  1. Hi Guys, I need your help on what to respond with. I received a yellow RFE around April 24th 2020, it states that: My initial Household was just "2" for me and my wife. and my income alone clearly meets the 125% Federal Poverty Guidelines for Hawaii. Why would they say that they could not determine? my income? or i just probably forget to sign it? but i doubled/tripled check before sending out the documents. I kind of doubted and thought that it's maybe because i filed the AOS and sent it just before (March 31st 2020) the expiration of the old I-864) , and that they haven't really got to take a look at it until early April, which is past the expiration date, based on the "Online Status Update" because of all the policy changes that's happening to USCIS and Covid-19. Im about to send them "my reply", which includes a newly updated I-864 expiration date (October 31, 2021) with a total of "4" household size this time, which i included my mother and father this time since they live in the same household as ours. I also added forms I-864A for both of them and added all their income to mines which "over exceeds the Federal Poverty Guidelines for 4 Household Size". But I'm worried that USCIS might reject our AOS petition because suddenly i have 4 in the household size when in prior i only sent 2 as my household size.. what shoud i do? write them a letter stating that even my income alone can hold for the 2 household size?
  2. Hi, I'm wondering whats taking USCIS so long to process my application for AOS along with application for EAD and also AP. We sent our application on the 12th of February through USPS, to Chicago IL. We had it tracked and it arrived at the 16th of february at their address. and so far nothing came in yet in the mail or notice though email/text with G-1145 on top of my application. I know that USCIS implemented the Inadmissibility on Public Charge Grounds final rule nationwide, including in Illinois, on Feb. 24, 2020. but our application came in earlier than that, ill post the note on the USCIS Website. " the rule affects postmark application starting on the 24th and after that date" Thank you for your time. Mahalo's ALERT: On Feb. 21, 2020, the Supreme Court stayed the statewide injunction issued by the U.S. District Court for the Northern District of Illinois affecting Illinois filers. USCIS implemented the Inadmissibility on Public Charge Grounds final rule nationwide, including in Illinois, on Feb. 24, 2020. USCIS will apply the final rule to all applications for adjustment of status, and applications and petitions for extension of nonimmigrant stay or change of nonimmigrant status postmarked (or, if applicable, submitted electronically) on or after that date. For applications and petitions that are sent by commercial courier (for example, UPS, FedEx, or DHL), the postmark date is the date reflected on the courier receipt. USCIS will reject any affected application or petition that does not adhere to the final rule, including those submitted by or on behalf of aliens living in Illinois, if postmarked on or after Feb. 24, 2020. The final rule requires applicants for adjustment of status who are subject to the public charge ground of inadmissibility and certain applicants and petitioners seeking extension of stay and change of status to report certain information related to public benefits. Due to litigation-related delays in the final rule’s implementation, USCIS is applying this requirement as though it refers to Feb. 24, 2020, rather than Oct. 15, 2019. Please read all references to Oct. 15, 2019, as though they refer to Feb. 24, 2020. USCIS will not consider, and applicants for adjustment of status do not need to report, the application for, certification or approval to receive, or receipt of certain previously excluded non-cash public benefits (such as SNAP, most forms of Medicaid, and public housing) before Feb. 24, 2020. Similarly, USCIS will not consider as a heavily weighted negative factor receipt of previously included public benefits (such as SSI and TANF) before Feb. 24, 2020, in a public charge inadmissibility determination. Certain classes of aliens are exempt from the public charge ground of inadmissibility (such as refugees, asylees, certain VAWA self-petitioners, U petitioners, and T applicants) and therefore, are not subject to the final rule.

Hi, I have a case where i'm expecting my NOA2 to arrive in the mail, it indicates it was sent on July 17 2019, i didn't get to check my case status until 2 weeks ago. so when i did check it said (Document Was Returned To USCIS) " On July 25, 2019, the Post Office returned your document to us. We will hold your document for 180 days or until January 21, 2020. Please go to www.uscis.gov/e-request to request that we resend the document to you." Side note me & my fiance at he moment is already in the process of getting her interview at the embassy. Our petition is obviously approved already but, I'm worried because we need our NOA2 for AOS specially. I'm confused to what happened because i check my post mail regularly but nothing came in, We have already receive our NOA1 way back in March on the same address. I did what it told me to do and i put in the request but USCIS emailed me back saying i need to File form I-824 for a duplicate of my approval notice. I'm upset because they still have my original Notice that they are holding on to, and now they want me to file an I-824 which cost $465 to file!? and for a duplicate? I'm obviously not filling that form. I need some advise on this if anyone went through it. thank you for your time.
  4. HI, my fiance is in waiting for the interview this coming next week. I Have a case where my NOA2 didn't come in the mail yet, but its already approved. She got a notice way back on the 9th of July , of her own indicating that my I-129F petition is approved and is sent to NVC and so on and so on got approved now it's at the emebassy. She did here medical already now we just put in our appointment. We're worried because where wondering if NOA2 is required for the interview. but like why would it be required if everything is approved already, and NOA2 is just a Notice for me saying that my petition got approved..

Hi me & my Fiance is on the process of waiting for the interview day. where just looking through our requirements and I noticed some people say you need your most 3 recent tax transcript but some says you just need the most 3 recent Federal Tax return? Im a bit worried because i already gave my 3 most recent tax returns & will they honor that as proof?.. Whats your guys take on this...

  7. its about the Ds-160: Travel Companion - I the petitioner plans to go back Philippines when my fiance's visa hopefully gets approved so that we can do a proper goodbye to her family.. and be able to fly out back to US with her since its her first time flying also. I'm a little confused on the travel companion options in DS-160 because if you say you are traveling with someone" there is no option saying "traveling with Petitioner/Fiance" so what should we do at this point, just say No? on the question asking if my fiance is going with anybody?
  8. Hi, I had some general questions if you guys could help me out with some of them. Me & my Fiance is about Five Months since filling the petition. So my Fiancee is about to undergo her medical examination 2 days from now, She & I was worried that she's about a week away from her Menstrual/Period and also read that sometimes they will turn down the urine test and visual genitalia exam if she's bleeding still. I heard some successful stories of using Tampons that day just in case and clean/remove it before the physical exams. but that article was back in (2014) so I'm not too sure now what the rules are now. The other Question i had was that she had a recent local CBC test and her results where a little off normal for her, (Red BCells 2-5) (White BCells 10-25) her Hemoglobin is normal and also her Platelet.. Would that affect her chances of passing the blood test exam? Also another one is that she also had her Urine Test, Her result Had a +1 Protein and that's about it, means also that it could be a little sign of kidney disease.. So Question is wold that also affect her passing the Urine test exam at St. Lukes.
