  1. For other people that have the same issue, here's another story.

My husband's application is now pending due to missing status information letter. he is 31, from what the selective service says, if you are 31 or orlder you are not required to provide a letter.  Before his interview he called Selective Service to make sure and and was told he did NOT need it as he was already 31.

He had his interview on March 14th, but the officer asked him if he had a SIL,  said no and showed him a letter from selective service (that the guy on the phone from SS told us to print and take with him).

Also on their website it says this

"Immigrant men who are 31 or older who are seeking naturalization and who did not register are no longer required to provide a “status information letter” or documentation of their status from Selective Service. If asked for a status information letter, you may print a form letter concerning their request for a letter for use with USCIS."

Now his application is pending, he needs to provide a stupid letter EVEN IF HE IS ALREADY 31. We requested it and hope it will get here before the due date (cause of course they give you a time limit).

So I recommend to anyone who is not 32 yet and was not registered, JUST WAIT.    IT WILL BE MORE EASY AND CHEAPER since we're probably have to restart the whole process.

    Will update!

I arrived in the US on April 19, 2014 with a K1 visa, I was 25 years old. My K1 visa status expired on July 19, 2014. I assume, I was out of status until USCIS received my I485 on December 31, 2014, I was 26 years old by then, I say ‘I assume’ because I don’t know how the status changes after the K1 visa expires, and after submitting the I485. I know the K1 visa is an non-immigrant visa, so I was not expected to register for selective service. I know that now, because I’m trying to do N400 and they ask me if I lived here between my 18th and 26th birthday (not including the time I lived under an non-immigrant status). So from July 19th, 2014 to December 31st, 2014 I had no status, which makes me believe I should have registered for the 1 month and 10 days I had before my 26th birthday (my birthday is in September.

At this point, I believe I must say I lived here before my 26th birthday even though, I didn’t get my permanent status until Dec. 2015. Because of this, I must present a status information letter from the Selective Service. I’m turning 31 years old in September. I’ve read some posts that say that would be 5 years after failing to register, therefore, this may not be an issue for naturalization in regards with the Good Moral Character.

I reach out to you guys because I want to know if it is very likely that my n400 application is denied because of this. I wouldn’t like to invest time and money if this is clearly heading towards a denial. I would also like to know what you guys know about applying after turning 31 years old and whether or not I should answered that I lived here between 18 and 26 years of age even though I was on an non-immigrant visa, then out of status and then successfully adjusted my status after turning 26 years old.

Thank you very much for your help.

***Disclaimer***: I’m not trying to comfort myself. No excuses, I should have known better. So I appreciate your help, rather than comments telling me I should know the law.

Hi, hope you get notifications to this posts even after 3 years. My husband is in the same situation, he turned 31 in december 2021, we applied for naturalization in January and had his interview March 14, he was told he needed to provide a status information letter although when we called Selective Service we were told he did NOT need it as he was already 31. At the interview the officer told him he instead needed it and that only 32yo and older are not required to show a letter. Like what??? Where in hell it's says 32 I don't know! His application is now pending...... We called and asked for a SIL that same day (march 14th) , problem is it takes about 2/4 weeks and he was given a due date (april 18th)  to provide or the application will be denied and he will have to re-apply!

Did you find out you were actually registered? Was your application approved?

    Hope you can answer,

    thank you,

    Faye

Also, if the status information letter doesn’t arrive in time, it’s a Hail Mary, but you can print

    https://www.sss.gov/wp-content/uploads/2020/02/Applicants-Over-31-Letter-Updated-03-02-2021.pdf

and submit that instead.  I don’t have high hopes it will work.

Note DoS or USCIS as appropriate should have registered him if he was under 26 when he filed DS-260 or I-485.  Be certain that didn’t happen. If he didn’t have an SSN at the time it is possible he was registered and SSS doesn’t have the SSN attached to his record.

Thank you, we checked to see if he was automatically registered but he wasn't. He came here before turning 26 and didn't have any idea. Our fault but def not intentional.

we printed that same letter (following instructions that someone gave us when we called Selective Service, they stated multiple times that that was all we needed as he already turned 31) and presented it at the interview, the officer told him he needs to be 32 and that a SIL is in fact needed. We called again and they're sending us now a SIL.

If he did, and did not register, they need proof he wasn’t eligible to register.  Citizenship in that case is the very least of his worries.  They can prosecute him.  Penalty is severe.  What exactly did they say?

    Some background

    https://www.sss.gov/register/benefits-and-penalties/

I've read of other people (also here) that did not register and none of them said they were prosecuted nor had any big troubles. They just had to present the status letter and that was it. Not a different situation than my husband.

  4. Hi everyone,

my husband had his Naturalization test on March 14th. He is 31yo, was not registered to the Selective Service, we called regarding getting a status information letter and we were told than he didn't needed one. To his interview he was told that he instead needed one and only 32yo don't need to provide.

His approval for Citizenship is now pending until a letter is provided and a statement is submitted explaining why he didn't register.

We called again and requested a status letter on march 14 hoping it won't take a month or the application will be denied.

Anyone else went through the same process?
