  1. Hello! I am nearly ready to submit my AOS (i864) however I have a simple question regarding the word "attach."

     

    The document itself says:

    Quote

    NOTE: You must attach a photocopy or transcript of your Federal income tax return for only the most recent tax year.

    The i864 instructions say:

    Quote

    You must provide either an Internal Revenue Service (IRS) transcript or a photocopy from your own records of your Federal individual income tax return for the most recent tax year.

     

    So when they say "attach"/"provide" my transcript, do they mean I need to add the scanned transcript to the i864 document (for a total of 1 pdf file) or do they mean upload the transcript to CEAC as well as the i864 (for a total of 2 pdf files)?

     

    I know it's a bit of a silly question but I could not find clarification and cannot handle an RFE setback for something so minor.

    I'm well into month 13 of waiting on NOA2 but my partner and I have never overstayed a visa or broken a law*. After the USCIS to NVC handover delay, the months it'll sit there, and the wait for an interview, I'm looking at 17+ months myself! BamaGoddess26 should be prepared to wait a lot longer than that, I'd wager.

    I'm sorry, Jorgedig is right. There is a ban on immigration from Iran at the moment. However, quoting a (former) U.S. Department of State Legal Advisor, "There are numerous exceptions to the ban, such as dual nationals who can travel on a passport of a country not covered by the sanctions."

     

    Are you a dual national? Check out other exceptions and see if you apply. Good luck!

    Yes! File your (thoroughly checked and complete) I-130 as soon as you can! Check the guides on this website and triple check the official instructions.

     

    I applied in June 2018 thinking I could move in August 2019, but my I-130 hasn't moved an inch. It takes a long time.

    Oh, now I know how I got it in my head that the NVC mails a package, it says it right here on VisaJourney's step-by-step guide.

  8. Hello all,

     

    A similar question was recently asked here but I would like to put my own spin on it.

     

    Background info: My wife and I are living together in Japan, however come the end of July, our lease will end and she will move in with her parents (in Japan). At that time, my employment contract will end and I will stay as a guest in her parents house for ~2 weeks before moving to the US alone (waiting impatiently). We are only at the NOA1 stage but our petition has been processing since June '18. One of my (many) concerns is that they will finish processing our stuff and the NVC will ship us a package before our address change is registered.

     

    Question 1: The USCIS agent I spoke to on the 1-800-misinformation line told me to update my (Japanese citizen) wife's address via a letter to the processing center. I clarified and she asserted that there is no form, no standardization, just a letter.

    Is this true? It seems so un-USCIS to require so little. I have been given poor information from the 1-800 number before and would like to confirm with you generous folks.

     

    Question 2: I'm worried about the timing. I'd hate for my love letter to the processing center and an NVC package to pass each other over the Pacific. Since my wife is moving in with her parents until her visa is sorted, and since I will be moving into my family's home in the US, can I go ahead and submit this paperwork now? I understand that typically this is not submitted until the move has taken place, but seeing as both of us are moving to a place where family members already reside, is there any harm in going ahead and changing our addresses now?

    to see if there have been request for more evidence sent, case sent to Department of State (case approved), etc.

     

    To be honest, you do not really need the first physical letter NOA1. My wife and I never received that NOA1 letter and we have not opened our NOA2 (approval)...and my wife has been in US for a few weeks now.

  10. Hi everyone! New to the community.

     

    *Short version: I've been waiting since July '18 for anything. No physical mail, no I-797, nothing has come to my house.*

     

    I'm a US citizen living with my Japanese wife in Japan, where we've been for 4 years. We married in the US, just before moving to Japan. We intended to move back to the US this August, but that's looking all but impossible at this point.

     

    I mailed my I-130 application in June '18 and received an email the next month saying my "case has been accepted" and I'd receive form I-797 in 7-10 days. After 10 days I thought "sometimes it takes a month for things to come all the way to Japan, I'll wait." A month passed, then another, so I decided to call USCIS and I kick myself for not recording the call. The operator said the I-797 isn't important, quote "don't worry about it." It's just to confirm my address, she said. So we confirmed my address over the phone and that was that.

     

    Month after month of waiting. 9 months pass. I call again, gently prodding a depressed-sounding operator with a couple small questions. He tells me there are "no problems" with my case and he doesn't "see any reason to believe it will take longer than 10 months."

     

    As you can tell from the title of this post, it's taken more than 10 months. All of the waiting and uncertainty has me thinking about that missed I-797 again. In all this time I have received absolutely no physical paperwork. I was okay with this, a year ago when I was told it was no big deal, but 11 months later I'm pulling out my hair. I filed a non-delivery notice last month but the case hasn't been assigned.

     

    Am I worried about nothing? Is the I-797 really a waste of a good piece of paper, and all I need is that old 30-word "case accepted" email? What would've been in this mysterious package I never received?
