My understanding is that if you ask to speak to an immigration officer at least twice during the phone call, the NSCS representative is supposed to transfer you to them. Once you get the immigration officer on the line, you will need to reverify your information, and then you can ask for your CR I-91 receipt number, to track your case online. The NSCS representative won't have that receipt number in their system until the biometrics letter is sent and their system updated.

What exactly is an entry visa? Do we need to do anything for it prior to leaving US?

My understanding is that it is applied for just like a tourist visa.

I'm sorry, but I am pretty sure that I have read in multiple threads here that for VAWA the 3-year rule still applies?

I did some searching, and here is what I found. According to this press release from USCIS, Section 319(a) of the INA (8 USC 1430(a)) has been redefined to include applicants who obtain lawful permanent residence based on an approved Form I-360 or if the applicant was subjected to extreme cruelty pursuant to INA 240A(b)(2)(A)(i)(I).

So it appears that the OP is eligible to file for naturalization 3 months prior to the 3 year anniversary of green card, not 5 year.

And since that is the case, yes, you can file N-400 while I-751 is pending, and it will force USCIS to adjudicate both of them. There is another USCIS memo that deals with adjudication of N-400 while the I-751 is pending.

Yes I have that NOA1 letter, and my husband carries a copy of that paper, I just called last week and they told me that my case is still under review, but it worries me because i have seeing other cases and they last 3 or four months, also if there was something pending they would let me know right?

If they are looking for further evidence, they would have sent you an RFE. When you spoke to them on the phone, they would have mentioned that as well. To be safe, you can open up a service request with them, so that you have a paper trail.

what does it means when they said I-89 card received?

The I-89 form is an internal form that USCIS uses to order a permanent resident card.

The actual permanent resident card is an I-551 card.

Don't worry.

It is expected that the receipt number from the NOA1 will not work online. It is still a receipt number, just not meant to be tracked online.

The receipt number from the biometrics appointment corresponds to the CR I-91 form, and it is meant to be trackable online.

It is also normal for it to stay in Initial Review until you are finally approved.

Just to be sure, you do have a copy of the NOA1 (the paper with the receipt number that you can not track online)? That NOA1 is the extension letter for your conditional residence.

On that same NOA1, there should be a receipt date. (That would be the NOA date you put in the Visa Journey Timeline) Once 6 months have elapsed past that receipt date, you can call USCIS and ask them to put a service request on your behalf to see what the status of your application is. You can also ask to speak to an imigrations officer.

Regardless of the time it takes, you should apply for a new passport. You might want to check with your embassy to see if there is a way to expedite it. I don't think USCIS will stamp expired passport, and eventually you will need your passport, because as mentioned earlier, you cannot apply for naturalization until 3 months prior to your 5 year anniversary of permanent residence.

Definitely call USCIS and get a service request placed, since you are outside of the 6 month typical processing time.

This serious situation with the Bio letter for many of us May filers is just so unfair. USCIS should follows the order as we have filed. Therefore May filers should get their Bio letter before that later month filers. That is my opinion. We are 'asked' to respect the rules and timeline, but we don't get the same in return. I'm really hoping that this week somebody of us May filers going to begin to receive the Bio appointment.

Why don't you call USCIS to find out what specifically is going on with your biometrics letter? You are over 30 days from NOA1, so the customer representative will be able to place a service request to the Service Center. You can also ask to speak to an immigrations officer to get your CR I-91 receipt number, so you can see your case online and sign up for e-mail/text message updates.

That way, in the rare case your individual case fell through the cracks or was overlooked, you can politely remind them.

I am starting to freak out now. i got my notice of action dated june 7th but still haven't received second letter with biometric appointment. is there any way that i can check status?? the receipt number doesn't work online i don't want to miss my appointment. please advise!!

If you look in the May filers thread, you can see that if you have not received a biometrics appointment letter after 30 days of your NOA1, you can call USCIS have a service request placed on your behalf to the USCIS center that issued the NOA1. You can also speak to an immigrations officer to get the CR I-91 receipt number, so that you can track your case online.

I did all of the above myself, as my NOA1 is dated 05/24/2010, and I am still waiting for a biometrics appointment letter. The answer I received from VSC was that the ASC that issues biometrics appointments is backlogged, and they have not yet assigned a biometrics appointment yet, hence no letter.
