The petitioner's hardship letter should include all hardship points with detailed explanation and evidence attached for each point. The letter should be signed under penalty of perjury.

    I am the beneficiary and I don't work either, I was thinking to fill out joint assets that we have on both names like bank account balance, etc; and include tax returns since they're on both names even if I don't work. 

    I was checking travel.state.gov and it says "Visa applicants are not requested to take any additional steps at this time and should attend their visa interviews as scheduled.  We will inform applicants of any changes to current visa application procedures". I also read comments on FB that only if sponsor doesn't make enough money the consul might ask applicant to fill up this form at the time of interview; and other comments on FB that everyone has to fill up this form and have supporting documents to prove assets. So it's very confusing. I don't have an interview scheduled yet so hopefully by that time there will be some clarification, but most likely I will bring that form just in case..

    I haven't heard of 601a denials due to public charge. I've seen an approval of 601a that couldn't move forward b/c beneficiary couldn't find a co-sponsor . The only denial of 601a I saw when applicant was in deportation proceedings. It seems the new rule applies to adjustment of status applicants only; I am guessing there should be some rules for consular officer to determine if Visa applicant is public charge. In 2013-2014 there was a "reason to believe" rule to deny 601a if there were other inadmissibilities of the applicant, later this rule was cancelled to simplify the process. I don't see why they would deny 601a based on public charge (in some cases hardship is only medical or it's about relocating so they don't have evidence of using government assistance anyway).

    Just found this timeline on FB: Received Nov 23, 2018, RFE Nov 2019, RFE received Dec 31, 2019, Approved Feb 3, 2020, Nebraska. And one more much shorter timeline: received Apr 1 2019, approved Dec 31 2019, Nebraska.

    His case is in Potomac and the wait time is 11-14 months. Do you guys think it might take that long to respond? It has only been 3 months. 

    The processing times are pretty accurate from what I've seen from this forum and FB groups for the past year. The wait time gets updated the last week of the month. For the past year unfortunately it slowed down 3 times. Patience and luck..🙏

    In my RFE I was asked for proof of hardship in separation scenario - more evidence of emotional/psych hardship. They said that statements in psychol. report didn't raise to the level of the extreme. So we submitted a mental health evaluation from a doctor specialist (about 1 page statement) about how my husband feels due to threat and fear of separation and that his prognosis will be worse without my support (some family doctors could do this kind of basic eval.) The doctor recommended him some medication and we included receipts & info sheet. Also, we sent 3 new letters from friends talking about the devastating impact of separation; latest photos, trips together, DOS travel advisory about crime against foreigners, language barrier (if my husband would travel to visit me) and job loss due to the need to travel to visit me often and having limited vacation days; financial burden due to high cots of airfare (we incl. a screenshot or airfare). Again, we have no kids, no debt, no other financial hardship.

    Oh, wow. I hope they let me speak in English b/c I cannot express myself in Ukrainian very well. I came here in 1999 and I only communicate in English including w/my husband and all my friends. Regarding Police Certificate - I had a relative getting one for me (in Ukraine with power of attorney) dated Sep. 11, 2019. It should be good for 6 month to upload but I have to give to the lawyer a copy to upload (cannot give her original so she would lose it). She told me copy is enough even though I don't trust what she's saying. She charged $$  for waiver and NVC at the same time so I am stuck with her. DS-260 I will fill out myself.

    This is an important step forward but the time to celebrate starts after we are successfully admitted back to the U.S.
