Today we went for our interview and got all our visas approved. I'll explain the whole situation:
My father filed the petition for the 4 of us (mom, elder sister, me, little brother) on November 2, 2015 and it was approved on March 2, 2016 (NOA2). Time passes by but we have not received any form of contact. My father consulted with an attorney on Guam about our status on July 2018. The attorney contacted the NVC and the NVC said that it completed the processing of the visa application and forwarded it to the US Embassy on June 14 , 2018 (Take note that we haven't submitted any form of documents to the NVC nor paid any fees). The attorney gave us the case number and the invoice id. We checked our case on CEAC and found that our elder sister wasn't included on the case. We contacted the US Embassy on August 2018 multiple times for the case of our elder sister and why is there no contact from them. They explained she aged-out that's why she's excluded and we must wait for further instructions for interview. We submitted our DS-260 on October 2018. We waited but still there's no contact and time passes by.
We went to an attorney here on Philippines on latter week of April (last month) for a consultation. She said the visa available date is Nov 1, 2017 (as opposed to Aug 2016 on earlier posts because I read the visa bulletin wrong). Our submission of our DS-260 on October 2018 just barely made it so that the petition won't expire (must be within 1 year from visa available date which is Nov 1, 2017). She explained that my elder sister is really out of the case because of aging-out. She calculated my CSPA age and I just barely made it by just a couple of days. If I'm eligible, much more so on my little brother. She contacted the US Embassy and they said that the NVC expedited our case and they are just waiting for us to book an interview appointment. Curiously enough we don't know why the NVC expedited our case and didn't inform us (my father, work secretary of my father which handled the petition, or the family). Anyway, the attorney booked us for medical examination on May 7 and interview appointment on May 21 (this day).
On the US Embassy we paid the IV fees and submitted the required documents on the pre-screening. Apparently on age-out problems they contact the US so that they can do the CSPA calculations and eligibility and the waiting time is very long. After that is the bio-metrics and then the consul interview. The consul said on the interview that both me and my brother are eligible for CSPA and he approved all our visas for the 3 of us (mom, me, brother).
