  1. I'm finding conflict in the forums. We need not fight.

     

    Per DS-160; an official government document, page 23 it clearly states: Immediate Relatives means fiancé/fiancée, spouse (husband/wife), child (son/daughter), or sibling (brother/sister).

     

    This makes K1 visa mission critical. 

     

    K1 visa was created in 1970 to make it easier for service men to marry foreign nationals. Not all couples can marry under a CR1 visa due to the foreign nationals laws, religious laws, same-sex laws, just to name a few.

     

    K1 is mission critical!

  2. Also same sex couple here. What I suggest is that you nicely front load your I-129f. Anything you have that show you had been together in the last two years I would include. I chose to live with my fiance in his community and used the lease as part of our submission since it showed both our names. Nothing mentioned about our relationship, just occupants. Our flat was 5 homes away from his family home.

     

    Onto the the same sex question. 

    When you enter an U.S. embassy or consulate you are considered to be on U.S. soil and should treated with the same respect as an U.S. citizen. This doesn't mean that the person who helps arrange your packet just prior to your interview won't have prejudice.  When you reach your interviewer that person is trained and has the knowledge needed to handle SS applications. 

    On June 26, 2015, the U.S. Supreme Court struck down all state bans on same-sex marriage, legalized it in all fifty states, and required states to honor out-of-state same-sex marriage licenses in the case Obergefell v. Hodges.

    You and your fiance should feel confident you will be respected. 

     

    Our process we have used a lawyer in the states. Worth every penny.

  3. 1b. No. We got the medical in 3 days but far from the normal. We picked up the file at their office.  If I recall correctly you can have the documents courier.   

    6. The fees had been paid via "cash" meaning he used his bank debit card.

     

    My suggestion would be, if you can afford it:

    Book your travel and stay at a hostel from the day prior to your medical appointment to the day after expected receipt of package (we paid less than $6.00 per night).

     

    I would do pretty much the same for the k1 interview. Book for a day prior to the biometric, stay in town for the interview then return home. Again we lucked out and got the appointments close together. The passport with your visa will be courier to you for a fee I believe is Rs 500 to the courier.

     

  4. Our experience. K1 Visa

    1. I suggest you make an appointment.  Easy to get from the medical facility. 

    1b. You will not get your report the same day. We had been quoted 7 days but got in 3. 

    2. Biometrics AND interview scheduled through USCIS in Mumbai. Our bio was scheduled for a Tuesday morning and the interview was scheduled for that Friday.

    2b. All remaining questions,  except for number six, are all no.

    6. Our cost came as, all in Rs. 12,000 for appointment, 3900 for vaccines, 140 for injection administration.

    My fiance worked in Lagos Nigeria in 2012. We have researched how to obtain a PCC without a Nigerian contact, but to no avail. I found on VJ a person who states that if it is not obtainable for a vaild reason it would not be required.

    Currently travel and more to Nigeria :

    at level 3 security threat, per US State dept.

    must have letter of invite for visa

    quoted cost for PCC over $2000

    State Dept quotes fraudulent activity for documents 

    S.D. quotes paper logs in Nigeria and no digital system

    S.D. advises get while still living in country

    S.D. mail is not a reliable avenue for request

    Who has experience with getting a PCC from Nigeria AFTER leaving  the country and returning to their homeland?
