    Okay. So that means I shouldn't go forward with the application. I am not going to risk any violations or rejection. And from what I have read so far, if he goes back now, it will be of no use. 

     

    The only option available is reapply, right?

    Now, what "ties"?  Did you see that the definition of domicile above is " your principal residence (also called domicile) in the United States, which is where you plan to live for the foreseeable future". Just having "ties" is not enough to sponsor someone. 

     

    I presume all his tax filings and obligations to the IRS are up to date?

    Yes. I went through the link that was attached. He has a domicile and his taxes are up to date

    A US citizen parent can't just automatically sponsor a child without actually living (or planning to live) in the US. That us called US domicile. Therefore if he obtained US citizenship, then decided to move to Pakistan thinking he'd use that Citizenship to sponsor his child into the US, you are mistaken. As others noted, family-based green cards are for reunification. 

     

    Have you checked to see if you yourself qualify for US citizenship if your father was a US citizen before you were born? Requires your father to have been living in the US as a US citizen for a certain length of time. 

    Okay, I think the confusion here is that my father had moved back for good. That is not the case. He has ties to the US

    why would your father petition you to be with him if he no longer lives in the US? His primary residence is Pakistan now.

     

     

     

     

    But do you have any proof of this? Anyone else who would like to share what they think. I am very confused

    you can try to get a temporary work or student visa.

     

     

    That makes no sense. He is a US citizen since before I was born. Do you have anything to back what you just said?

    My father had filed the I 130 on my behave. He is a naturalized US citizen.  The petition was approved and now I have been contacted by the NVC to submit the documents and proceed further. Since filing my petition, my father has retired and moved back to Pakistan.

    What type of Visa do I qualify for? And any idea how long it will take to submit the documents and by when will the interview be scheduled?

    Anyone who recently migrated to the States from Pakistan and can help me out? How to go about getting the degree, inter and o levels certificates attested?

    You need to have a checking account with a US institution/Bank. Just put in your routing number and checking number. Easy, just like you pay your electric bill or similar. 

    Thanks! I will look at the guides. Can I have my brother make the payments? He is in the US and working and a citizen.

     

    Also, any idea what is the next step and how long will it take after I submit the documents for it to happen? 

  8. Hello everyone,

     

    I have just received an email from NVC stating that I need to visit the CEAC website and fill in the required forms, gather the documents and make the payments.

    Can someone please guide me, how to go about it? Especially as to how to make the payments and what documents will be required? As I wont be able to access the website for another 72 hours (the email said that first time bloggers have to wait the time period).

    Friending on the country consulate country specific timing and process , you seem closer to completing with  the I130.. but I dont believe there is any ptonk with filing the fiancé visa. Just don’t marry, or do anything that gives the appearance of marrying .. administrative processing may occur .. but it’s likely to happen  on either, if it’s going to happen.

    - It does not matter, just do K-1 visa, assuming it is bona fine and disclose on application that someone already filed petition for you. 

     

    - If your PD has become current, you can stick with your I-130.

  11. Hello everyone,

     

    I have a small dilemma. My I130 petition was approved and I received an email from NVC saying that the application has gone for further processing. 

    I also got engaged a couple of months back. Now, we are not sure what to do. As in which would be quicker should we apply for a K1 Visa or should we wait for the NVC to contact us? 

    Also, if we apply for the K1 Visa and it gets rejected, can I still use my I130?
