  1. The last touch we received on the I-485 was when my hubby had the biometrics appt back in December!

This is all our online status says..

Application Type: I485, APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS

Current Status: Case received and pending.

On December 4, 2007, we received this I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS, and mailed you a notice describing how we will process your case. Please follow any instructions on this notice. We will notify you by mail when we make a decision or if we need something from you. If you move while this case is pending, call customer service. We process cases in the order we receive them. You can use our processing dates to estimate when yours will be done. This case is at our NATIONAL BENEFITS CENTER location. Follow the link below to check processing dates. You can also receive automatic e-mail updates as we process your case. Just follow the link below to register.

So is our case still in Chicago where we mailed it??? sigh

Another question: Have any K3's been approved? I am having a hard time understanding how a marriage that is 12 years old takes longer to process than a K-1 marriage.

Don't feel too bad. I am still seeing the same message as you. I found out about the Biometrics interview a month after we missed it by calling the service center. Luckily the local office was not busy and they did the Biometrics when we walked in to try and reschedule. If I hadn't called, I would still be waiting and wondering, like now. The national benefits center is in Missoury. Hence the M in MSC. Or should that be Misery??? So far we never recieved any paper work, except one NOA in the beginning.

  2. Lost or missing Appointment letters. It's worth the phonecall if you have been waiting too long.

02/26/08 Called USCIS 800 number. Very friendly and helpful individual and supervisor.

Found out correct MSC numbers. Also found out that we missed the Bio appointment!

We never received any appointment letter. (Originally set for January)

Went to local support office and asked about re-scheduling the Bio. Very nice manager at the office

did our Bio then and there, without having to wait since they were not busy.

Numbers now show up on the web page as well.

Hopefully I will get any future appointment letters (Interview).

  3. What are they doing?

Everyone else is getting notices, Bios. etc. For us, only one NOA received, different numbers on the check and NOA, and nothing, nothing, nothing! See below.

    11/29/07 - Fedex'd to Lockbox (Chicago)

    12/3/07 - Delivery confirmation..........

    12/21/07 - Checks cashed!!!

    01/10/08 Paper NOA1 for daughter received - Postmarked 12/20/07

MSC# on back of check doesn't match MSC# on NOA.

02/02/08 Still no news for wife. All three numbers still come up red on-line.

  4. Will she be able to receive citizenship eventhough her k2 visa has been expired? Or will she need to file an adjustment of status and undergo a conditional permanent residency.... i hope someone can help me... please. Thank you

I am just going through the AOS process for a K-1 and K-2. Your daughter has until her 18th birthday to adjust her status to permanent resident. If she fails to do it by then (with some exceptions), everything becomes invalid, and she will not be able to adjust, and may have to leave.

Since she did not adjust at the time you did, she will have to pay the full fee (U$D 930 for AOS & U$D 80 for Biometrics).

The good part is that if her father is a USC, as soon as her status is adjusted, she will become a citizen, and can apply for a US passport. No need to wait anymore. It is due to the "Child Citizenship Act".

Just make sure she adjusts before she turns 18.

    Good Luck,

    Helmut.

  5. Lost in USCIS Land? What's going on?

I received the paper NOA for our daughter January 10, post marked 20 December.

I never received the paper NOA for my wife.

I did get the MSC numbers off the back of the checks, and the MSC number on our daughters check is different from the MSC number on the NOA.

None of the numbers show up when checking on the web site.

Time for an Infopass, or wait some more?????

  6. "The Big O, is designed to be an "instantaneous surge of human biological, mental and spirtual energy" that organizers hope will reduce levels of violence, hatred and fear around the world during this, the longest night of the year."

It might just work.....there will be so many tired people around afterwards, they wont have any energy to fight!

Will do the hardest to help out!

  7. Does anybody know what exactly happens when you fill out the form to report the $?

It just creates a paper trail to allegedly prevent money laundering. You can bring or take as much as you want, just make sure you declare it if it is ove 10K. If you don't and they find it you most likely will loose it, and have a s**tload of legal problems.

(It's like the form the bank fills out if you deposit or withdraw more than 10k in cash. Big brother is watching... that's all. I have had the bank fill out the form on my several times, but nothing ever happened).

PS: I would do a wire transfer for that much. It's safer, and not that expensive.

  8. VJ,

I am ready to send our AOS package for my wife (previous K-1). Someone just told me that I need to send a 325a biometrics form for me (USC/petitioner) also. In the VJ guide it stated that I only need to send one for my wife. So, do I send the package only with her 325a, or send one for me also? I don't want to confuse the government trolls too much, by sending one for me, if I don't have to.

    Thank you,

    H.

  9. I had a problem with this when I was naturalized. I was a permanent resident, but worked all over the world. My travel kept me out of the country for about 180 days a year. Unfortunately sometimes longer. When I applied for the citizenship (2003) I was rejected, since I missed the "physical presence" by 43 days. I had the choice of staying in the country longer, until I met the requirements again, or file for an appeal. I filed for the appeal ($200). When my case was reviewed, the reviewing officed approved my citizenship, since I maintained my residence (house) during the entire time, and also had paid all my taxes continuously.

    Hope that helps.

  10. We made it through the BKK interview, and to the US (all went very well), but when I try to update the Embassy and POE info page it keeps telling me I have to register first. (I am logged in...what am I doing wrong?)

    PS:

We had the asian (japanese?) CO. His main question to my fiancee was...How do you communicate with your fiance? When she answered in english (although very nervous), that was apparently sufficient. He told us to come back the next week to pick up the visas. The whole process took one less than one hour. The Thai staff was friendly, apparently because I was there. They were not so nice to the Thai applicants that were alone. (September 7)

The POE was interesting (Los Angeles). The officer was very friendly, but had never done a K-1 and K-2 before, so the whole process almost took one hour, since he had to ask the other officers for help several times. Other than that, it was easy. (September 16)

  11. Don't worry too much. I don't know about the Phillipines, but we just went through the medical in Bangkok last month. I was there with her.

they asked her to fill out the history part of the form (Download the forms fron VJ) and that ws pretty much it. They took her blood, urine, and chest X-ray.

They gave her the missing vaccinations. If they do, she might have a slight reaction, as Bee had. It looked like she was getting the Measles on her hands and arms, but after three days it was gone. As for the physical part, she had her clothe on most of the time. The doc looked at her eyes, nose, and ears. He had her lie down, pulled up her shirt, and pressed around on her stomach. That was it. The worst part was waiting for them to assemble all the paperwork for the embassy.

Overall pretty harmless I would say. If she feels better, go with her, or have her take a friend if you can't go.

    Good Luck.

  12. Our california number was WAC0710350XXX. our embassy number was BNK20076XXXXX. I didn't see our number on the web for two month.

Stop worrying about the number. If you really love the guy and want to stay with him for ever, the 7-9 month to get the visa will be a short time. After you come to America, you will make plenty of money, and will have plenty of time to buy him whatever you want.

Good luck to both of you.

  13. I am going to counseling and im also writing a journal of all the hurt emotions I go thru everyday. I have told my military chain of command of my situation and have a police report on her leaving me. They say nothing they can do since she leave willingly and not kidnapped or anything. I will go thru counseling a little longer and then make the final decision to divorce and report to INS. Its just so hard to do this because I feel my wife may still love me and may want to come home. I just dont know...im so confused and so hurt. I dont know what to do anymore and dont want to do anything drastic yet. I need the strength from God to do this. I also need more money for divorce which is something I dont have right now. I have some but not alot. AOS process ran me preety dry on cash. So I need to get back on my own feet.

Off topic I thank everyone for their support and love on this situation. I feel better just telling people how I feel and what is going on. Everyone on her family side say its my fault she leave me and i need help for all the wrong things I did to her. They say I have abandoned her...yet im here at home still waiting and wanting my wife and daughter home. I wish things would work out and we could be together but I dont think its going to happen. I ask everyone to pray for me and pray for the stregth to get thru this. Thank you ver much for all your support and love to me even when you dont know me.

If you are an American citizen, and have a daughter, there is a good chance your daughter could be an American citizen also. (My fiancee is going through the K-1 process, but our son is an American, due to my citizenship, even though he was born in Thailand. The embassy issued a report of foreign birth abroad).

This is why it is important that you get legal advice. A friend of mine went through a similar situation like you (Married a foreign lady, had baby, and she "split"). Because the baby was American, and she claimed custody during the divorce, and received custody, he will now be paying child support until the baby is 18. It was a well planned and sleazy way by her to get "support" for the next 18 years.

Protect youself, and talk to a good lawer.

    Good luck with everything.

    H.

  14. I want to get a jump on packet 3, but all the web downloads, and the embassy (and govt) web pages only have the DS-XXXX medical forms with expiration dates close to this or last month. If I use these forms, will they be rejected by the embassy? Should I wait until I receive them in the packet 3? Is there any place I can get current forms?

    Thanks
