  1. i dont know where you are in your visa journey, but there are no shortcuts, the important thing is to be very accurate in provideing every document they ask for so that there are no delays in the processing of your case.

    if you read my timeline you would see I am at the end and I started soooo long ago that many things have change since then. Back when I started snail mail was the only way to pay your fees...you have no need for shortcuts now.

You will get a letter from USCIS (make sure your address hasnt changed), this is a NOID/NOIR. you need to consider what reasons they may have for thinking it is a fraud and start compiling evidence, everything you can possibly put together (phone records, plane tickets, letters, photos, ect...). when you get the letter then you need to write a response to every point they list for sending it back. you lawyers is correct, there is nothing they can do untill the letter is received except for what I have just told you.

    my case is also in 221g AP, i am worrying if they return it to USCIS what kind of documents they ask to REAFFIRM the case???

    For further evidence I sent phone records, chat logs, more photos of all of my trips, me with his family on my last visit, and afidavit from his parents, copies of my visa's with passport stamps, everything I could think of and it all consisted of about 5 lbs of paper. I also wrote a letter (5 pages in length) answering all points the consulate gave for returning the petition. Put it all togther before they send you the NOIR/NOID and you will be ready. I am sure you will have an idea for the reason if they send it back. AP doesnt always mean the case goes back.

  4. This has been such a torturous nightmare. I was beginning to think we would live our lives searching for a way to be together but after our case being reaffirmed the consulate accepted the truth and issued my husband his visa.

    The one piece of advice I would give to everyone in the middle of the long wait that US immigration puts us through is to show perseverence. There is little else we can do. I got senators and congressmen involved but it did no good as far as I can tell. May it showed the consulate I was serious but all I was aware of it doing was telling me the same thing the conculate did.

    I am greatful to all of you here on VJ that so willingly shared your experiences, and your encouragement. If not for VJ I would not have been able to do this whole process on my own. I used James shortcuts, so thank you to him, and so many phone numbers members have been good enough to share.

  5. It has been 3 days since my husbands interview and we are both having so many ups and downs because searching here is not giving a lot of information simular to what we have been through.

    At the interview the CO did not say approved but told him he was under administrative review, they have to review all the documents and when I called and spoke with the CO she told me the same thing. They took all his fingerprints not just thumb like the first interview, they asked for 2 new passport photos as well as the new medical and PCC, and they gave him no paper after (not blue, pink or white).

    The interviewer seemed to be very young and inexperienced, it only lasted 2 minutes. They gave him back his passport. so we dont know exactly what this means. with the hell they put us through before it is hard to feel confident about anything.

    can anyone tell us, is this approval with a wait like others have had to go through?

  6. Congratulations !Indianheart it is just a formality I hope the AP is over quickly I know how bad you feel but look how far you have come it wont be long now. Your case and Twisted K 's case gives me hope.

    I am wondering if it is because of our age, we are both over 40 (I will be 49). I feel like they are torturing us. We are both concerned because they gave back his visa. should I threaten sueing them for discrimination? I havent seen my husband for nearly 15 months and cant afford a trip now because I have done everything I can think of to bring us into the same country ( I am at present working on a work permit in Canada because I thought I could bring him tied to my work permit. His ties to india are not strong enough. what a joke, US says he is tied to india and Canada says he is not).

  7. My husband went to the consulate today for "interview", this case was reaffirmed in Oct. 2009. They took all finger prints, spent 2 minutes, told him it was going to AP and gave him back his passport...WHAT THE HELL!

    I called and was actually able to speak with the CO. She said they had about 8 lbs of files to review and needed nothing from us. What can we expect now?

    Here is another question for any one out there. My husband had his passport renewed and was given back the old passport, he said it is an "offense" to show the old one but I am wondering if they would allow him into the consulate with that one and a copy of the new, but of course I dont want his to get into trouble showing the old one. Under these circumstances would there be any legal trouble from Indian government or US by showing old passport to get entry?

    your husband must be having a receipt which he must have got it while submiting the application.Whant he can do is go to the enuiry window and show him the photocopy of the receipt and then he would be told to meet the concerned person. where he can tell the person sitting that the interview date is on 10th. when i went ti enqire about my pcc ..i saw a lady who had the medical the same day and she was given the certificate and the pasport on the spot.i am sure he would get it. i got it from chandigarh passport office.my pcc was delayed coz i had not written the name of the country that i want pcc for, and that was just lying there.

    He showed his interview letter and the receipt. He was told that if they were not done with the varification and if he took his passport for the interview it would take another month to do the PCC all over again. Caught between a rock and a hard place. I need to know if the consulate will allow him to interview with only a copy of his passport and distric PCC since the passport office PCC is pending and they are holding his passport, (this practice is ridiculous to me, I have had FBI clearance and state police clearance and all they needed was fingerprints...why hold the passport????)

  10. I need an answer urgently to this question. My husbands interview is Dec. 10th and he started getting his PCC's as soon as we were informed of the intervew date but the passport office is not done yet with that PCC. I am afraid to reschedule and have a new date over a month away (we havent seen each other for over a year and this is the second interview ..."reaffirmed petition"). Would the consulate allow him to go to the interview showing a copy of his passport and another form of picture ID and submit the PCC and passport to VFS after receiving it (that will be next week when he gets it)?

    I hope some one has information on this or I will have to reschedule the interview in the next 12+ hours.

    there is a difference between the K visa's and the CR and IR visa, the K's are non immigrant. I know that the intent is to immigrate but in the case of my husband (now that we are beyond 2 years married) he will receive a 10 yr green card and will not have to adjust status. this is why I was thinking there may be a difference in the way it is handled at the consulate. from your time line it looks as though things are starting to speed up with the process, it has been 18 months since our interview. and nearly a year since our case was sent back. I am getting a little fed up with the way the USA is handling immigration, they want to give amnesty to illegals but hold up those who try to come legally.

    I have only found information with K-1's, there was another here that was a CR-1 and her timeline didnt mention a new interview so I was wondering if there was a difference with CR-1's. I went to the consulate last year before the case was return and was treated very rudely, but was told that if my husbands case was reaffirmed they would issue his visa so I dont understand the reason for anather interview. Also I had contacted my congressmen to make an inquirey and they were told they were doing a background check. I am certain that this happened prior to our first interview if I am not mistaken.

    I have decided to give DOS a call in a week and see if they will tell me anything.

    If there is anyone else out there with a CR-1 going through the same thing I would sure be interested in hearing from you.

  13. I have been searching here for approximate times for visa issue after reaffirmation. Can any one help me with this? My congressmen got information from USCIS that they were doing a background check then I received email stating they reaffirmed the approval of our case. I havent seen my husband for a year now and we are very anxious to finally begin our life together on a daily basis (not annual), so if any one can give us an idea of time frame I would greatly appreciate it.

  14. :crying: My husbands case was sent back from the Ukraine Embassy May 14 after 10 months of AP, USCIS logged the case in on June 29 . We still dont know the reason.

    Does anyone know how log it might take before we hear something?

    mine took 6 months, just check the USCIS processing times. You will know the reasons when you get the NOID. that 30 days they give you to respond goes by fast so I would just prepare for what ever you think it might be, I sent a 2lb box of papers and photos.

  15. according to the attorney all they should be concerned with is if the divorce is legal and our marriage legal, just be spouses are dovorced relationship (friendships) are irrelevent. People share history and children and too many times in India family (cousins being married). how do you not continue relationships when there are children involved.

    as far as proof there was the first 2 trips, copies of bus and train ticket for our travel there, pictures of the first year and our wedding, his tax ID with USA address (mine), and he offered chat and phone logs at the interview and they said they didnt need them.

    they just wanted to deny and looked for evidence to do it (and when not clear enough they stretched it). they made a home visit to his ex's during the ganesha festival week where he was visiting the kids. dont tell me they didnt plan that when our interview was 5 months prior. he told them he visits his kids often, so they I am sure knew he would be there for his kids.

I have a residence here in the USA and always will, there will be no problem with me getting notices sent by USCIS in order for me to respond because I have family that will notify me just like they did when I worked as a traveling RN. I am not dropping the ball on this and will never give up on being with my husband. Some people get lucky with the officer they get at the interview and if our case was approved by USCIS the first time I think they might take offense at the consulate returning it with no proof of wrong doing especially when we can give them a mountain of further evidence. If we move to Canada there is always a chance at getting this case moved out of India and him getting an interview in Canada. Some riskes are worth takeing.

  17. this attorney said he was a member of AILA, and what he said about USCIS not liking split cases had to do with part in one place and part in another. He said that if they got the new evidence that they would request that the pouch with our case in it be sent immediatly so this would speed the process. I have not yet retained him but he said I could feel free to contact him any time for advice. this way I wont be out a bunch of money (yet) and if I do send this further evidence early (all copies, photos in inexpensive albums, I always have the originals) all I will lose is a little money putting this together and the postage. If they do toss it I can put it all back together again. I think it is worth taking the chance if it truly helps speed this mess along. at least I know what the risk is by doing this.

    the attorney also if it looks as though they revoke it is not worth the money to appeal it, I should cancel it before it is revoked and start fresh, this way there is no visa denial on his record. I am looking very seriously to moving to canada and bring my husband there too, already talked with employers up there that said this would not be hard at all. This would prove that he wasnt marrying me for a green card. with our economy being so bad here Canada may not be such a bad thing.
