loosing 4 notices is highly unlikely.

    I just called USCIS. They actually gave me receipts on Nov 12! They are being sent to me. So I was able to get three receipt numbers for I-485, I-765, and I-131. I just added the receipt numbers to my USCIS account and now able to track them! Not sure why they haven't mentioned I-130 yet but she said they have received all four, just the 130 will be under my husband's name?

    Ah! That is very irresponsible on the lawyer's part as any seasoned immigration lawyer should know that the form G-1145 is very important for updates and notifications about your application. There is no fee for the RFE. USCIS sends a letter explaining the RFE and documents they need to move forward with your application. I would have advised you to call USCIS to check the status of your application but without a receipt number, I am not sure if they will be able to help you out. That is why G-1145 is so important because USCIS will send you a text with your receipt number and updates about your receipt being sent.

    Oh gosh, yeah I feel quite beat up over this kind of unprofessionalism. I might as well could have done a better job researching on here and do it by myself at this point.  I can just follow up on it later with just the case number after they send me one right? I hope that's the case! I'll just try calling USCIS and hopefully they can identify my application with my husband's info and my info :(

    Did you not fill the Form G-1145 to get e-Notifications about your application? I got a text as soon as my application reached USCIS and another notification when they sent out the receipts which was within a week of my mailing the application.

    Unfortunately my lawyer did not fill that form for us and I had no idea about that form. I'm waiting for my case receipt so I can track it on the USCIS website. Did you have to pay extra fees for the RFE and correcting your info beside the mailing fee?

    You might get an RFE for the I-864 as each form is processed separately. I received an RFE for my I-864 as I missed to check a box. Don't worry about it and when you do get an RFE, just send the updated form.

    Thank you for your reply! Did it delay your process significantly? Did you redo the entire form or just submit the pages that applies? Also it's been almost 3 weeks now and I still haven't received the receipts yet, I don't know what the issues are.

    Hello thank you for the reply! I checked on the USCIS website and they say they may use the SSN filled there to verify if my husband is qualified to sponsor me so I'm just very nervous about this. Do you know if such is the case and would they deny my application because of this?

    I'm an F1 student who just got married to a US citizen and he's sponsoring me. We're both in grad school, my husband worked for a couple years and now just got offered a Phd research position. We're currently living in different states due to school but we meet each other twice a month and I'm going to spend Winter break with him.

     

    The immigration lawyer filed and filled out all the forms for us, the entire AoS packet was sent to the Chicago lockbox on Oct 30. I have not received any receipts yet. I was a bit concerned so yesterday I requested to review the application info again and lord and behold, the legal assistant made an error in form I-864 in typing my husband's ssn number (repeated a digit in the middle twice and left out the last digit). Beside that, his ssn in form I-130 is correct and we also include his tax transcript of 2018. His street address, city and zip code are correct but the state is not (VA not TX). Needless to say I feel very upset over this, I find this very unprofessional. This is not the first time I had to correct her and she was rushing me when I wanted to review in details the application before it was sent out, she assured me it would be double checked by the lawyer again. I sent an email to the lawyer past midnight yesterday when I just found out and so I'm still waiting for his response on this.

     

    Put that aside, my main concern is I do not want to delay or jeopardize the whole process. How serious is this typo mistake? I have not received case number or the receipts yet so how can I fix this? I imagine the sooner the better before they proceed to something else right? 

     

    Please share with me your experience or your knowledge on this. I'm so worried right now, I can't even focus on studying. I know the EAD takes a while to process and I really need it to be able to work :(. Thanks a bunch to whoever comments.
