So almost done with the paperwork part and going through the process of obtaining the required documentation for my Spouse’s adjustment of status.
she was an aupair from August 2016 until April 2018 on a J-1 visa.
since then she has always traveled and visited on her B2 tourist visa.
we are now married and I got to this question on the I-485:
”13. Documentation Regarding J-1 or J-2 Exchange Visitor Status
If you previously held or currently hold J-1 (principal) or J-2 (dependent) nonimmigrant exchange visitor status, you must submit copies of all relevant Forms IAP-66 and/or Forms DS-2019, Certificate of Eligibility for Exchange Visitor (J-1) Status, ever issued to you (if available). You must also submit copies of all available J-1 or J-2 nonimmigrant visas issued to you, and copies of all available Form I-94 and passport pages with entry stamps showing your admission to the United States in J-1 or J-2 status.”I imagine this applies to us unless it is in reference to someone who overstayed their J1 as “previously having”. The old visa itself and passport Pages she still has back in her home country. However the sponsor would have the IAP-66 and the DA-2019. If it’s the host family I imagine it’s gone, or is it something the Au Pair Conpany would have? Or can I obtain it from the USCIS?
Anyone been through a similar situation or have any insight?

Did anyone hear back about this? I checked off “Yes, I am enrolled” because my wife is on my health insurance.

In order to be considered “fluent” do you need to have passed the TOEFL if English is the second language?

My beneficiary wife's documents are in a foreign language. We have to submit a copy of her diploma and transcript with the I-944. Since it's in a foreign language it seems like we need it translated to English. Can we use Google Translate? Or can she do the translation herself?

Research Concurrent filing. My husband and I did the same thing. I filed for 130,130A, 131,485,765,944 and 864ez. I made errors on the I 944 so got a rejection notice. refiled everything this past week. The i 944 is a pain in the butt. Refer to the USCIS website for all updated forms and instruction. Also the people on here might be your biggest resource. Good luck with everything
Did you send them all together in one package to:

My spouse was not living here at all in 2019. She most recently came here in 2020, and since that arrival we married. For household income, do I list her name and check NO for filing a tax return or do I just list my name (since I did). The question is confusing because it wants to list all household members in Part 2, but the checkbox for each person encompasses the entire household. This is Question 1A + 1B for Part 3 on the I-944.
Also for assets, if I have 5 brokerage accounts, 1 checking account, 2 savings account; do a list all accounts separately or just 3 items... BROKERAGES, CHECKING, SAVINGS. It also looks like Assets are for both of us, and debt would just be her debts.

Spouse was formerly an au pair (2 years before we got married), do we list this as a “job” on her work history even though it is an exchange program?

I 130 does ask for state under address for USC , the petitioner
this form is also used when a person marries outside the US , so there would not be a state for the address of beneficary as that would be a foreign countray with no state so it asks for providence
question 12 a is US address and goes after that to formal address # 14 (need all for last 5 years so add a paper if more than these 2
I’ve noticed City of birth does not ever ask for a state or province. Just City and Country
-
A lot of times the form asks for City and Country but not state. I have been putting Springfield,MA for city ... should I not be doing this?
also on page 5 question 11... for beneficiary’s current address, it’s here in the USA. Question 12 is same. Is physical address outside the US blank or the address she lived at before
Coming here?

Thanks for the help everyone.
also does anyone know if I am allowed to add her to my company’s health insurance while the paperwork is processing? Or do I have to wait until she receives her residency card.

If you don’t mind me asking... what kind of errors?
Also for places where it asks for her current address, i would put our US address and not her Mexico address?

What is your plan? Is she going back home and you do consular processing or does she wants to stay here and adjust status?
She wants to stay here and adjust status.

My girlfriend came to visit me on a tourist visa; I popped the question and since then we have gotten married. Do I need to file the I-130 or the I-485 if she is still in the United States?
thanks!

Yes........but,as always, it is up to the visitor to convince the CBP Officer of intent to return to his/her country at the end of the short visit.
Is there a certain limit on the amount of time they can stay (even if the tourist visa allows for more)?

Every couple has their own priorities, and each couple must decide which visa is better for their situation.
K-1
Slightly faster arrival in the US (currently about 3 months sooner)
More expensive than CR-1
Requires Adjustment of Status after marriage (expensive and requires a lot of paperwork)
Spouse can not leave the US until she/he receives approved Advance Parole (approx 5-6 months)
Spouse can not work until she/he receives EAD (approx 5-6 months)
Some people have had problems with driver licenses, Social Security cards, leases, bank account during this period
Spouse will not receive Green Card for many months after Adjustment of Status is filed.CR-1
Slightly slower arrival in the US (currently about 3 months later)Less expensive than K-1
No Adjustment of Status(I-485, I-131, I-765) required.
Spouse can immediately travel outside the US
Spouse is authorized to work immediately upon arrival.
Spouse receives Social Security Card and Green Card within 2 or 3 weeks after entering the US
Opening a bank account, getting a driver's license, etc. are very easily accomplished with GC, SS card, and passport.Spouse has legal permanent Resident status IMMEDIATELY upon entry to US.
While the visas are processing, is the non-US citizen allowed to visit the US on their tourist visa (or at all in general)?

I have the I-130, I-130a, I-485, I-864, I-944, I-765, I-131, and g-1445.
can I send them all in one giant envelope/package? I currently have each form in a different folder with its supporting documents (6 folders total). Can I mail the physical folders like that in one envelope or just combine everything into one envelope without folders ? I am using many paper clips within a folder to separate certain supporting evidence from one another and from the form itself. Thoughts?
