Thanks for the links. For some reasion I never got NOA1 letter which tells how many days it takes to process.

And i rescheduled my Finger print appointment and finished it. Does that delay my process ?

i sent my N-400 applicaiton on 03/07/2008 to Texas Service Center(Local Office: Atlanta ).

Check cashed on 03/10/2008.

Never got NOA1 letter which gives how many days it takes to process.

Got Bio metric appointment for April 10th, rescheduled to April 15th and finished it.

As per USCIS website, Last touched on 03/18/2008.

No activity after that.

I got Card Production ordered email, on April 10th and got same email on April 11th.

On April 15th another email saying that "Approval notice sent". This is my current status, but i am hoping the card in mail any time.

i don't know about other people, who recently got approvals.

On April 10th, the USCIS online status said "Card Ordered to be Produced, contact us in 30 days if you dont get the card", just like yours.

But! Now the online USCIS has changed to "Approval Notice Sent", because we got an approval notice yesterday.

For God's sake, I WISH I had taken a screen shot of that "card ordered" page, because now I have no proof it was ordered. I just called the USCIS customer service line and they said they cant go back and check previous updates.

I have a bad feeling the USCIS made a mistake in telling me my card was ordered.

Has anyone else gotten an update of "card ordered", but never actually gotten the card? Sounds odd, but this IS the USCIS were talking about. They seem to derive great pleasure from yanking our collective chain.

Hi All,

I am tired of this waiting game. As my 3 year Conditional Permanent resident will be finished some time in May....i am preparing my N-400 form to apply for Naturalization. I will be mailing this application tomorrow.

I wish i have other choice, other than applying to TSC.

I am sending my N-400 package. Before that, i want to make sure what i am doing is right.

I have 2 year conditional permanent resident card issued on 05/11/2005. I applied to lift conditions to TSC on 02/27/2007. Its recently got transferred to VSC.....still not approved.

Now i fall under 3 year lawful permanent resident (still 2 months to go, but 90 days bracket to apply) and i am in USA since July,2004 & married to USC since August'2004.

I gathered all the documents to send my N-400 package.

My Question is:

In the N-400 form Part-6, Part-7, asking about, where you lived, worked, traveled for the last 5 years.........do i have to write where i have been from last 5 years....while i am not permanent resident from past 5 years ?

In my case does it mean that i have to write for past 3 years where i have been? or at least since July,2004 will work ?

And following documents are included with this application:

• Fee, N-400 Application Form, Two Passport Photos.

• Copy of permanent resident card, I-751 extension letters.

• Copy of my wife’s birth certificate (USC), passport 1st page.

• Copy of our marriage certificate.

• Copy of house rental agreement for year 2006, 2005 and 2004.

• Our DSL, Telephone, cable bills.

• Bank statements (Current & Previous), checks showing our joint accounts.

• Copy of the tax statements for year 2006, 2005 and 2004.

• Copy of our driver licenses.

• Copies of various car insurance policies

• Copies of the titles of our cars, showing joint ownership.

• Copy of my 401K, life insurance beneficiary designation statement.

• Copy of our current health insurance cards showing a joint policy.

Am I missing any thing? Your input is greatly appreciated.

I also got same email notification, last Updated 02/13/2008. They changed message instead of saying: transferred to VSC " to Case is now pending at the office to which it was transferred."

I don't think its good idea, to stop the adjustment of status before getting divorce decree is in your hand. Then you won't have any status. I think the better way to approch is, file for divorce....it may take couple of months to get your divorce finalized. In mean time if your AOS case is approved, you are lucky.

Other wise, after having divorce decree in hand , you can request to halt your adjustment of status process. And then you have to apply freshly I-751 form with filing separately clause.

Because you cannot file new I-751 seperately, with out having Divorce decree in your hand.

Please don't think this is a troll. I created a new account to remain anonymous and I need some advise.

How serious is the affidavit of support? My husband came to the US on a K1 visa and we married when he arrived. We've applied for the AOS but it's still pending. Long story short, this marriage isn't going to work out and I need to know if I can just cancel the AOS before it's approved and withdraw my affidavit of support or am I going to be financially responsible for this man as long as he's here?

If he goes to live with the girl he's been chatting up on the internet am I going to end up being their guaranteed paycheck?

Sorry to hear this. I would definitely contact USCIS and explain the situation. File for divorce. Try to stop the adjustment of status.

You're lucky because you found out so soon. If you were married for a few years and he had just waited the entire time he would have much more in his favor. As it stands you have a chance to say you were used to gain entry into the US and the guy used the marriage to de-fraud you.

If this is to happen to someone it is far better that it happens where you are. The only thing better is to find out before they even arrive, but it is a bit hard in a LDR.

Best of luck to you. I'm sure you are feeling used, angry, depressed, but keep reminding yourself how much worse it would be if he had PLR status and you needed to pay alimony.

Hi all,

I went to GA DMV (http://www.dds.ga.gov/locations/dllocations.aspx?csc=37) for my driver license renewal, I shown the NOA letter with my expiring conditional residence card(expire in May 2008). They did not understand it at first, but talked with other officials and issued the license for one year. I think it depends on the mood of that official in that particular office.

My experience with Atlanta Local Office: I went there to get stamp on my passport, they did not give me one and told me it’s not necessary.

Anyone got any news? Still waiting - jumped the 6 months mark as of yesterday....

I applied my I-751 to TSC some time in Feb and got NOA dated 02/27/2007. Today i called Customer Support to find my status and told them my application passed over 6 months period as mentioned in TSC time lines.

She said that she is going to send a request to TSC, to find whats going on. And TSC is required to respond in next 45 days.

Lets see what happens.

In general, the clause used in divroce may be "Irretrievable breakdown of the marriage" , which may not say lot of things. Does it effect I-751 decision making, if you are a pertitioner or the respondent in the divorce arragement ?

I am not sure I follow what you are saying. I don't have a "document" for the conditions surrounding the divorce. I am preparing a statement for that right now. Should be able to send it later this week or by next week.

Were you the petitioner or the respondent in the divorce? Either way, you should have a document ~ the divorce petition, itself should spell out the grounds for the termination of the marriage.

I guess that was dumb question to ask does it look like Open/Shut case....because it never be with INS. There can be many complications. I am curious to know, did you able to produce the document “conditions surrounding the divorce” ?

There is no such thing. Prepare to be approved without an interview, either RFEd or called for an interview, or both RFEd and then called for an interview, or denied (a little unlikely).

Also, make sure you document the reasons surrounding your divorce as well. I just got an RFE asking me to explain that (conditions surrounding the divorce).

I got 1 Year extension (NOA1) and also finished my Bio-Metrics on March'30th 2007. My file was last touched on March 31st 2007. From last 5 months nothing happened to my case. i don't know how long its going to be with TSC.

As per my current situation goes: Here is my story in short

After 1st year of marriage, because of my job, we moved to Georgia (from last 2 years) and her kids (from her previous marriage) never able to adjust here. I always acted with best interest of them in my mind. We tried so hard to please everybody. And past 2 years our life is rollercoaster.....surrounded with kids.

We decided our marriage is not going to work and soon may be applying for divorce. She is ready to help me in any ways to finish the immigration process. I am trying to see my options.

1st, I think i have to file new I-751 separately as divorced person. To prove it as bona fide marriage, can any body suggest me precautions that i have to take in my situation?

when getting divorce, the clause we might be using is "Irretrievable breakdown of the marriage", or is there any other clause that will help with my future immigration process ? (we might be doing every thing ourselves, no divorce lawyer....if possible)

If my wife, write an affidavit about our relationship does that help in my immigration process ?

First, there is a good chance that the jointly-filed I-751 will be adjudicated without an interview and within the next few months. How imminent is the divorce? And is there an urgent need to terminate the marriage now, as opposed to later, after the conditions have been removed?

I really dont know how long does it take to lift conditions with TSC. It can be any given day or nothing may happen for long time. She is strongly thinking to move on for the sake of kids. They dont like school systems in GA and many. And i cannot hold her up for my immigration reasons, which may or may not take long time.

Can any body suggest me on legal & immigration side of my case.

No one in his or her right mind is going to suggest anything on a legal basis, here or anywhere, unless they are:

1. your attorney

2. familiar with the details of your case

however, that said, since you've already filed a joint I-751, I can tell you that USCIS is statutorily prohibited from adjudicating a jointly-filed application, if the parties have since divorced. So, in the event that your wife proceeds with a petition for divorce, or you do, and the divorce is finalised prior to the USCIS deciding the fate of the jointly-filed I-751, you will be required to withdraw the I-751 and replace it with a waiver.

A waiver is a form I-751, with item "d" checked, appropriately. It must be accompanied by a divorce decree.

What would/could happen if USCIS adjudicates the jointly-filed application and you have since divorced? Well, the award of a green card without conditions would be inappropriate under the laws specified in the INA, and it could be rescinded.

The choice then for you at this juncture is to decide....do we prolong the marriage until we hear from USCIS, or do we get on with the process of divorcing, and be prepared to re-file the waiver when it is complete?

Is my case looks Open/Shut case or do i need to go through Immigration lawyer ?

P.S: I really do not trust lawyers, but if i dont have choice, i guess i have to choose one.

First, there is a good chance that the jointly-filed I-751 will be adjudicated without an interview and within the next few months. How imminent is the divorce? And is there an urgent need to terminate the marriage now, as opposed to later, after the conditions have been removed?

I really dont know how long does it take to lift conditions with TSC. It can be any given day or nothing may happen for long time. She is strongly thinking to move on for the sake of kids. They dont like school systems in GA and many. And i cannot hold her up for my immigration reasons, which may or may not take long time.

Can any body suggest me on legal & immigration side of my case.

I have conditional residence card, which expired in May 2007. I have applied for I-751 lift of conditions jointly with my wife to Texas Service Center on Feb 27th 2007. I got 1 Year extension (NOA1) and also finished my Bio-Metrics on March'30th 2007. My file was last touched on March 31st 2007. From last 5 months nothing happened to my case. i don’t know how long its going to be with TSC.

As per my current situation goes: Here is my story in short

After 1st year of marriage, because of my job, we moved to Georgia (from last 2 years) and her kids (from her previous marriage) never able to adjust here. I always acted with best interest of them in my mind. We tried so hard to please everybody. And past 2 years our life is rollercoaster.....surrounded with kids.

We decided our marriage is not going to work and soon may be applying for divorce. She is ready to help me in any ways to finish the immigration process. I am trying to see my options.

1st, I think i have to file new I-751 separately as divorced person. To prove it as bona fide marriage, can any body suggest me precautions that i have to take in my situation?

when getting divorce, the clause we might be using is "Irretrievable breakdown of the marriage", or is there any other clause that will help with my future immigration process ? (we might be doing every thing ourselves, no divorce lawyer....if possible)

If my wife, write an affidavit about our relationship does that help in my immigration process ?

I will have following documents ready for my New I-751:

1. Tax returns, from past 3 years

2. Vehicle titles registered, under our both names

3. Joint Bank Account from past 2 years, telephone bills, drivers’ licenses stating our address.

5. Health Insurance cards, (whole family is under my insurance plan)

6. My Life Insurance & 401K beneficiary as my wife (vice-versa)

7. Very Few pictures

8. I can produce affidavits from my wife & mother in-law if necessary

9. Affidavits from our common friends,

10. Rental House agreement from last 3 years, where we both signed.

11. Divorce decree

I mailed my I-751 package Texas Service Center on 02/20/2007. Check cashed on 02/27/2007.

Bio-Metric Service Appointment letter received on 03/19/2007 for 03/29/2007 .

NOA 1 Year extension approval notice received on 03/21/2007.

Finished Bio-Metric submission on 03/29/2007.

When i check my portfolio on USCIS website ......My case Last updated dated on 03/31/2007.

[03/31/2007 CRI89 PETITION TO REMOVE CONDITIONS OF PERMANENT RESIDENT STATUS RECEIVED ].

Nothing after that...........

I sent my application for Removal of Conditions (I-751) to TSC on 02/20/2007 and recivied(checks cashed) by them on 02/27/2007. Finshed my Bio-metric finger prints on 03/29/2007. My application was last touched on 03/31/2007.

Waiting on any changes....

Actually I took InfoPass and went to local Atlanta immigration office to get I-551 stamp, they didn't issue me one. They said NOA letter and expired GC is enough.

There is so much inconsistency. The immigration officer told me we are entitled to have that stamp!

As i understood, they will issue I-551 stamp, if you loose your NOA letter or if you didnot get NOA before your 2 year GC expires. And again it depends on the officer you will face in the local office.
