when we send our AOS application we only attached 1 copy of my husband 2006 ITR and W2, we did not include 2004 and 2005 and also the bank statement was on year 2006 and we did not include sending employment letter verification. im really afraid that we might get an RFE or delay in the process though my husband is making more than 60K per year. can somebody share me their experience with the same situation with me. and by the way when i was tracking my package to Chicago, it was delivered on monday this week..how long do u guys think it will take before i will have my biometrics?

I agree $90 is not that expensive (we paid $190.00) but that's not the problem here, the problem is USCIS does NOT require a full medical, therefore you shouldn't be "forced" to get one... why spend $90 on what you do NOT need, when you could spend $25 for what you need ?

Just a thought, but of you that have been sent to CSC, did you also have an EAD attached?

Personally, if I was setting policy, I would want to streamline K immigrants that were wanting to work before for those that were not going to work (immediately). Of course, thats too logical for our government.

I didn't apply for EAD with my AOS, but it wasn't because I didn't want to work!! I am dying to work, however I didn't feel comfortable shelling out the money for the EAD application when I could potentially get the Green Card before it was approved. Granted, I am taking a big chance, but the lack of an EAD application doesn't mean I don't want to work.

I don't think you can make a judgement call about someone's want/need to work purely based on whether they applied for EAD or not. Everyone has a different siutation.

I agree...the $180 for EAD is a potential waste. Many people are getting GCs in three months time. Why waste the $180?

According to several websites and timelines I looked, Orlando Office is processing applications from 6 months ago, but I still took the risk and didn't apply for EAD either... and we happen to be one of the first ones (from the april filers list) to get an interview appt. Also, I sent photos, copy of our lease, and other evidence, so I wonder if that helped our case move quicker. My wife's friend also got married and applied 1 month before we did and she still hasn't received an interview letter.

Maybe the changes in immigration law are causing a softening of policy and enforcement in immigration.

Today Gie and I went to see the Civil Surgeon to get our vaccination supplement done. Of course, having read this site extensively, I knew that a full physical was not required for a K-1 visa holder. Well after going around and around with the doc over whether a full physical was required or not, he politely informed me that he was going to charge the same amount ($90) regardless. My first instinct was to walk, but as Gie's interview is next week, I didn't have the time to find another surgeon and schedule an appt.

Well, he took me for the $90. No sleep lost over that. But what bothers me is that USCIS is putting money in the pocket of a scam artist by designating this guy as a civil surgeon. And of course, they provide no means to make reports of un-ethical business practices of their civil surgeons that I'm aware of.

If anyone is in need of a civil surgeon on Oahu, PM me and I will tell you who NOT to go to.

I agree and you can file a complaint with the USCIS about it. I am not sure how, but a quick google search I am sure will show you how.

You should file a complaint, they are ripping people off, you do NOT need a full medical done, so you shouldn't be charged for one. They take advantage of people who don't research and because of that are not aware of what needs to be done.

Getting a refund...not going to be easy.

Hell, if THEY mess up the info on your green card, you still have to pay the almost 200 dollar fee.

That's not true. The form states clearly that if it was their mistake, the fee is waived.

I was reading about AOS cases transferred to CSC.. Do You know if those cases transferred have been acompanied with a TONS of evidence of relationship? bank accounts, lease, boarding passes, lots of pictures?

I sent all the evidence required and 6 photos of our wedding.. is this sufficient, at least for skip an RFE?

Noone is certain of why some get transferred to CSC and some don't. We have speculated and guessed several reasons, but noone knows for sure.

They will not refund you, but they might waive the fees if you file AOS again... I have seen it done before with a very very very close friend of mine. They didn't refund but they gave her a "credit" towards re-filing.

Your relationship to your step-father is because of your relationship of your mother to him. That is why they have to wait for your mother's AOS to be approved before they will approve yours.

A US citizen CANNOT petition for a step-child if the child is over 18. After 18 the "child" is no longer considered a "step-child" and cannot receive the benefits of AOS through the US citizen (parent's spouse).

There is a requirement that one must file returns every year, so they dont lose the PR status. Is being carried as a dependent on tax returns by someone else a failure to meet this rule?

It is not just about tax return, or time absent, or time in the US, it is a combination of things.

If they are just going to be coming here to visit you, they should just get a B2 visa.

Ah interesting. I only just noticed you adjusted from another type of visa (not K1 or K3). Not sure how that works with the I-130 if they approve it before or during your interview for the I-485.

I-130 is approved at the interview.

thanks! It's tomorrow at 11:00 so there isn't time to get a copy. I just had it in my hand the other day and got side tracked, now its nowhere to be found. I guess we'll just go there and bring the NOA1 hope they accept that.

Just now having time to give an update on here. Biometrics appt went really well after we found the place! (Why do they have to be located in obscure places?)

Anyway, the folks running the place were very friendly and we didn't have to wait too long....about 20 minutes.

I suppose this is the same place where the interviews are conducted? Hope so...I know where it is now. lolol

LOL.. it is true. The office here in Orlando, is inside a business complex and it has NO signs at ALL of where the actual office is. And it is a complex with well over 150 offices... you have to drive around until you find it and of course, it is in the very back and it faces the opposite side of the road. So not only it is in the back, but it is also behind. lol if that makes sense...

Hello everyone. Hope you are all having a good day. We had our biometrics yesterday. Not as lucky as Nuzzel...2 1/2 hours later!! But we got it done, and had nice converssation while we were waiting together.

Did Iceyshades really get an interview in less than a month from filing or is that an error? Anxious to see when others get their interview appts so we can overanalyze when we will get ours!! You know us VJers...always needing therapy for one thing or another.

Her case is not like ours, If I am not mistaken, her husband was awarded some type of legal right to remain in the US at an immigration court and they scheduled their interview right away.

What timeline are you looking at ? The ones that I saw here on VJ are so old... there aren't any recent ones in Orlando. I am from Orlando and we just got our biometrics done and now we are waiting on the interview letter.

I was wondering if there was anyone out there who as gone in for an interview based on a father/son over 21 years old. Just wanted to know the questions that they ask, and how to be prepared for it.

The father is a US Citizen ? I dont think there is an interview for that, I might be wrong but I thought interviews were to establish that there is an ongoing relationship with the US Citizen and a father/son relationship can be proven just with a birth certificate.

So we had biometrics appt today and it took us exactly 8 minutes to walk in and walk out. No kidding... I looked at my watch when we walked in and it was 12:32, we had an appt for 1:00pm, when we walked in the lady smiled (!!!) and said: "Cell phones?" - so we tell her, no, we left it in the car, she gives my wife a clipboard, we filled out the form, she gave us a ticket with a number and told us to have a seat and wait, from walking to the chair and almost sitting down, they called the number... it was seriously, 10 seconds... fingerprints done, photo taken (Wife says: Oh I love the picture !!! "I say, yes honey, it looks beautiful" lol), Thank you very much, Bye... - we are out at 12:40. Painless and very easy. I just hope everything keeps going smoothly...

Now, it is waiting for the interview - hopefully it will be a breeze as well.
