  1. Hi everyone,

we are happy to say that we have finally been approved. Recently we had a 2nd interview and the lady officer said there is no risk found after risk assessment they performed. she didn't even want to ask any questions regarding AWA waiver nor NOID/RFE evidence we submitted. She simply asked our name, birthday, address and parents name. And she approved us!! Praise the Lord! It took us almost 4 years to get approved but i think this was all God. If you have any questions please message me.

But are you not AOSing from a K-1?  How were you able to get the visa in the first place?

No. That is why this thread was moved to CR-1.

I initially came to the states with F1 visa. I met my husband over 10 years ago in college. We have dated few years back and broke up. And we rekindled our relationship and that is when we finally decided to get married. So I have gotten married in the states. Have not left the states. We were trying to file Green card application and came across Adam Walsh Act so we had to hire an attorney for that.

I’m confused though- why is this just now an issue for AOS?  Wouldn’t it have been an issue for the actual petition?

No it would be an issue with I-130. So you are correct. But my concern is that we do not have any idea whether our waiver has been approved and whether the USCIS officer will be giving us approval on our AOS interview or not. There is no way to know whether our i-130 has been approved to move onto I-485. Sorry for the confusion. Never saw it that way to create confusion.

Why did you need a waiver?

Sorry, i didn't include any details pertaining to the case that My husband (petitioner) was involved. He was charged with possession of few pictures of girls who "appeared to be younger than 18" and served his time in jail for 42days and he has finished all the requirements and counselings, etc. He was very remorseful and he has told me all the details before we got engaged. I chose to forgive him and we decided to move on. After much research, we hired an attorney who is well versed with AWA and she told us to file the waiver with the rest of the green care application up front. It was difficult to obtain all the documents needed and it took us forever to do it.

  5. Hello everyone. I understand this is under K1visa but i could not find any other forum specifically talking about AWA waivers except this one.

We filed our package with the waiver including all the documents that we have gathered over a year and a half in July 2019.

Having researched about adam walsh act and its policy in USCIS really scared me and my spouse.

    (We got married last year)

we received biometrics for beneficiary (nothing for petitioner since we have submitted everything up front i think), finished the biometrics. Just have been waiting for EAD card but hasn't arrived. We aren't sure whether they have finished reading our package including the waiver and supplements. No NOID's or RFE's so far. However we recently got notice to appear initial interview of AOS for November. We want to know whether this is a good sign. Or is it going to be a false-hope. We have been praying ever since the incident took place and having to deal with such extremely difficult process. I wonder if they will be just leave us hanging and wonder if they will ever approve our case. Typically the interview would be the last step for green card, but having Awa is huge burden on our backs... anyone who got approved, has any good ideas? And maybe care to share their steps of their own process? What else can we do?

thank you for reading this post and we humbly receive any criticisms/opinions/ideas/recommendations.

Grateful to be part of visajourney with you guys.
