  1. I was able to get the number off the back of my processed check today and I was able to enter that in my profile at USCIS.

    I was able to pull up the status:

    Receipt Number: XXXXXXXXXXXx

    Application Type: I130, IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN

    Current Status: Case received and pending.

    On January 29, 2008, we received this I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN, and mailed you a notice describing how we will process your case. Please follow any instructions on this notice. We will notify you by mail when we make a decision or if we need something from you. If you move while this case is pending, call customer service. We process cases in the order we receive them. You can use our processing dates to estimate when yours will be done. This case is at our CALIFORNIA SERVICE CENTER location.     Yeah, Desi, based on your timeline, I'd say your NOA1 is soon. Has your check been cashed? Keep us informed as you are the first December reference we have.

    Spoke too soon!!!! I just checked my account and yes the check is cashed!!!! Can't see the back of the check yet but I'll probably be able to by tomorrow.

  3. Thanks but I have already filed, meaning have sent it off to USCIS and they received it on 12/3/2007. I called today to USCIS and told them about my situation. They said she has a choice between using a new name or the old name. But whatever she chooses, she needs to be able to provide identification in that name. USCIS also said that I will be able to make "corrections" to the I-130 once I receive the NOA1 because then I will be assigned a case # to refer to.

    Does anyone know if correcting the I-130 form causes a huge delay? This is the only thing I'm worried about. I wouldn't mind correcting it and have her get a new passport, if it won't cause much delay.

    I already filed my I-130 to bring my wife here from India. After marriage, my wife's middle name changes from her father's name to the my first name. She already has a passport with her original name(the one with her father's name). When I filed my I-130, I put her original name. Is this going to be a problem? Also, what can I do now to fix this? Some people are saying that they put the new name on the I-130.

    I really don't want to get a lawyer just for this change but if I have to then I will.

    The I-130 will ask the beneficiary's name which is her present legal name. Further down it will as any other names she has been known by including her maiden name so her name with her father's would go here.

    Thanks for the reply. Does she need to get a new passport with the new name? Also, how do I correct my I-130 at this point?

  6. THANKS to ALL for answering the questions!!!!

    I'll be following the K-3 route and will wait until I get married to start the process. I think with K-3 its taking about 4 to 6 months on average which seems to be the fastest comparing to I-130.

    I was thinking of going there now, do the court marriage, file the I-130 from here and then by the time i go there for marriage, she would have the visa to come here so that she can just come with me. However, I don't think that this will work since they may have problem accepting the court marriage as a bonafide marriage.

    Does providing the evidence of bonafide marriage such as phone bills, joint bank accounts, etc. speed up the processing time?

    First of all, I LOVE THIS FORUM. In just one day, I found so much information that I've been searching everywhere without any luck!!

    My situation: I'm getting married in end of October. My fiance is in India at this time. I'm U.S. Citizen.

    My questions are

    1. What should I file? I-130 with I-129f (k-3 visa)seems to be the best choice but I can also file for fiance visa(k-1) and that would be just 129f.

    2. Where should I file? Since I'm getting married in India, I have option of filing from here or over there, correct? If so, which is preferred/faster?

    3. Can I do anything at this time to help this process? Maybe go there for a week and register marriage?

    4. Also, is it true that if I file from Delhi, I would need to stay there for 90 days? I keep hearing that the rule does not apply anymore. Does anyone know for a fact what the current law is?
