Ok guys the i-130 is in the post, i have got used to the fact i wil be here for 3 to 6 months,6 months will be fine as i wil have time to save like hell and this time get a truck and not a 2 seater. So its been 2 weeks already and gone pretty fast. I will get police report done asap as that takes the longest, when i was approved last time for the k1 i then sent for the police report and it took 2 months. So the sooner the better. I did recieve an email which i will include in this post.

    Thank you for your e-mail correspondence. Unfortunately, the current circumstances require that you obtain either an immigrant visa or a K-3 visa in order to re-enter the United States . The first step in this process requires that your wife needs to file the I-130 petition for an immediate relative immigrant, as well as the I-129 petition if you wish to simultaneously pursue the K-3 visa.

    The K-3 visa was designed to reunite family members who are awaiting processing of an immigrant visa. Further information on the K-3 visa and application process is available on the U.S. Embassy website: http://london.usembassy.gov/cons_new/visa/iv/kapply.html.

    Please note that the K-3 may take approximately three to six months to process to issuance. You may shorten wait times by beginning the process of obtaining required documents such as birth certificates, marriage certificates, police certificates, ect. The link above gives additional information on the required documentation. The UK police certificate is valid from one year from date of issue, if the certificate you obtained to present for your K-1 visa is near expiration you are advised to apply for a new police report as soon as possible.

    We understand and sympathize that this is a personally stressfull time, and regret that we could not be more positive in our response. Please be assured that on receipt of the approved petition from USCIS, the Embassy will endeavor to handle the visa request as expeditiously as possible.

    I like the please be assured part. I will be sure to email them when they get my approval. Well its been a lesson but it will make us stronger and i will be financially pretty good. Not worked for 6 months already so looking forward to working then get another 90 days off when i get back.

    Thanks to all for there help pm's and advice and if i had not found this site before i applied for the K1 i probably would still be waiting.

    Brian, I was seriously hoping that you'd come on and prove us all wrong. :( That really sucks, but with the strength of the pound versus the dollar you could have quite a nest egg saved by the time this is all done!

    Well i hope so. The 5 months i spent in CA with no work cost me 20k so im excited about getting back and working there.

  2. Forgive me for being stupid, Lisa think Lisa sent the i-130 along with something else which was free to send i cant remember what form it was. Now that its been posted does that mean i have applied for the K-3?

    I am still unsure what the CR1 is as both need the i-130 sent first?

    I would love to know when i arrive i can work pretty soon.

    Oh and can i go back for 90 days if i want to?? Probably wont cos of work but never know.

  3. Get it done asap. I did not get asked for Lisa's but i had it anyway. Better to be safe than sorry and i know its a bit of work but it gets you both together quicker, they might ask you for it then you will need to have another interview.

    Play it by the book and whatever you do dont leave the country before you get the adjustment of status, thats what i have done and need to apply for another visa .

    Good luck and my interview was ten mins and very easy as i had everything all ready.

I am the guy who made the mistake of returning to to the UK without AP so i have been informed that i do need another visa, i was told by the consulate that they would hurry my application along as my ciscumstances are bad, they told me to get a K-1, is this the best bet? My wife has filled in the i-130 and i will fill in my part tonight and she has another couple of forms to fill in and hopefully get it away tomorrow, They sai it should take 3 months, i really hope so as 3 months aint that bad really.

    Any advice would be welcome. I will apply for another police report tomorrow also as that was the part that is the longest to get.

  6. If you go the K3 road you will have to file for AOS once you come back to the US (just like with the K1).

    CR1/IR1 is the one where you get the I-551 stamp in your passport at the POE (which allows you to work right away) and the GC in the mail a couple of weeks later. You will be a permanent resident then.

    Take the time and check the guides out on VJ to decide which of the two is the better one for you.

    Ok i think the CR1/IR1 is the one for me. I want to work when i get there and not need to wait another 90 days. Its a shame my $1010 has gone down the toilet. Where can i find tis form and whats the cost?

  7. Ok , 6I will find out more tomorrow and thanks for all your help i really appreciate it. So i will need my wife to file the i-130. This costs $190 and in 6 months when im accepted i am a permanent resident? Can i work right away. Im lucky i can get my old job back made a cal today. So like despair said i will have to make the most of it and im sure this will make both of us stronger. I can live here with my mum and i can visit sometime in Feb to break the time up a little. It said 6 months on the prossesing times page. I will write a letter with it explaining my situation. Just incase i get a good guy dealing with it.

    So to recap Lisa fills in the i-190 and we both fill in the G-325A. And i will recieve permanent residence and work permit?? or does green card give me that right. I wanna get all these forms ready just to be saef and get it done quick.

  8. Apply for your work permit. I made the mistake of getting married and then applying for my AOS and work permit. So i was 5 months with no job and still waiting. Whatever you do dont leave the country i have returned back to Scotland as my mother is very ill and i cant get back to my home and my wife.

    And get your CA driving lisence. All you need to do is sit a theory test costs $28 ish. Thats if you have a current driving license from your country

  9. I have a great friend in California who is a top attorney and his firend is a immigration attorney. So he has passed all my info to her and the first things she said is thats going to be a problem but when he said i was on a K1 she said she needs more info but there is hope because its a K-1. She is going to email me within the next hour and i will pass on all my info. She has worked in immigration law her whole life so im on to the right person. There is always a way.

  10. I called and spoker to a girl who never really knew much. She kept putting me on hold to ask her supervisor. So after a few mins she asked me to email the consular in London and they will tell me what i have to do and it will take a couple of days for a reply. Dont like the sound of this.

    In the email i told them that i have no job here and my wife is living in an apartment which she could not afford herself and had a lease. I cant afford to pay for that and then get a place here and still need to find a job. Im just hoping someone sees that i have made a mistake and is leniant with me. I done all the hard work to get the visa and have been marries and had the best 5 months of my life and i really cant even think that i would be without her for months again. What if my mother died and the offices were shut. Do you need to wait till they open?

  11. Well im still awake as im on Pacific time still. Only been here a day and a half. I will wait up and call the consulate at 8am. I just cant believe how stupid i have been. My mother actually got diagnosed with cancer on teh 24th. She kind of knew on the 22 the day i booked my flight. But if i need proof it could work out as when i found out the us consulate was closed and i flew on the 25th where it was also closed. I am really close to my mother and i had to come to her. The bad thing however is that i had a biometric test arranged for the 22nd which i never made because i was at airport booking flight. Lisa sent a letter and back dated it to the 20th aying i had left the country. She only posted it tonight so she is going to get up early and get it before it posts.

  12. When i left US soil the girl asked me for the green part i should have had on my passport. I think she ment the i-129 the green part i would have if i was ther to visit. I never had that so she let me go anyway. If my passport was not scanned and she did not have this then how would anyone know i left in the first place. Could i just not go back on a vwp 90 day visa and stay. And just take a chance that they did not know i was away???

    I would be willing to try. Its a gamble but could be worth it. If it did not work then Lisa could move to the UK.

  13. Its amazing the things that a few days can make. On the 25th i was there and said bye and see you in a week. Now i cant get back home. Its a nightmare. What have i done. After all the money and time to actually get the visa and move and now i have a car there and all my belongings there and more importantly my wife there. This is terrible. Thanks for your help and if anyone reads this and can give me any information please help.

  14. I cant believe i have been so stupid. I thought as it was really an emergancy it would be ok. I am married and my wife and i have a house. I dont have my adjustmant of status but i filed for it over a month ago. Will i be stuck here for months? This is a nightmare. Just to clarify my details so i can find the right form i was married to a us citizen in californai on 29th september. My k1 runs out next month but i take it it is useless. I really need to be home with her as we have a home there.

    What form do i need from the 2 mentioned. If i am stuck here for months then we are in trouble. We only found out i may not get back in today.

    Please help.
