    Last Updated: August 7, 2020

     

    On Wednesday, July 29, the United States District Court for the Southern District of New York enjoined the Department of State from “enforcing, applying, implementing, or treating as effective” the Department’s October 2019 interim final rule and accompanying Foreign Affairs Manual guidance related to the public charge ground of visa ineligibility.  The Department is complying with the court’s order and is in the process of updating its guidance to consular officers on how to proceed under the preliminary injunction. In the interim, visa applications that appear to be ineligible under INA 212(a)(4) will be refused for administrative processing to allow for consultation with the Department, including legal review to ensure compliance with applicable court orders.  Visa applicants are not requested to take any additional steps at this time and should attend their visa interviews as scheduled.  Applicants are not required to complete nor should they present the DS-5540, Public Charge Questionnaire.

    noone knows exactly if they should bring it or not because apparently if you dont they reject you?!?! i heard weird things so far.

    just ask and if they say no and fill it out anyway and bring few important documents with it as well

    It would be wise to have a joint sponsor yes .. the interviewing officer will make the final decision and you may not need the joint sponsor .. but, by lining it up before hand, it will save you time if you do 

    If I provide bank statement and we own home at interview are we still need joint sponsor

I wouldn't bother then submitting such updated return (creating confusion) but rather look for joint sponsor.

    My 2018 it’s show more than my 2019 and I got the copy of transcript it’s show everything right except the total and growth income it’s less than I make even if I still above I just don’t know what should put as is in my transcript with mistaken or what

    if you want to file with adjusted amounts, then either wait for IRS to process 1040X and then get your transcript or otherwise you could try file now 1040X but you still need corrected w2. 
     

    keep in mind though, that the current income (needs proper evidence) might be higher than your last year's return, so a couple of k shouldn't make a big difference, meaning you could file whatever 1040 you have submited for 2019 (while IRS works on your 1040x) so you are not waiting a few months just to see a couple of k more on your past return.

    This meaning I can put the 1040 and w2 in my affidavit of support with less k and upload it to nvc and when it’s coming to interview I will show the correct income with my amended or can u make it clear for me more

    It’s  the gross income number it’s less couple of k can Iput the real number in the my affidavit of support and attachment 1040.x and the new new w2 form ?

  7. In my 2019 transcript the gross income it’s show less  make during to  fault from my company W2  and now I admended  1040x and the company they will send new w2 and it will take up to 16 weeks To irs to fix it so what should do ? 

    Whats option I have cuz 16 weeks it’s a lot to be waiting thanks so much for helping

    I already got it from alabbasiya and the marriage certificate does include my mother name and my father name It’s noha Ahmed Mohamed and in my birth

    It’s the same name sir but will explain my mother name in my marriage is noha Ahmed Mohamed and in my birth certificate it’s noha Ahmad Mohamed Ahmed so the is this will make Issue or no ?

    I don’t have problem with my I’d at all or my name in Egypt we don’t use the mother name we used the whole father name the thing is my mother name it’s shortage in my marriage not her full name and worried to make any problem?

    Wrong.  Unemployment benefits are based on insurance paid by the employer.  It is a non-issue to receive them.  To BE "employed" at the time of submitting the affidavit can be a problem.  Why do people who know little about a subject, ask questions, the argue with the answers.  If you think you know the answer, why ask the question.

    If I was know the answer I wouldn’t ask I was know now during to visa journey that’s all thanks
