Hi LaniLin, I'm in the same situation right now. If it gives you any relief, I've been to the US twice since we started the process, and haven't had any issues on arrival.

Thanks! Yeah, we have traveled to the US as well during the process. I guess I just got nervous when they specifically said in the latest communication to not make travel plans. But sounds like they mean travel plans for the permanent move so we should be good!

You are fine.  Enjoy your trip to the US.

If asked, tell CBP that your husband is traveling to the US for vacation and intends to return home for his visa interview.

P.S.  He would return to home to interview for an immigrant visa.  He gets the green card after he enters the US and is inspected by CBP.  He is not going home for a green card before he moves.  US embassies/consulates do not issue green cards.

Thanks for responding! And for the clarification. :)

  2. Hello, I searched but didn't find an exact question like mine. Would love to hear from anyone who has been in this situation. We booked a visit to the US to travel there for Christmas, with a return flight in January where we will return to Israel and wait for the green card before moving. At the time of booking our trip we had not even submitted all documents to NVC etc. Since then, documents have been submitted, fees have been paid and we just received the email that case is complete and we are now waiting on a date for the interview. I got nervous about our upcoming trip when I read "Please do NOT make any travel arrangements, sell property, or give up employment until you have received an immigrant visa from the U.S. Embassy/Consulate General.".

Based on other timelines, there is no way we would miss the interview by traveling when we planned while we wait for the interview date, and if for some reason they scheduled it for a time during our trip my husband would just change his return flight to make it back early for the interview. Is it still OK to travel to the U.S. for our visit? This was always just planned as a visit. Will my husband be stopped at customs? Or will we be OK to go forward with our travel plans?

Ours was submitted August 17, 2018 and we just got approval on August 21,2019. Seems like they are getting through August filers now so hopefully you’ll hear any day. (We were at Nebraska!)

Hello there! Quick question, how do you go about the application process with a joint sponsor? My significant other and I are considering this but have no idea how to go about it!

the sponsor doesn't come into play until after the i-130 is approved. so first you submit your I-130 petition and then if you, the petitioner, can not financially support the intending immigrant, you can use a joint sponsor to help meet this requirement. That is where the I-864 comes in. :)

One copy is what is required for the joint tax return. Even tax return transcript is very long??

They didn't order a transcript, but made us a copy of their copy they were given for their records by the person that prepares their taxes.  Seems there are a lot of additional forms included due to owning a business and property etc. Looks complicated. Do I only need to include the copy of Form 1040 (which is only 8 pages), even though these other forms were submitted with their federal tax return?

  6. Hi, I (petitioner) am using my mom as a joint sponsor for my husband (intending immigrant). She is filing the I-864 and her husband (household member) is filing the I-864a. My question is - if the i-864 sponsor and the i-864a household member have a joint tax return can you just submit 1 copy? Their return is a very large amount of pages and to include 2 copies of the same document seems silly.

An LPR petitioning for a spouse would fall under F2A, which is processed by CSC right now.

    https://egov.uscis.gov/processing-times/

Current processing time for this category: 18.5 to 24 months

This is also ignoring that an IR of a USC has a visa number immediately available. For F2A, the wait there was ~2 years until just recently (so even if USCIS approved the case in a week, it would have still sat for 2 years with no way to expedite).

I see what you are saying. I guess my comment was just in general as I'm a USC and I've been waiting for a year and am seeing the same thing - some people applied just this year and already have their NOA2. Frustrating!

  8. The company my husband (the intending immigrant) works for is interested in having him continue working for them once we move to the U.S. As of now it is just a conversation, but it looks very likely. If the intending immigrant's income will continue once we move, what evidence can I provide? Would a letter from the company suffice? Does it need to be in the form of a contract? I think they are waiting to see when we are planning on moving before they actually get to the contract phase, and this process makes it near impossible to give them a solid date. That's why I'm wondering if some type of letter would suffice.

    Thanks!

  9. Hello,

I'm a little confused on how to handle the i-864. I am the petitioner so have to file one, however have had no income since we had our first child 3 years ago, and because of no income also have not filed U.S. taxes. My mom and stepdad will file a i-864 and i-864a respectively and have substantial income etc. so it seems we are covered, but it does feel strange to file my own with so many zeros. Should I include my husband's (beneficiary) assets here in Israel on my i-864? We own our apartment in his name and he owns 1/3 of another apartment we will sell upon green card approval to give us a financial start in the U.S. We also have a car that we will sell. I really don't want to complicate things if this isn't necessary as it comes with a lot of additional paperwork to prove this ownership/translations, etc. and because my parents can technically support us on paper. Just looking for some advice!
