  1. Two major law firms' websites posted unconfirmed source about new development on FBI name check.

    FBI Delays To End

    Immigration Daily has learned that the FBI name check delays that have stalled benefit applications may soon be a thing of the past. We understand that the Executive branch will soon provide name check clearances within a prescribed amount of time. If the clearance is not completed within the designated timeframe, the benefit will be approved by USCIS while the FBI continues to work on the security process in parallel. The rationale to move to this new process is not just better customer service for benefits applicants but also because it will enhance national security (our security demands that the bad guys be apprehended, not merely be denied immigration benefits). The background for this change of heart by the Executive branch is the fact that many federal courts have been coming down hard on excessive name check delays by the FBI. In fact, not only have some courts ordered expedited name check completions but in some cases courts have suggested that the courts have and would use their authority to adjudicate petitions if the Executive branch could not get its act together. The attorneys and litigants who have sought federal court relief over these last several years deserve credit for forcing the Executive branch to adopt a more effective policy in this area (when it does happen, hopefully very soon). Stay tuned.

    Well, there have been some rumors like this in the past, in fact, USCIS once said that this problem was going to be resolved. We hope for the best, because not only is it ridiculous to make some people wait 3..4 years but it also shows that the security of this country that they talk about so much is seriously compromissed - They can't even process a background check, who is to say that they are going to be anymore efficient when it comes to catching the bad guys.

    Oh well... I wish a lot of patience and luck to the ones stuck in the FBI name-check. I can't imagine walking 1 minute in your shoes.

This is due to internal USCIS processing being performed on your Case. This will be reflected in the "Last Updated" date, but may not result in a different status message. :yes:

    We told you the updates are not accurate AT ALL. Do not rely on them. YO uare approved and you should get your card in the next few days... my wife's I-130 still says pending on the website and she has had her green card for almost 2 months.

    You are approved ! You have to be happy and not anxious anymore - at least not for a while.

  3. yuandDan, another question about the affidavit of support. We have to file two total! How ridiculous! This is incredible! I figured the adjustment of status would be way easier than filing for the visa. ugh. You sound very knowledgable. Any other advice?

    Exactly why is it ridiculous ? I don't understand why everyone feels like they have the right to be mad about the paperwork. Next time, marry a US citizen and you won't have to deal with paperwork.

    I, personally, think that the AOS is a pretty straight-forward and easy process, it is time consuming, but other than that it is extremely easy.

    Upon the approval of my AOS I received CRIS E-mail stating that "CARD PRODUCTION ORDERED" just after 2 and a half hours after my interview. But after checking the timelines of VJ members I saw different types of Emails regarding I-485 approvals. Welcome to USA letters comes first, I-485 sent approvals comes next in few days and card production came to last Email before receiving the card. But on my case, Is it normal that I have received first the " card production ordered " before those welcome Emails ??? and it is almost a week passed there's no update emails regarding this like those??? Can you please give me THE step by step details of I-485 approvals on CRIS emails and total numbers of days onreceiving card in the mail???

    Secondly, I have this question about SSN. Immedietly after the AOS interview, I went to SSA to apply for my SSN, so then...I am just confused again of How many days does SS card arrived in mail??? For those people who already received their SS card,can you please share us the number of days you've waited before receiving this???

    Lastly,It is about the drivers license. What is the average days before you recieved the actual DL card in the mail after achieving your passed test at DMV??? Can you share us the procedures for attaining a DL card???

    Sorry for this questions of mine??? But I am sure that there are people also who has the same questions regarding these cards. Hopefully you are kind enough to share your idea or experience and it would be appreciated.

    There isn't a rule of how many or how often updates are sent. Some people receive welcome letters, some don't. Some people receive card production ordered e-mails, some don't. Some receive the same email 3..4 times.. some don't. There is really no rule - so you have no reason to worry. The card should be on its way, it might take a few mmore days because of Thanksgiving.

    2. My wife's social arrived pretty quickly. She applied on a monday and received the card the following tuesday. They run checks to make sure you are in the US legally and sometimes it takes longer for them to update their system - therefore it might take 3...4 weeks to receive your card.

    3. My wife applied to renew her license right after we received the NOA1 - They gave her a piece of paper which was a temporary license and about 30 days later she received the actual license valid for 1 year. After receiving her green card, she went to the DMV and again, she was given the piece of paper but the license arrived the following week and it is good until 2014.

    Miles, USCIS, SSA and the DMV don't all follow the same rules and same time frames - everyone here seems to receive their cards at different times and we haven't been able to figure out some sort of pattern, so the waiting game never really ends... :devil: But just wait and soon enough you will start getting these precious cards on the mail.

    Oh, I am sorry florida_guy07. I am just confused and I just want to gathered informations about this card because I will travel on next month and I just want to know if this card will be on my hand before i leaved US. But anyway, thankyou for your advise and info.

    I'm sure it will but if it is not, you know NOT to leave the US - unless you have a stamp on your passport.

  5. Not sure why people are saying that a passport isn't needed, that was the first thing the interviewer asked for. And isn't it in the interview letter that you must bring it?

    Mierda (!) - A passport is not required. Just because it was asked doesn't mean it is required. We've gone over that several times here on VJ and passport is definitely NOT required for the interview.

    I lost my passport way back in June and have been in limbo waiting for a replacement to be processed through my Consulate. I had hoped that I would get my new passport in time from my AOS interview in January 2008. I'd been told that the passport replacement process takes at least six months. But... no updates yet, and the paperwork did not go through up until a month ago. (I had to use the NY consulate form, not the LA one. Processing officer on vacation for a month, my photo background was not the proper shade of blue!! I need original documents from Malaysia but I still have not received them ...yadda yadda)

    Well, I was wondering whether anyone has gone through an AOS interview without a passport? What was your experience and did you have a hard time getting approved?

    I do have the following documentation:

    - US Driver's License

    - EAD card

    - I-94

    - SSN card

    - Marriage record

    Will these be enough to support my case even without a passport? Any advice would be hugely appreciated.

    anyway, passport is not required for aos interview.

  8. Hello everyone, Quick question: we sent form I-864 and my wife's co-sponsors I-864 with my her AOS packet. Do we need to take additional ones to the interview? I did not make a copy of her co-sponsors. He is visiting this week and if its required, I might as well ask him to fill out another when I see him so he doesnt have to send it later. We don't have an interview date but I'd rather have it ahead of time if its needed.

    It wouldn't hurt but it is not necessary. I had a change on my income and I had a new I-864 at the interview, I asked the officer if she wanted and she said: "NO!"

  9. im getting ready to send my fiance the 134. she need a copy of the 129 application package or does the embassy get the one i sent to vermont? im not sure if i should send her my origanal birth cirtificate or divorce decree. im thinking i should send notarized copies.

  10. First I woke up at 4:30 am sick as a dog and felt terrible the rest of the day. We had a 1 hour 30 min drive to Indianapolis. We arrived 30 minutes before my step-daugthers appointment at 9:15. The officer called for Lena and my wife Larisa at 9:05. I will say that our officer was very personable, friendly and kind.. The officer ask the basic question and examined our pictures and joint accounts, her answer was "YOUR APPROVED". :thumbs: In 2-3 weeks you should recieve your cards.

    We spent the rest of the day in downtown Indianapolis. I slept maybe 2 hours while Larisa and Lena where in the mall..

    Congratulations... it sucks to be so happy and so tired at the sametime. The more you try to cheer up the more you feel like screaming: "WHERE IS MY BED !!!!!!!!!!!!!!!!!!!"

    But anyway, I'd say it is a good day for you. Congrats again.

    Trust me :unsure: I refrain from calling people names, but this person deserves and I know that's besides the point but I couldn't help it, I knew it was wrong but I couldnt help it. Some people need to realize that this isn't a game... we are not playing who wants to be a millionarie USCIS edition - our advices are much more than advices... they can make someone's life easier or they can make it much harder.

  12. UNREAL, a diocese(probably the Catholic Church) told you to do this! As stated above this is blatant visa fraud, because you "intend" to get married on a tourist visa which your finance will take an oath and be asked a question by USA officials if she intends to come to the USA and immigrate or not on this tourist visa, which if she says no and then does so later on, guess what visa fraud. I am totally shocked at the number of people on this website that abuse the USA immigration law and flagrantly and arrogantly try this or give you such advice. What needs to happen to shut down this supposedly legal loophole is for anyone filing for a GreenCard after marrying on a tourist visa or work visa, that did not apply for a K1 or K3 needs to pay $10,000 to apply for AOS green card since they cannot follow the law, maybe the USCIS knew what they were doing when they raised these fees in July 30, I am getting my eyes opened more and more and more to the outright dishonesty and abuse this great country experiences with it's immigration rules even for those of us that can do it legally and choose not to or get advice from others not to, and from a diocese, just unbelievable. That diocese needs it's tax exempt status yanked, then I bet they would not be giving out that advice or trying to shelter so many would be immigrants or helping them game or ripoff the US laws. I am disgusted at this. Get a k1 or k3 that is what they are for, marriage visa.

    I think you will need one on your interview since you cannot follow USCIS interview instructions for proper documentation of tax returns, hope you calm down and stop spazzing.

    While marrying in the US after entering the country with a tourist visa and the intent to get married is fraudulent, please not that everybody's situation is different and that the situation of people with a work visa is unique.

  13. Just received our Appointment Letter which is as follows:

    The front of the letter lists the office location, date/hour, who to ask for (District Adjudications Officer), Reason for Appointment (Application for Adjustment of Status) - this interview may be video taped. Also noted to bring with you: PETITIONER MUST BE PRESENT AT THE INTERVIEW and Bring documents listed on the reverse of the letter. If you do not speak English, bring a translator. WARNING: If you are missing some of the documentation requested on the reverse of this letter, your case cannot be completed and it may require an additional, interview.

    Back of Appointment Letter:

    REQUIRED DOCUMENTS FOR YOUR FUTURE INTERVIEW

    Bring all ORIGINAL documents (or a certified copy) PLUS one photocopy for the Immigration Service. You must also provide a certified English translation for ALL foreign language documents. The translator must certify that he/she is fluent in both languages and that the translations are accurate. Bring your ORIGINAL documents, even if you have already submitted copies for review by the interviewing officer.

    Any notices and forms given to you by the Immigration Service, including advance parole, other travel documents and employment authorization cards must be submitted at the time of the interview.

    ALSO BRING:- your appointment letter

    - ALL Passports, including expired passports, Form I-94 (arrival and departure record), photo identification (i.e. state driver's license, state identification card, military identifications)

    -Proof of petitioners lawful permanent resident status (greencard) or US citizenship

    - Birth certificate for beneficiary.

    - Marriage certificate (if applicable)

    - Proof of termination of ALL prior marriages of petitioner and beneficiary (if applicable)

    Form I-693 with attachment, medical examination, completed by a Service approved physician and submitted in a sealed envelope (unless submitted at time of filing).

    - Form I-864, Affidavit of Support, with supporting documentation (see below)

    - Certified court documents, including arrest report, complaint and final disposition for any and all arrests, including any that may have been sealed or expunged.

    EVIDENCE REQUIRED WITH AFFIDAVIT OF SUPPORT

    If the petitioner does not meet the poverty guidelines, you must submit an I-864 from a co-sponsor

    - completed, signed and notarized.

    - Federal Income Tax returns and @-2 forms (or a recent IRS printout) for the last three years, Form 1099 and business license (Original plus photocopies).

    Paycheck stubs, at least last three issued.

    Original letter of employment for sponsor(s)

    Proof of sponsor's lawful permanent resident status (greencard) or US citizenship.

    Proof of sponsor's residence in the United States for the last six months.

    Additional documentation which may be required- evidence of a bona fide marriage - submit any document which would assist in establishing the validity of your marriage such as (but not limited to) lease agreements, home ownership documents, joint bank accounts, proof of joint ownership of other property such as investments

    -Birth certificates for your children.

    PLEASE NOTE: you may be required to file a Waiver of Inadmissibility Grounds Form I-601 if you have been in the United States illegally for over 6 months BEFORE filing your application for adjustment of status and have traveled outside of the United States.

    This is a general list. Each case is unique. Interviewing officer may request additional documents.

    so i'm putting together the affidavit of support and it says on the paper to check:

    X "I have filed a Federal tax return for each of the three most recent tax years. I have attached the required photocopy or transcript of my Federal tax return for only themost recent tax year."

    I can attach the photocopy of my most recent tax return... but I have NOT filed for all three years. I filed 2004 and 2006, but not 2005. Can I still check that section? Is there anything extra I should do? Like attach a letter explaining why I didn't file (I spent the year traveling, and not working) Do I need to wait to file AOS? HELP!

    Here is the truth on this, it says optional, which is keyword here and many on here will argue that you do not have to send or bring more than one year's worth of tax transcripts or returns or supporting W2s and 1099s, USCIS says that on the form but reality is they expect all three years worth of most recent tax returns, and I am sure you are going to have others post on here I am not right it says optional and all this about misinformation, but think about it why do you think the USCIS go ahead in line below the most recent tax return check box and say optional for next two years worth. Later on they will ask for it more than likely later to prove you are stable and able to provide above poverty income to support beneficiary and not become a government charge. I think you are right in doing what you suggest, attach a letter or note explaining what you have available and why you were not required to file in 2005. Also helpful tip, send in photocopies or bring them with you of any 1099, W2s for most recent tax return and any supporting schedules, for they do look at those also. Good luck.

    It is not about knowing more or less than others. First of all, you are dealing with SERIOUS stuff here on this board, we are not playing to see who knows more or less, our advice can RUIN someone's AOS, therefore we need to be extra careful when giving advice. This isn't about what you THINK is required or not, it is about what the USCIS thinks is required, they play the music and we dance along and they do NOT (nowhere have they indicated otherwise) require you to bring tax returns from your last 3 years, they may ask for it, but they don't require you to have it. I mean, they can ask for anything, really.

    Also, your attitude is what is frustrating people around here, first the HIV thread where you were extremely mean, then others and now this one where you feel like you hold the truth, even though you don't know what you are talking about. Just remember, our advice can ruin someone's life, so take it serious and if you want to answer questions here, do a lot of research. 99% of the people here aren't attorneys, we knew nothing at some point, we know what we know by experience and by researching.

    Why are you hising what visa you are adjusting from ? Noone here works for the USCIS and it doesnt really matter but it helps us determine better if you are going to get transferred to CSC.

  18. As the interview date approaches, we have 95% of everything in our accordion folder ready to go. The last thing we do not have however are the last 3 years taxes for my wife and my co-sponsor (my mother in law). We have last years though photocopied.

    Is this an absolute requirement to have? Getting transcripts can take time and I am worried like last time it could take a month+ before we finally get them and maybe something goes haywire and we don't at all.

    Feedback, opinions?

    They ask for and expect three years worth, it was in the directions, now we get to find out if you can get by without following their rules, interesting.

    OH MY GOD... you are the king or queen of ASSUMING things and speaking about something so surely even though you have no idea what you are talking about. All the posts I see from you are full of "know-it-all" attitude...

    Show us where on the I-864 it says that 3 years are required. You won't find it, you know why ? Because it is not required. The last year is required and the previous 2 are optional.

    You might want to considered doing some research before posting here, because you are looking like a fool.

    No I just follow the directions and rules of USCIS forms, that is all, and honestly, think about it, if it is optional then why does USCIS ask for or offer it optionally? They expect it or they would not have even give it as option, they would just say one year worth, and that is fine go ahead do what you think is best for you by all means hope it works it will be interesting to see. Thus show me where it says you do not have to send in those returns, it is a poorly worded form with directions on that I864 that confuses a lot of people, and a lot of people have gotten RFE over this optional check box and then asked or directed later to resubmit all three years worth. But like I say go for it, try it, will be interesting to see what happens, maybe they have changed their minds now, who knows. Best of luck.

    This is STRAIGHT from the I-864 instructions:

    "You must provide either an IRS transcript or a photocopy from your own records of your Federal individual income tax return for the most recent tax year. If you believe additional returns may help you to establish your ability to maintain sufficient income, you may submit transcripts or photocopies of your Federal individual income tax returns for the threemost recent years."

    and question number 25 says:

    "_____(Optional) I have attached photocopies or transcripts of my Federal tax returns for mysecond and third most recent tax years."
