    They were a bit back-logged, but not to that extent.  We recently just had ours AOS processed and it only took about 2 weeks; sent Oct 19th, received Oct 21, got NOA letter on Nov 4.  I don't see why you couldn't cancel the check and re-file.  It's a tough decision to re-file or wait, but seeing as it's been 50 days already, perhaps the re-filing route would be the more expedite route.

    That’s what we thought, we don’t want to wait any longer, so we’ll sign everything again today. The only problem is that we sent the medical exam on the last package, so we’ll have to get that done again.

     

    But we’re hoping it will be better than to keep waiting. We’re a step away from giving up on everything

    I tell my friend's story over and over again because lawyers are not to be trusted(most of them). my friend used a lawyer to submit AOS for his wife and after 3 months of waiting, they were following up and they found out she never sent in the package!! they got the congressman involved to refile cuz she was out of status big time and then eventually after they filed, they went to sue the the lawyer because his wife was "overstayed". so be careful who you trust, this is your future, not their's, your money is their future, that's all they see $$$$

    That's pretty much my situation now, my tourist visa expired on September, so now I have nothing to make my stay legal, I’m afraid of going out of the house because I’m so paranoid now.

     

    We supposedly got a lawyer to make everything easier, and well that backfired like crazy.

    I think it's your lawyer rather than USCIS that's made the flub. 

    Kinda makes it seem like they're playing you for the fool to have you redo everything to cover up their error.

     

    You can always cut your losses with your lawyer and do it yourself....or wait...or play dumb and follow along with your lawyer....or tell them something's fishy and you know it. 

    You can always fire them after they resubmit.

    Up to you really.

    Kind of impossible for anyone to decide for you though. 

    Can't really say what has happened.

     

    The problem is the money, we still owe them almost $1k and they’ve done nothing but disappoint us, we don’t just have that kind of money laying around. I’m so angry

    You said you emailed the lockbox? Then youll wait for their response. It wont take 30 days if they have it though. And if they dont it wont take 30 days either.

    They are efficient in these situations.

    I have a deja vu feeling that youve emailed the lockbox too soon though ie. Your lawyer didnt submit it when they said they did.

    In my lifetime here ive "helped" many ppl in the same situation. All of whom were lied to about when it was sent. None of whom had actual lost applications.

    I do have a tracking number, but how can I be sure it’s from MY package? 
    I sent the email to lockbox 35 days after my package was “sent”, meaning its been 2 weeks since I sent it. 
     

    What worries me is, what if they didn’t actually send the package and now they can’t send it because the stubs would be 2 months old, and that’s why they’re suggesting to send it “again”.

     

    To bad we have an agreement with them, now I feel like I could’ve send it by myself with the help of this forum.

    Sounds like your lawyer is planning on upping his fees to "help" you but is waiting for the go ahead for you to say yes.

    So you think 50 days is not a long time considering it usually takes 1-3 weeks to get the receipt? 
     

    We’re feeling really confused, she says there’s not extra charge, all we need to do is sign all the forms again, write a new check and bring the new work payment stubs. And in the new package she will put this is the second time we’ve sent the package.

     

    I don’t know if resending will bring any problem. I mean, let’s say they did lose it, how long should we wait to actually know? Can something happen if it’s not lost and we just send a new package with a new check?

    If your tracking number says it was received, it has been.

     

    My lawyer says it’s way too much time, she says the best option now is to cancel the check and re-send everything, she thinks the USCIS probably lost my papers.

    That’s what I thought, but right now I have nothing from the USCIS to let me know if they even got my case. I’m so worried about my future here. We try to do everything according to the law, and we feel like we’re being scammed by our lawyers, and we can’t afford to have all that money to waste.

    So it’s been 50 days since my lawyers sent our package, and we have no response at the moment. No approval no denial, nothing. I sent an email to my lawyer asking if the package was actually sent because a read here sometimes the lawyers say they sent it but they didn’t.
     

    So today my lawyer said it was sent on September 16, and received on September 19, but she thinks it’s weird that the check hasn’t been cashed yet. She said something we could do is cancel that check and send the package again, with a new check. Do you think that’s a good idea.

     

    Also, the law office is not cheat at all, they divided our payment into 3 payments and they’re asking for the third and final payment, although we practically have nothing. We don’t know what to do, because if they’re barely paying any attention to us now that we still owe them money, what would happen when we’re all payed up?

    I don't remember my exact timeline but we could verify that the check had been checked not long after FeDex notice of the package arrival.

    As for your original question, never send documents that haven't been asked. Wait until you get a NoA or a RFE in order to do that. As far as you know they haven't even opened a case for your application yet.

    If I were you I'd ask your lawyer again and try to call the USCIS, even though it may be hard to get an answer since you don't have a receipt number yet.

    Just so it's clear, did your application contain an I-864 at all?

    yes it included l-864 with my wife’s tax information. I have already sent an email to my lawyer to verify that the package was actually sent.

    There have been some recent posts about people waiting for NOAs but nothing to indicate the current processing time at intake is delayed more then normal. You sent it apx 45 days ago and no payment processed nor a NOA, so its an unusual and unique situation. The best I can say is wait on the lockbox reply and double check everything you sent against the guides posted on VJ to make sure it was all done correctly. Prepare a new packet to mail but dont mail it yet! Just have it ready to mail again if needed. Do not mail additional stuff now, esp since you dont have a NOA that it was accepted. Even then its never a good idea to mail stuff with out them asking as it often does not get attached to your case properly and can cause more delays/issues then help. 

     

    Also did you mail this yourself? Often people give stuff to their attnys and believe it is mailed promptly but the attny just sits on it. Was it mailed to the correct lockbox address? (just trying to come up with any reason for this but I am at a loss besides to say it might have gotten lost which stinks but does happen on occasion). 

    Thank you for all the information. It’s very helpful. The package was sent through a law office and the assured us that it was sent on September 16, they gave us a tracking number and it said it was delivered on September 19 at a Chicago address.

If you didnt include your 864 theres a chance your packet will be rejected and is going through that process still hence why no NOA yet... 

    There’s not Noa yet, they haven’t cashed the check ir anything. We did send my wife’s 864, but we know it won’t be enough because she had only been working for 6 months when she did her taxes.

    i sent my package on September 16, according to USPS they received it on September 19. It’s been 7 weeks and still no response. I was wondering, could the lack of response be because we haven’t sent the joint sponsor information yet? Our lawyers said that could be send once they requested for more evidence. we’re having trouble trying to get a joint sponsor, but they told us we still had time to get one.

     

    Can we send the form for the joint sponsor now even if they haven’t responded yet.

     

    i have already sent an email to the lockbox and they said it could take up to 30 days to respond. So what else can we do? We’re tired of waiting and getting no response.

    I sent my package on September 16 and supposedly they received it on September 19 and I still haven’t got any answer. I sent an email to lockbox last Monday and the replied saying it could take up to 30 days to reply. So that’s where we’re at. I’m not losing my hair and not sleeping well out of stress or anything. 

  14. I got the tracking number and I sent an email with our names and address and the forms we submitted. We got a reply saying we’ll get an answer in the next 30 days.

    My question is, what could be the reason why we’re not getting an answer yet? We know we’re going to need a joint sponsor, but we haven’t sent that form, could that be it?

  15. I’m sorry, I don’t know how to reply directly to you.

     

    I just requested the tracking number from the law firm. We decided to file with them to make things “easier” but it appears it is the opposite. The person filling our forms made a couple of mistakes and the time is taking to get a response makes us think there’s something wrong.

     

    Do you think it’s taking too long?
