I wonder if I can petition my mother first then later on my father. I know my mother can petition my father and my brother but I am not sure if my mother can work due to her lack of english language understanding but I need my mother first so that she can take care of my kids. Or is it okay for her to petition my father and my minor brother even though she doesn't have work? me and my husband will just give them our affidavit of support? because by that time we can have double job for sure.

If you are not going to extend your K3 then you will file for a new EAD along with your AOS.

Correct, EAD based on a pending I-485 costs nothing. Renewing your existing EAD before filing AOS will cost you $340 more.

File I-765 along with the I-485, and code the I-765 (C )(9 ) based on pending I-485.

i wanna know if i have 45 days until my visa expires or if i have 45 days until my I-94 expires to file for my visa extension. I want to know this because I have file for AOS on a K-3 visa. My visa expires before my I-94. My Visa expires on May, 16 and my I-94 is on July 10.

This has nothing to do with US Citizenship, Movint this to AOS forum.

You entered the USA July 2007, your I-94 card should expire July 2009. The expiration date of your visa is the date that you must use the visa to enter the USA by, it has nothing to do with when you should file AOS, you have until your I-94 expires to do this and preserve your status.

K-3 can file to extend their visa using I-539 http://www.uscis.gov/portal/site/uscis/men...00045f3d6a1RCRD

Note: You WILL need to do a full I-693 medical to adjust status, the medical for the visa was good for only 1 year.

My visa will gonna expire on May 16, 2009.. and we still ddnt apply yet.. coz we are waiting for my husband's 2008 taxes.. and my mom in law that will gonna do that affidavit of support is taking so long to do it =(.. what am i gonna do? am i not gonna pass? am i gonna go back to my country?.. sorry kinda late reply i havent been here in visa journey coz im kinda bussy playing online game.. hehe

anyways, we just called the embassy call center 2 times then the number in Manila US Embassy, 1 time.and that's all.. what im thinking now is maybe because of my birthcertificate in NSO coz whenever im getting the copy of my birthcertificate in NSO its always on MANUAL so i usually get my NSO birthcertificate for 3 weeks to 1 month. hmmm thats it.. well i know how u feel now that u are so worried.. but they always said if u have a pink slip then thats a good sign..so just relax and also on the time that i got so deppressed coz im thinking im waiting too much.. I tried to forget it for awhile and think of something or do something that i will gona be bussy of. but just keep the faith! it will be given to u soon... take care always!

1. affidavit of support form or I-134 => ( http://www.uscis.gov/files/form/i-134.pdf ) note: u need to pass the 125% poverty level ( http://aspe.hhs.gov/poverty/07poverty.shtml ) if u think u are not passed u need a co-sponsor that is above 125% above poverty level and it should not have many dependant.

2. your income tax return or w-2 form of 2006 (if u want to include your 2005 its okay too)

3. copy of your passport (include the date of when u went to her)

4. pictures (that ur both together)

5. letters or ur chat conversation ( its okay if its too many eventhough the CO will not gona read it all, its just 4 proving that u are always talking and ofcourse if she have her own computer, she can just print it here)

6. remitances

7. phone bills (if u have)

hey everyone i'm new here, my husbands visa was denied at he's interview and there sending the noir can anyone give me an idea on how long it will take for me to get it and what do they need for the noir as far as proof he was denied under 221(g), the second question is what is 221(g) any advise would be very helpful

huhuhu.. until now.. its still processing.. my hubby called again in their call center, bcoz he dont wana call on the number vsmtghdy gave to me.. coz he said hes afraid to talk to filipino, and i dunno why its hard for him to do that.. hes always saying i should be the one who checked out on that.. well anyway the operator said..my paper is still in processing and she said the processing may took 6-8 weeks..and told my hubby to call them back again.. so I dunno..

I am from Manila, and yes i am checking in thier text hotline and site always.. and so as my hubby too, he's checkign always in their site and until now its nothing.. and this day their system down.. and what it sucks more is the number that i gave to delbros.. was broken yesterday it always said "Insert sim card" on any of my phone.. so thats really sucked! and also this is the last day that the operator gave us to wait. coz she said call them again if the visa wont come until 31st of may.. and vsmtghdy thank u soo much! for giving me this number!! coz when my hubby called to thier call center it charges him 18$ in like 1 or 3 minutes..

yah i will gona update if ever they delivered my passport.. Im really getting so sad..

i got interviewed last april 17 and until now no visa coming or even text from delbros that my visa is out.. my hubby already called them and they said.. just call them back if its on 31st still no visa come.. but then no info if im approved or whatever they are doing to my visa.. i ddnt get any paper just the pink slip and my interview letter(from the packet 4) from embassy..and im really aware on the things they will gona give to me at that time.. so i know im not on AR but i dunno why it took soo long!! Its really deppressing! I swear!
