Hello, Don't worry after the RFE you should be fine. Most people with RFE receive their approval soon after they receive the RFE response.

First of all I don't think that you sent "A lot of proof" as you wrote... if you check the list of other guys here (included myself) the list is much more that what you sent. And this time you need to send everything you can just to be sure.

    1) Send everything you sent in the first package. Don't worry that will be repeated. Do it.

    2) Remember to send everything you have covering the last 2 years of you marriage.

    3) Do you have any club, gym, movies card, travel tickets, concerts or whatever that show some interaction between you guys?

    4) For me affidavits are very weak proof but in your case if you can send new ones, do it!

    5) No joint credit card accounts?

    6) Junk mail with both names and address?

I am pretty sure that if you send all the new evidence that you wrote plus the old one in this RFE response you should be fine.

And if you want more help from us :time:

    Good luck.

  2. Thank you Silke.

I am watching your progress in a very close way because we have a similar timelines in CSC (and also the problem with the delay in our biometrics and the service request was almost exact in the days to get our biometrics).

According with most of the recent timelines in CSC the approval could be around 1-2 months from the time of the Biometrics so you should be very close to your approval!!!

  3. Hello!

Today I finally get my Biometrics Appointment!! After 46 days since the delivery of the I-751.

Appointment is for 08/01/09 (Saturday) but I will try to complete a walk in this coming Saturday to see if I can win some time.

And the case number is available online!!!!

Application Type: CRI89, PETITION TO REMOVE CONDITIONS OF PERMANENT RESIDENT STATUS RECEIVED

Current Status: Case received and pending.

Thank you for all your support.

  4. Hello.

You don't need to contact CSC (directly). If you call the 1-800 USCIS number they can check (calling CSC or something like that) if they received your RFE. At least is what they did with my last call to them. The operator told me me to wait 5min and she was contacting CSC to see what happened with my Biometric letter and then she opened a service request for my Biometrics.

Maybe that will help to clear your doubts about the RFE or maybe the operator will tell you what to do to confirm that.

    Good luck.

  5. Hey guys,

Just to let you know that today I called USCIS 800 number.

I am very happy with the operator that took my call, she was very friendly and open to help in any way. I explained that I have more than a 30 days (since the day of the receipt) waiting for my Biometric appointment so I asked for a service request to see what happened with my appointment.

She put me on hold for a couple of minutes and then she returned saying that I was right and that she will open a service request with CSC to see what is wrong then she gave me a confirmation number for future reference.

I am happy because normally I read in other posts that most USCIS operators ask you to wait 45 days (since the day of the receipt) to call for a service request but this one didn't ask to wait for that and she start the service request immediately. I had at the moment of this call about 37 days waiting.

She confirmed my address and all my information in the system just to be sure that everything is OK.

By far the experience today was very good, no waiting time (after my selection of the options she answered almost immediately), fast and friendly service.

I just hope that this help in any way to get my Biometrics because most of the May and even June people already received their Biometrics appointment.

Good luck to those waiting like me.

  6. "Application Support Center Appointment Rescheduling - July 6 - 10, 2009

System errors caused a number of Application Support Centers to be overscheduled during the week of July 6-10, 2009. As a result, some applicants may receive cancellation notices for appointments originally scheduled during this timeframe.

If you do not receive a cancellation notice, please appear at your ASC appointment as scheduled. If you do receive a cancellation notice, you will soon receive an ASC appointment notice for a new date and time, typically for an appointment within the next two to four weeks."

    Source: http://www.uscis.gov

  7. I received the same cancellation notice today. I'm glad I did a walk-in on Saturday (my actual appointment would have been on July 9th). Maybe you could try to do a walk-in as well?!

    Hey Silke,

Are you 100% sure that your walk-in and now the cancellation of your original biometrics is not going to mess up all your Biometrics process? I mean... now you should receive another biometrics appointment letter and maybe they will cancel you original appointment in the system or something like that.

For that reason I am not going to do the early walk-in. I know thay MAYBE could speed up the process a little bit but this is the USCIS... and I don't want to take the risk of any bigger delay or problem. I am going to be patient with that and wait until the original appointment date. I hope to receive the appointment soon and I hope will be one with no cancellation or delays.

In any case good luck and let us know any news in your case.

  8. Sorry to hear that. I completely understand your situation because I have some friends with similar problems.

Reading your story is obvious to me that she was holding the marriage (and in first place started any relation with you) just for the green card and the surgery and now the money that she can take from the future divorce... I can't advice anything because just you can make a decision but if I was you I would report her immediately to ICE (Immigration Police) and explain everything, trying to save some evidences to explain that she was not in a bona fide marriage (even try to record some conversations) but again is just my opinion... because will be VERY DIFFICULT at this time to prove now anything to drop her condition in US. But the law is very clear: She IS just a Permanet Resident and her status could be terminated in any time if she did something illegal or not real.

MORE IMPORTANT: I hear some stories like yours where the wife (or husband) but in most stories was wifes, leave the US Citizen without a penny after the divorce, taking all they can in court. So be prepared...!!

Is terrible but I think some people need to learn not to be naive or blind for "love", we need to keep a good part of our brain in any possibility (bad or good) that could happen. A lot of people in countries like mine could show to be the perfect couple just to come to US in a legal way with a US Citizen then hold some years with that marriage and then once everything is done finish that theater of the "perfect couple" and end the movie...

But again in my opinion go NOW to USCIS not only with a letter, report her (with evidence) like the websites, some conversations, try to find more and go ahead with that until the end. If she win at least she will have that report in her record and at least is not going to be an easy way for her.

Good luck and I am sure that from this you will learn a lot for your next relationship that for sure will be much better!

  9. I was wondering, my wife's green card is going to expire in July, however we have applied for her to get her 10 year Green Card, and we received an extension letter. Today we went to the Texas Department of Public Safety to get my wife a Texas state Identification Card, we presented the person working there her current green card, and 1 year extension letter, however we were told that my wife would need to have a sticker on the back of her green card stating that it has been extended for 1 year. My question is, where do we get this extension sticker, or does it even exist?

Sticker? Is the first time that I hear something like that. Go to the Texas website and see the requirements to get the Texas ID. http://www.txdps.state.tx.us/administratio...equirements.htm

In any case as far as I know is not a sticker in the back of your green card is a passport stamp that is like your extension letter but accepted in more places. To get that you need to schedule an infopass appointment at http://infopass.uscis.gov/ and they will stamp your passport. Maybe they will take your expired GC in "exchange" for the stamp...

    Good luck.

  10. So this weekend on 6/20 my green card expires - I filed to remove conditions in May, the package was received and the check was cashed soon after that but as of yet I have recieved no NOA! Now my concern is being in legal status - what do I do to prove my legal status? I live in an area that status is questioned frequently and my employer is asking for proof of extension. I just got back from a week out of town today and my mail had nothing from USCIS while I was gone so basically I am asking for advice.

Do I make an Infopass appointment to try to get a stamp? If I do what are the chances of this happening with nothing but the check clearing as proof of filing.

I am getting nervous, please help!

Flutter, you should be fine. Schedule the infopass appointment ASAP. Go with the copy of the check cashed (both sides) and for sure they will stamp your passport for 1 year. That give you 1 year to live and work while you solve the problem with the missing NOA.

At the same time call the 1-800 and ask about the NOA. I know that the case number that appear in the check does not work in the online website but I am pretty sure they will be a good reference for the IO that will take your call / infopass (my check show a case number that start with WAC-XXX... that is the same receipt number of my NOA so that should work fine for a reference and as receipt of your I-751).

Good luck! and let us know any news about your problem.

  11. Thank you - do you mean 3 yrs after the removal of conditions or 1 year?

So I will get the perm residency this year 2009, conditions removed 2011, naturalization in 2012 or 2014?

    Thank you!

If you have been married to and living with the same USC at the time to apply for the citizenship then is just 3 years since your "first green card" so if they (Uscis) approve your GC in 2009 you will need to remove conditions in 2011 and then you can apply for USC in 2012.

  12. Ok guy's sorry for sounding so dumb! this is a list of what i sent:

    - Joint car purchase contract

    - Joint health insurance cards

    - Joint utlity bill

    - Joint life insurance

    - 3 years of joint tax returns

    - Joint checking/savings account statement

And your evidence look good to me. Maybe I would send everything again plus new bills and some photos. You sould be fine!

I had an RFE when I was adjusting status requesting for tax returns and all the taxes was included in my original package so I just sent the same copies again and I was approved.

    Good luck.
