Luis H Y viviana. Siento mucha tristeza al conocer la injusticia que una c'onsul cometi'o con ustedes, pero su amor es grande y de una u otra forma hallar'an el camino para estar juntos. A m'i casi me pasa igual pues la c'onsul p ensaba que era un negocio por haber intentado antes obtener visa de turismo en 3 oportunidades y se pegaron de ah'i. Afortunadamente al final cedi'o.

Me pregunto Luis H. en qu'e fallaron tu hermana y novio para que ellos aseguren que es una falsedad. Estaba muy segura que no tendr'ian inconveniente por la visa previa que hab'ia obtenido Viviana y por que estabas aplicando nuevamente por la misma persona. Qued'e azul..... Estos errores que comenten los c'onsules algunas veces son los que duelen profundamente, como en tu caso. Dios lso bendiga y les abra puertas.

Natalia, tengo una pregunta ...A tus padres realmente les gustar'ia vivir aqu'i toda la vida ? Si tienen la visa de turismo, considero que es la mejor opci'on para viajar cuando se quiera y a la hora que se desee y si la han manejado bien mucho mejor. Es s'olo mi opini'on.

Hola Martesa, gracias por el apoyo brindado, al igual q tu me quede totalmente desmoralizado al escuchar la respuesta de la consul, a leguas se ve la injusticia cometida contra nosotros, pero al mismo tiempo la injusticia cometida contra mi hermana, sobre el caso de ellos, fue q ellos en realidad no cometieron errores, solo tal vez el poco tiempo de haberse conocido y el deseo de estar juntos, esto es solo una opinion, pero igualmente creo q todos los q nos enamoramos con personas lejos de nuestras residencias tenemos el mismo deseo de estar juntos lo mas pronto posible, y mi hermana hizo lo q tenia q hacer, viajo muchas veces a colombia a verse con su novio, tienen suficientes evidencias q su relacion es una relacion seria, y q nadie planeo eso, pero por discrimnaciones de la embajada ellos automaticamente asumieron q la relacion de mi hermana era un negocio , falsa, en ifn, durante la entrevista de ellos, siempre fueron atacados con la pregunta de como se conocieron, quien los presento, y les preguntaron mucho sobre viviana y yo, lo cual ellos contestaron lo mejor posible, imaginate q ellos contestaron lo q sabian, mas ellos no sabian detalles personales ymios o de viviana, porq somos dos relaciones separadas, cada uno se preocupa de la vida de sus parejas y solo se conversa de las familias cuando algo nuevo sucede, osea como siempre es en la vida de todos, lo normal, ahi con ellos y con la mia hubo injusticias, y ahora solo toca conseguir maneras de como resolver, tengo mucha fe y la seguridad q esto se va a solucionar , en q momento no se, osolo Dios lo sabe, y me atengo a EL, pensando en unas de las preguntas q le hicieron a mi hermana : una de ellas es q ella no sabia el nombre del mejor amigo de su novio, y tampoco sabia q el tenia hermanos por parte de padre, cosas q yo se debido a mi larga relacion con viviana, pero son cosas inocentes q pasan desapercibidos cuando te concentras en la persona amada, mas no entoda la familia, el hermano de viviana, no supo contestar el mporq viviana se habia regresado la primera vez, se puso nervioso, se le cerro el cerebro, pero bueno al final ya sabemos los resultasdos de ambas entrevistas, ahora es tranquilizarse , y pensar con mente fria para buscar soluciones.....

Cualquier detalle, estare posteando, por ahora agradesco el apoyo brindadom por todos, y seguire consejos, de asesorarme con personas expertas en el asunto, estoy seguro q se cometio una injusticia y es mas el uso del chantaje de parte de ellos hace q el procediemiento de parte de ellos hacia nosotros lo hace algo ilegal, asi veremos q sucede.

Hola Natalia, espero te encuentres bien, mira mas o menos entiendo tu caso, primeramente explicanos tu caso un poco mas, o tal vez yo personalmente no lo entienda bien, segun lo q he leido es q dices q tu hermana tuvo un caso de k1 con el cual ella llego a este pais, y q el novio era una persona amable, pero con el transcurso del tiempoel cambio debido a sus problemas sicologicos, y q al final ayudaste a tu hermana a alejarse de esta persona, corrijeme si estoy equivocado, ahora luego dices q ella conocio a otra persona y q estga o va a hacer sus nuevos tramites, por otro lado nos dices q tu estan haciendo los tramites para q tus padres puedan obtener la residencia, y q si en algo afectara esto al caso de tu hermana, bueno como me dijeron a mi , son dos casos diferentes, y porfa no pienses q porq a mi me paso lo q me paso a ti o a tu hermana le va a suceder algo parecido, recuerda q tu estas pidiendo legalmente a tus padres y tu hermana esta haciendo lo mismo por su lado, no creo q eso afecte en nada el caso de tu hermana, claro eso depende de como fue q sucedio todo, por eso te pido q nos expliques un poco mas, el saber de donde ella esta, aca en usa o en colombia, si ellla se llego a casar con su primer compromiso, o si solamente se alejo de el y se quedo aca, osea de eso depende el resultado, a tus padres no van a tener problemas el conseguir la residencia, pero el caso de tu hermana depende de como se desarrollo todo, aqui puedes encontrar persosnas q te puedan aconsejar adecuadamente, de mi parte pienso q los dos casos son diferentes , y q todo se debe resolver bien, si deseas puedes escriberme a mi correo y asi por lo menos brindarte apoyo, y si se puede aconsejarte de acuerdo a lo poco q se sobre estas cosas, solo recuerda q Dios esta de nuestro lado y q el dispone de nuestras vidas, es solo confiar en el y darles nuestras preocupaciones para q el nos guie.

Q alegria saber Daliaq tus documentos ya han sido enviados a Bogota, y q de paso ya llegaron, ahora solo toca esperar confirmacion de tu atajo y saber cuando es tu entrevista, q estoy seguro sera programada para Junio, ahora si q toca ponerse pilas con todas las cosas y prepararse bien para la entrevista.A pesar de q fueron 44 largos dias, ya esa espera termino y ahora es q viene lo bueno, asi q Dalia pregunta lo q desees......

Hi everyone

this is what my sister's boyfriend received at the embassy, a white piece of paper with a checkmark on this phrase: SECTION 212 (A)(5)(A) visa was denied due to no have presente enough relationship evidence, it also says that the petition will be sent back to United States iInmigration, and then a final decision will be made and sent to petitioner.

My sister is already back from Colombia, while she was there they did not allow her to talk to any supervisors or someone, all they told her was that visa was denied.

So I went and checked what that means and found out that those codes have to do with some kind of labor, and that confused me completely, that's the reason for me asking to clarify, before mysister goes ahead and marry him overthere, her plan is to ammry him in July, but that still does not assure her that he will get his visa or legal papers to come to the United Staes..

Julieth igualmente no te desesperes, trata de concentrarte en los documentos q debes llevar, asi como las evidencias necesarias (fotos, conversaciones, recibos, etc), no te preocupes q tu novio no este a tu lado el dia de la entrevista, pero tu misma has visto q muchas muchachas han ido solas y les han otorgado la visa, asi q no te desesperes, piensa muy bien en todo lo q tenga q decir, recuerda las fechas, y lomas importante con mucha FE EN DIOS, q es EL quien te sostendra de la mano en ese momento.

Para todos los demas, mucha tranquilidad, Pequita se que aunnada con tu NOA2, pero lo unicoq te puedo decir es eso llega , se demora, pero llega, asi q tranquila amiga, para ti Dalia, ya falta poco para salir de NVC, llevas 41 dias o algo asi, eso significa q se acerca la fecha de q envien tus documentos a bogota, asi igualmente tranquila q DIOS ESTA EN CONTROL,

Hola amigos saludos a todos, para ti LUISH no te preocupes que confiando en Dios todo te sale bien, lo importante es ir muy preparados y seguros. Creo que a pesar de la familiaridad entre ustedes, tu caso es diferente y hay algunas reglas que en el caso de tu hermana aplicaban, pero en el tuyo no. Cada petición es analizada de manera particular, recuerda que los procesos son individuales y no en grupo. Tienes que mostrar tu seguridad ante el consul que los entreviste, y hacerle entender que tu no eres responsable por los actos de tu hermana. Aunque también me da tristeza ver que ella ama a su novio y lo que les falto fue un poco más de seguridad, e información. Dios te bendiga y animo que el amor verdadero está defendido por la justicia divina, y pasa por encima de criterios humanos.

MONOKOKE, con el respeto que me mereces, asi como todos los miembros de este foro me parece que afirmar que la mayoria de casos que se presentan en la embajada, son negocios o fraudes es un poco apresurado e irresponsable. A menos de que tu conozcas las estadisticas de la embajada es imposible saber eso y más aún juzgar a todas las personas de esta manera. Yo creo que este es un medio creado para darnos animo, información y apoyo entre todos y no para decir a veces cosas de manera apresurada.

Todas las personas que desde el inicio posteamos en este foro, estamos buscando la manera de realizar nuestros sueños pero de "AMOR" por lo tanto si se toma esto como una evidencia en la embajada, somos un ejemplo de pequeña mayoria en honestidad y transparencia.

There is one VJ member who is very active on the Thailand threads (daboyz, you have probably seen his posts here and there on VJ). He recently did a CR1 visa for his wife in Thailand. At her interview (this was in March, I think) the CO pulled up financial information about Scott (daboyz) that was not part of his normal Affidavit of Support filing. He filed I-864 (not I-134) since it was a CR1 filing. He had included tax returns, paystubs, etc. But they confronted his wife with the fact that he had a previous IRS lien for which he had worked out a payment plan with the IRS. They were challenging whether he really was over the poverty thresholds due to that lien. In the end he was able to satisfy them, and get the visa. His wife is now with him in Dallas - happy ending to the story.

Note that Scott did not have an AP@NVC situation. What happened apparently was that BKK Embassy was able to dig deeper into his financial background and did not merely accept the paperwork he submitted for his Affidavit of Support.

It's entirely possible that this is what happened to your sister too. It may not have been NVC that pulled this info, it may have been the Consulate.

After all, they do have her social security number and DOB, that's all they need to run a credit report. Takes 2 minutes to run one against Equifax, etc.

If she has a bad credit history I can see that this may raise eyebrows.

Good luck - I hope she can resolve her situation. Is she a member on VJ? If not, perhaps she should consider getting some specific advice here on how to proceed. There are people here like pushbrk that may be able to help her.

Also, no matter how hard I try, I can't wrap my head around this. For the life of me, I can't imagine any CO asking this type of a question, under any circumstances. My whatever common sense says that this particular question was added to the whole story either by your sister, or you, for.. a shocking purpose.

I disagree. This is not uncommon at all if the interview doubts the validity of a relationship. They can and will ask all kinds of intimate details to assure you are telling the truth. Typically the husband and wife are put in separate rooms and asked the same questions. Then the answers are compared. This was in the movie 'Green Card' and is a real phenomenon.

However if your relationship is legit no matter how personal the questions may be you should be able to answer them.

Yes my sister's petition spent 50 days stuck on AP at NVC. ( my petition was stuck for 35 days, and 30 the first time I filed in2007)

As you well know there are two types odf set questions for visas K-1 , and K-3 or marriage visa, my sister and her fiance were asked the second one,eventhough they are not married, the reason to this I assume is to what you say about relatives knowing other thru family references, and my sister going out with my brother in is one reason, second reason is age difference. Now a little info about my sister, she was married twice before, but was divorced a long time ago, and of course it would raise a red flag the fact that they met last yr, fell in love and then filled the petitions, my sister's last divorce was around 1990, and since them she is been involved in other relationships, but nothing that ended upin a marriage, the fact that there is distance between them, is the reason to had filled the petition.

Now about the questioning, yes they were asked questions about initmacy, when they had thier first encounter, when theyhad their last, what kind of underwear they both use, if there is any scars, or beauty marks intheir bodies, and if there is any partuclar one in a private area. About jail, too, if she had been in jailed before, this question was asked becuase of the existence of another woman name the same as her, (that woman was my first wife),also she was asked questions about both of her ex husbands, their criminal history, at the same time her boyfriend was asked about this and he knew about it. Al of this had to come out of the AP at NVC, since my sister did not about her ex husbands problems with the law, but had no idea about my first esx wife, (even me had noidea about this). Also her financial status was questioned, you all know that you don't say anything about your financial situation on any of the documents that are needed for the petition, and at the interview they knew about this, mysister and her fiance were prepared to answer all the questions since their relationship is a real one, this couple is one that tell each other verything about thier lives, hide nothing , they really know each other a lot, but me personally never expected the visa to be denied.

Hopefully this can help clarify certains things, but again my purpose of telling all of this is not to scare anyone stuck at AP / NVC, but prepared for questioning in case they feel is necessary.

This is for future refrence in case someone goes thru something similar.

I just wanted to add a cautionary note following Luish and wasabi's posts today.

NONE of us are inside NVC and able to assess what they're doing, or why.

Everyone of us here on VJ is just speculating on what AP means at the NVC. Who gets chosen. Why. What checks are done.

It's possible that some red flags are setting them off. And it's possible that they do an intense search through each of our personal histories and backgrounds, as Luish suggests. I really don't know.

I just think that before postings like that cause new people caught in this situation to panic and be overly concerned, we really just don't know.

On the contrary - much of the (anecdotal) evidence from those who have been through AP@NVC and gone on to have their interviews and get their visas (cdneh, Lisa, Badgerella, Luckie-Kookie, others....) is that once you're out of AP the consulate process is pretty much standard and no different than it would have been if the file had sailed right through NVC.

Yes it's right what uscandual says about what exactly goes on at NVC, the reason for my post is to help you guys understand a little bit, and to be prepared just in case, you never know is something form your past when you were young is gonna pop up, but is better for your love to know about it... this way in case that person is askede about it, again at the end many people go to their interview with no problems at all, but in my sister case she was denied...

WOW Luish, Im sorry about your sister's situation. She should try to get them to hold the application there and demand another interview ASAP. As long as they havent yet sent the petiton back to the US with intent to deny, she may be able to interview again with a supervisor.

I do think the relation between you guys and your visa process might have alot to do with it. Thats just my feeling.

I think they generally look down upon immi relatives introducing their relatives to USC's. Did I say that right? Anyway, I have read that in many many places and unless its custom there(like an arranged marriage) it's suspect.
