  1. Hi,

    My wife and I were married in January of 2007, we applied for a K-3 Visa which was granted November of 2007, She entered the USA and we applied for AOS in the month of August 2008... at that time we were married less than 2 years. We got our AOS interview in March 2009 and after the interview she recieved the Green Card in the mail about 2 weeks later.

    What is the best way to know whether this is a conditional green card or not, when we filed the AOS paperwork we were married less than 2 years, when we went for the AOS interview were were married for more than two years.

    Is there a way to tell if the Green Card is conditional or not?????

    I have a Adjustment of Status Interview for my wife coming up the 16th of March 2009.

    We have been married a little over 2 years, my wife entered the country in December of 2008 and our son was born January of 2009, we live in Dayton, Ohio.

    I wanted some help going thru the check list of things to bring to the interview.

    1. 1. USCIS Interview Letter and Photo ID.

    1. 2. I-693; we have already submitted this and only have a copy of the vaccination report.

    1. 3. I-864; Again I have already submitted this and have a copy with me and all documentation.

    1. 4. All documentation establishing your lawful permanent residency status.

    1. 5. EAD we did not apply for I-512 Advance Parole.

    1. 6. Passport and I-94.

    1. 7. Wife Birth Certificate.

    1. 8. My Birth Certificate, Naturalization Certificate.

    1. 9. Our Son’s Birth Certificate.

    1. 10. Eligibility based on marriage

    1. a. Certified Copy of Marriage Certificate

    1. b. My Naturalization Certificate and US Passport

    1. c. My sons Birth Certificate

    1. 11. Supporting Evidence of our Relationship

    1. a. Tax Return 2009.

    1. b. Bank Statement – 3 Months.

    1. c. Health Care Cards – Beneficiary on Life Policy

    1. d. Wife Medical Bills and Dental Bills.

    1. e. Wedding Photo Album.

    1. f.Application to amend Department of Defense Top Secret Clearance as I am Married to a Foreign National.

    1. 12. Original and Photo Copy of each supporting document I have submitted with our application.

    As I am assembling my application if have the following problems.

    • Items 2 and 3 on the list, do I need to take a copy even though I submitted already?

    • what does item 4 mean?

    • Do I have enough evidence in item11, I am worried as all the utilities are in my name and I do not have a lease as I own the house and the cars, I had all this in place before she got here and saw no practical reason to change any of this as we are married and what is mine is hers.

    Any suggestions from you guys would be much appreciated as I just want this to go smooth and finish up.

    My wife is currently on a K-3 Spouse visa issued on in the month of November 2007, she landed here in the USA in December 2007, we took our time to file the AOS paper work as our son was born in January 2008 and kept us busy, I did eventually file the AOS paper work on the 13th of August 2008 and have just received the “Initial Interview” Letter with a date of 16th March 2009 for the interview. The problem is that my wife is currently in India visiting her parents and is scheduled to come back in the first week of April. Going thru the Immigration letter, it looks like it is strongly recommended to attend the interview on the given date, I would however like to reschedule for one month later as she still has 7 months left on her K-3 visa and I would like her to enjoy her time in India and not rush back……

    Has anyone else tried to re-schedule their “Initial Interview” for the Adjustment of Status process?

    Also, what exactly happens during this “Initial Interview” and when is the Green Card actually issued to the spouse (assuming all goes well during the Interview).

    I would like to take this opportunity to thank all those in the Visa Journey Forum, it has been a long journey for the both of us, especially the 8 long months before she actually got her K-3 visa were especially trying, could not have done it without the support of the expert knowledge of those on this site.     I am preparing my AOS packet for my wife and have the following arranged in order, i have been looking at these papers so long i cannot make out if i have missed anything, i have listed the contents of the package, if someone who has done this before could take a look at my list and express any thoughts, i would be much obliged.     1. Cover Letter – includes itemized list of contents.

    2. I-485 Main Application

    a. Check of 1,010.00 made payable to US Department of Homeland Security.

    b. Copy of Foreign Spouse Passport – All relevant pages – I-94 also.

    c. Copy of NOA 2 Approval Letter for I-130 Application.

    d. Copy of US Citizen Passport – All relevant pages.

    e. Immigrant Birth Certificate.

    f. Marriage Certificate.

    3. G-325A Biographic Information – Completely Filled out.

    a. Two Passport Style Photo Graphs with Name Written on Back.

    4. I-693 Medical Examination.

    5. I-864 – Affidavit of Support

    a. Tax Returns for past 3 years.

    b. Employment Letter.

    6. I-765 Employment Authorization.

    7. I-131 Application for Travel Document.

  5. My wife has a K-3 visa valid for 2 years, we have not applied for AOS yet, can she travel outside the country and back on a K-3 visa that is not expired?

    This is what i found on the USCIS website:

    "Can I Travel Outside the United States?

    If you are in K-3 or K-4 status, you may travel using your unexpired K-3/K-4 nonimmigrant visa to travel outside of the United States and return, even if you are applying for adjustment of status simultaneously"

    According to this statment, i guess she can; any information from members who have actually travelled would be appriciated.

  6. Medical for AOS:

    My wife had her medical in Chennai India before she got her K-3 Visa, we did not take a copy of the medical report at that time but just handed it in to the embassy and they gave us her visa, now she has her vaccination record from India and has had all her vaccines necessary for the AOS at various points in her life, how should we proceed to AOS.

    If we give the vaccination record to Dr Arnold and get the I-693a filled out by him, is that sufficient to proceed with our AOS; or do we have to do a full medical again.

    Please advise as we have completed all other parts of our application, just not sure about what to do about the medical, there seems to be so much conflicting reports on the VisaJourney website and every where we look.

  7. I put my wife on my Blue Cross without a SSN, the column even said optional next to it. I saw a disclaimer on some form that said if your company tells you a SSN is required call the insurance company directly to get them added.

    I also had her added on my checking account at Bank of America (the bank I have my savings account through requires a SSN), listed her as my beneficiary on my life insurance, got her on my credit card as an authorized user, and put half the house under her name. That was about as far as I've been able to get without a SSN though.

  8. All, I am getting my wife’s K-3 package ready for her interview at the Chennai, Consulate. I am putting together a list of documents that will be submitted to the VFS in Chennai and Originals at the interview. Please let me know if I have missed anything. I am so anxious; some one double checking with a cool, calm mind would reassure me.

    Packaged and Ready to go:

    1. DS-156 Completed for Applicant. Two copies with the Bar Code on them; I did them online and printed off.

    2. DS-230 Completed for Applicant.

    3. I-134 Completed, Notarized and attached the following:

    a. Job Letter.

    b. 2006 Tax Return.

    c. 2 Months Pay Stubs.

    d. 3 Months Bank Statements.

    e. CD Deposit Statement.

    4. Marriage Certificate Copy.

    5. Petitioner Passport and Naturalization Certificate Copy.

    6. Applicant Passport Photocopy.

    7. Photocopies of Approval Letters for both the I-129F and I-130.

    8. Proof of relationship stuff, plane tickets, my wife’s medical records to show we are having child together, marriage album, phone bill, vacation/honeymoon pictures together.

    Still not ready; on list to do:

    1. Medical Certificate.

    2. Police Certificate from District Police Station.

    3. Police Certificate from Regional Passport Office.

    4. Photos for DS-156.

    5. Original Birth Certificate for Applicant.

  10. I am completing the I-134 for my wife who is interview at the Chennai, Embassy for her K-3 Visa.. I have read from many of the posts here that I can skip the asset section if my salary is high enough; my job letter states that I have held the same job for a little over 5 years, and my annual base salary is $80,200.00; I have claimed 2 dependents on my 2006 tax return, but they are not my dependents any more for 2007. I believe even with the 2 dependents I am well over the poverty line and can still skip the asset section.

    Any advice from wise members is much appreciated.

    Also if I only use the job info and no bank and home equity info what statement or documentation do I need.

    Hi, I need some clarification, my wife is going for her interview to the Chennai Embassy and we have received the interview letter with instruction on the different forms we have to submit; one thing it asks for is a “Job Letter” I assume this is in conjunction with the Affidavit of Support piece of the package. I have worked for the same company here in the USA for the past 5 years, but wanted to find out just before I ask my HR; what the content of the letter should be; I am sure that some of you have gone thru the process already,

    Can some one basically give me what the format should be and what the contents are expected to be? Thanks very much in advance.

    Hi, I need some clarification, my wife is going for her interview to the Chennai Embassy and we have received the interview letter with instruction on the different forms we have to submit: There are 2 version of the Packet 4; the hard copy that the consulate sent to us and the electronic copy that anyone can download from the website. The Hard copy that they sent to us asks me to submit a Form I-134 where as the Electronic Downloaded Packet 4 says I-864. I am sure I do not have to do both, I am going to email the embassy about this, but was wondering if anybody here had any answers for me.

    Also my salary is high a little over 80K; but bank balance is not necessarily that high, is this a problem? Are they expecting to see some sort of high bank balance? Just a Question.
