*** Moved from Off Topic to Tax & Finances During US Immigration, where similar topics are discussed ***

No US tax when transferring money from abroad.  But there's usually a service fee charged by the bank or service company you use to transfer the funds.

ok thank you, i was under the impression that if i transfer all my life's saving it would be taxed. Thank you again!

Just gonna note that even if you are treated as a full-year resident and you elect to use the foreign income exemption, if that foreign income came from self-employment you will still have to pay Self-Employment tax on that income, even if it is exempted.  Seems like an easy tax to overlook, so I just thought I'd point it out.

    1. Taxes for the self-employed abroad

Generally, self-employed individuals pay income tax and self-employment tax (SE tax). If they qualify for the FEIE, they can exclude foreign earned income up to $104,100 (2018) from income tax. (Although the FEIE will be pro-rated depending on the business expenses.) But they still have to pay self-employment tax. Being self-employed, you must pay SE tax on your entire net profit, even the amount you can exclude from income tax.

i have been here for less than half a year and have no form of income since i left my job in my original country to live here. I hope it isn't all as confusing as it seems lol!

You have to file based on your marital status on December 31st, 2019 as others have mentioned. If you were married before the end of the year, and have a Social security number already it is a file as normal situation. You have no income so far, and that is a good thing as if you file MFJ you will have a 24,000 dollar standard deduction that should net you a nice tax refund assuming your spouse has a normal job with standard withholding s ( Not 1099). But even then it will be beneficial. Usually MFJ will serve most people the best, but as he was supporting you since you couldn't work without EAD approval HOH ( Head of household) could be more beneficial( depending on how long you were here last year), but usually not, you can try both ways to see what gives you the best tax liability, but more than likely MFJ is your best option. But just file using any software with you listed on it with your social security number, and when it asks for your income, or if you have any W-2's you have none, so nothing to enter, so your part of the return is really easy as you are just " Along for the ride" per say. Make sure if you went to school, maybe took any type of educational training to pass the time, they are tax deductible, and you can write off any tuition and books, etc. They have some decent deductions for pending immigrants if you look.

    Thnk you!

The marketplace is based on income. If the income is over a certain threshold, most of us receive no subsidy (tax credit) at all. Of course the insurance will be more expensive but that's obvious.

Getting insurance through the marketplace will not cause a visa denial.   Adding the adjustment of status applicant (new alien spouse) to a marketplace policy is ABSOLUTELY ALLOWED.

Thank you but, if my spouse receives a subsidy  (tax premium credit) at tax time and i am on her insurance as a joint insurance is that considered a public charge and denial of AOS application /green card?

  5. I know there is a ton of topic regarding the health insurance but my spouse and i are overly confused about what can we do and what we can't do that will affect our AOS approval. The marketplace is a place where they give you a premuim tax credit and either they give you the credit each month or they give you the premuim credit during tax time. My question is if my spouse the US citizen is getting a tax credit each year will we be denied a green card ? And if it will not affect my spouse getting the green card is it advisible to add my spouse to my insurance through the marketplace? I appreciate any advice. Thank you.

Just keep in mind that 125% is the minimum for consideration. The IO still makes a decision based upon the totality of the circumstances.

It seems that you came on a K-1 visa, so you already passed the public charge test once, which is a good sign IMO.

My husband makes about 4-5k more from the  proverty guidelines. We are currently living in a rented room and want to get our own place to own or rent but he has bad credit due to a vehivle accident that he is still paying off. Just looking for options to consider.

Each case is different and we shouldn’t link every health insurance thread any more than we’d link every thread related to every CR1 or K1 applicant.

Mods for you guys some of these are specific case questions and do not belong in the “whining about the new rules” megathread.  Use judgement.

@OP the issue isn’t buying insurance on the exchanges it is collecting subsidized premiums to do it.  If your petitioner is enjoying subsidized premiums it appears that this is already a strike against based on the question “you or any member of your household...”

So you are allowed to purchase your own insurance and if you purchase a plan and pay the premium without subsidy that is exactly what the new rules appear to be directing you to do.

I appreciate that so much! Thank you for reading my questions and understanding what i sought and also answering it as simply as possible!
