    Immgrant Visa for parents approved in Caracas Embassy, now what?

    Hello guys,

    Finally my mom and dad completed the visa process for the green card (my sister did the I-130 petition about a year ago).

    The US Embassy approved them and they took their passports (receiving the passport with the visa in 5 business days) saying that the immigrant visa will be good for 6 months.

    Now the question is... we never fill any I-485 because they are living in Venezuela (not adjusting status) but now we are confused what is the process to get the actua Green Card. They gave a very basic instruccions saying that once they come to US they need to contact USCIS to get the Green Card...

    I am thinking that they obviously need to come to US before the expiration of that 6 month immigrant visa and once here they need to fill a I-485 (about $1000 more per person!????) and wait here for the Biometrics appointment?

    After the next travel to US they need to return to Venezuela to sell everything and prepare to come in a definitive way so we need to know how long they need to stay the next time they will come with the 6 monhts immigrant visa.

    Filing for USC while separated

    my spouse and i have recently separated. i am the USC and my spouse is the Permanent Resident. my spouse received the conditional two-year green card in December '05, and then got the permanent green card in '08.

    my question is, can my spouse apply for USC based on being married to a USC if we're separated? or, apply for USC based on being a lawful permanent resident for 5 years?

    thanks in advance for any advice.

    If she received the conditional 2 years GC in Dec 05 and if you are separated then she will need to wait 90 days before the date on the GC. That means that your spouse can apply under the 5 years rule on 09/day on GC/2010. So is very close. Avoid any application under the 3 year rule if you are already separated!

    Hello Guys!

    My sister is the US Citizen that started the petition for my mom and dad.

    We are really desperate now... We spent several months looking for the original documents required by NVC for the DS-230 (from Venezuela and from Peru) for my mom and dad. We sent all documents with the front letter (bar code) with all the translations (more money) and after one month of review for each case we just received an email with a pdf file that show that "all documents" are missing and we need to sent all the documents to avoid a delay or denial of their cases (we receive the same email for both parents!!!!!!!!!!!), like they never receive anything.

    This is just amazing and frustating. We just had the originals we already sent and took months between Peru and Venezuela to get all the documents (Birth Certificates, Marriage Certificate, Police Records) . We even have the signature confirmation as receipt of our package (we send everything Priority Mail with Signature Confirmation).

    I was reading some similar cases and looks like the only solution is to send all the documents again but I can't believe there is no other option. This is corruption, lazy immigration officers or what?

    Any idea before we call tomorrow? My sister is going to explode now and I am sure she will explode even worst with the operator on the phone.

    My mom and dad are very old and for them was super difficult to travel to other cities and spend several days/weeks doing a lot of stuff for each documents and now this...

    Hi everyone,

    It seems as if most May 2010 applicants received their interview dates..

    I still see RFE on the website.. should I begin to worry and make an info-pass to ask my case?.. or should I keep cool for some more time?

    Call Customer Service and ask for a service request for the "RFE", you will have your interview letter in 3-4 days after you call. Is what I did and also one of my best friends did and we received our interview letters 3 days after the call.

    Original Wife's passport for Interview??

    Thank you guys! I feel much better know.

    The list of original documents came in a separate page with the Interview letter appointment, is the form N-659 (Naturalization Interview Document Check List)

    That form start with the following: "Bring the original and a photocopy of..."

    then in Part 3 of that form:

    "If you are applying for naturalization on the basis of marriage to a U.S. citizen, bring:

    Proof that your spouse has been a U.S. citizen for at least the past three years (brith certificate, naturalization certificate...

    and a more documents they ask like marriage certificate, IRS Form 1722, Proof of marital union as well as proof of residence"

    So I don't think they are asking to me and only to me to bring the original passport. Looks like is a general rule with that form.

    I will go with the copy of both my wife's passport and copy of her birth certificate plus all the originals of the marriage certificate, bills, bank statemens, credit cards statements, loan statements, car insurance, photos and more.

    I can't find her original birth certificate. She born in Worcester, Massachusetts.

    Can I request (as her spouse) a certified copy of her birth certificate?

    Original Wife's passport for Interview??

    Hello guys,

    I am a little bit worried because I get my interview letter with an extra page saying that I need to bring my wife's original passport or birth certificate to prove she is US Citizen. The thing is that my wife is in India for a Buddhist retreat until the end of September. She obviously have her passport and I just have a copy of her passport and her birth certificate but nothing else. I was trying to find an expired passport that I remember is somewhere in the house but no luck.

    I was reading some Interview experiences and most of the time (I think is all the time!) the IO didn't ask for wife's / husband's passport for 3 year N-400 applications based on marriage.

    I am going with everything else in originals (marriage certificate, bills, bank statemens, credit cards statements, loan statements, car insurance, photos and more) but I am worried about this critical part.

    Delay on Interview Letter due Name Change request on N-400?

    Milimelo, your sugestion was perfect.

    For those with the same delay (more than a month after the biometrics) when you call the mis-information line ;) they will prove again that they don't know anything about the process as we know.

    Yesterday I call them in the morning, the girl told me "wow! but you have a request of evidence!" and I said "as you know in N-400 the request for evidence normally is the Biometrics appointment letter, the one that I already received" but she said "no, no request for evidence is not the biometrics" and I said in my mind "ok, whatever" but she told me something that I thought was good "let me open a service request to see why you didn't get the RFE letter" and I was sure that this was going to be good because that will force to touch my case and see whats going on.

    Soooo! almost at 11pm (yesterday) I get the email and text saying that my case was transfered for interview to my local office!

    My best friend was in the exactly same position here in Denver (we sent our applications the same day and biometrics was also the same day (walk in)) and she called after me asking for the same thing and they told her the same words about the RFE and created the service request. She called this morning telling me about her email/text!

    So if you have a delay of more than a month between Biometrics and Interview letter, just call and ask about a service request then by the end of the day your case will be updated and case transfer to your local office!

    Delay on Interview Letter due Name Change request on N-400?

    Hello guys,

    I am wondering if you guys think there is a possible delay between the Biometrics and Interview Letter because of any name change request on the N-400 (remember that for those cases a Judge need to be present in the Oath Ceremony so is not the "regular/normal" oath ceremony).

    What do you think?

    I am not worry yet but most of the guys in vj received their interview letters in Denver less than 30 days (the average is 25 days) after the biometrics and I did an early biometrics and still nothing of my interview letter. :unsure:

    I really need to receive the interview letter ASAP because I am waiting to schedule my knee surgery and avoid to put that date on the same day of my interview or oath. Doctor is pretty busy and will be very difficult to change the date once on the system without any further delay.

    I have wondered about these yellow letters, I have seen other people reference them. Does everyone get a yellow letter? If you do not get a yellow letter, what are you required to take to the interview? (My plan is to take a copy of everything I sent in with the application package) ....

    Well... My plan is to go to the interview with all the originals of every documents I sent in my application. I don't want to take any risk and I can always return with the originals back home.

    Looking at the April 2010 applicants thread, there's one from NYC, looks like it took "Dabu" almost three months to get the interview letter, so no need to panic just yet.

    Jasminelily look the last April 2010 applicants table again. "Dabu" completed the biometrics appointment on 05/11/2010 and he received the Interview letter on 07/03/10. That is not even close to three months as you wrote. Is just 1 month and 3 weeks. The normal wait between the biometrics and interview letter is 3-4 weeks. I would start calling USCIS two months after the biometrics appointment.

    Which site do u use to check the status? uscis.gov does not show touches as far as i know..

    uscis.gov show the touches when you creates your portafolio. If you look at the list of cases in your portafolio there is a column (Last Updated) that show the last "touch". In my case my N-400 was last touched on 06/18/2010 (two days after they sent the biometrics letter).

    again the touch was amazingly quick after my biometrics during my first green card and then when I was removing conditions. I think hours after I did the biometrics my case was touched in both cases.

    In any case patience is the first thing I need to remember in every step of this journey.
