    Is there anybody who been waiting for I-130 approval since sep 2006, I am pakistani national studying in UK and my wife she is USC, last year in july we went to pakistan to get married and then i came back to UK my wife she did file I130 and I129F bt we r still waiting for approval, can anybody tell me how long it will take and do i have to go to pakistan to get my I130 or I129f visa????? thankssssssssssss for ur help

    I think that he meant to write 2007 instead of 2006 for the dates of I129F.

In my exhaustive study of this forum, things can get a bit askewed...especially late-nite, but I thought I read somewhere that if a person has filed both the 129f and 130, and got an interview for the 129 (being the faster), they could contact the embassy and ask that the interview be changed to target the CR1.

    Anyone know if this is standard...or did that particular poster just get very lucky?

    You're correct, in theory but it's not that simple. Before the new policy instituted last fall, the CR1 and K3 would both run along at their own speed. As long as you kept spurring the CR1 through NVC, there was a possibility the CR1 paper file would arrive at the Embassy or Consulate before an already scheduled K3 interview had taken place. If so, the interview could be for CR1. It is still theoretically true that if the CR1 catches up in that way the same could happen. The problem is that the new policy makes the CR1 petition lay down for a Rip Van Winkle nap unless you file another form insisting it continue to move, pay the associated fee and wait nobody seems to have a clue how long before it actually starts moving again. This makes the chances move closer to none than the former slim.

    I just received the approval notice for I-130. It says that my petition has been sent to the National Visa Center. So does this mean that I do not have to worry about I-129 slowing down the process? And secondly, I have heard that I-129 goes through National Visa Center much faster than I-130. Is this true? And what is the typical amount of time that the I130 sits at NVC. Thanks in advance.

    First, I suspect your NOA2 for the I-130 is just a form letter that hasn't been changed and that your petition is NOT going to NVC. Anyway, you can call NVC in a couple weeks to verify it. Even when your I-130 is at NVC, it just doesn't sit there. There is interaction with you and the beneficiary over a period around six months. There are shortcuts you can follow to speed up the steps of the NVC portion of the CR1 process. In any event, your I-129F is not going to slow down the process at this point. The fact that you filed it is supposed to mean your I-130 gets held at the service center.

    pushbrk, thank you for the information. I just have one other question. The transfer notice for my I129F says that the USCIS has transfered the case to the CSC "in order to speed up processing". Is this the standard for every transfer notice? The NBC also transfered my I-129F the same day my I130 was approved. Do you think that they are going to approve my I129F faster since my I130 is approved already. Thank you very much.

Since last fall some time USCIS has begun the practice of holding approved I-130s when an I-129F is filed for the K-3 they make the assumption that the petitioner and beneficiary will use the K-3 and adjust status in the USA and hold the CR-1 petition. You may have to file I-824 to get them to send the approved I-130 on to NVC.

    I wouldn't rock the boat. There is not enough information to conclude your I-130 will continue to process, if all you do is withdraw the I-129F. This is uncharted territory since the change last fall. You could shoot yourself in the foot. I would suggest the first step of determining whether your I-130 is being held at the service center or has moved on to the NVC for continued processing. It it has moved on, there is absolutely no need to do anything about the K3. It can't hurt you. If the I-130 is being held at the service center, you're in that uncharted territory.

    Thanks for the information. I have a feeling that my I130 is going to be held at CSC until my I129 is approved. The reason is that my I129 was transfered to CSC the same day my I130 was approved. It maybe that my I129 will move faster since my I130 has been approved. I am not going to do anything right now. I think that I should just wait and see what happens in the near future.

  5. I have recently sent documents through DHL to India and their service is fast and reliable. It cost me around $55 but I think it was worth the money. I have also sent documents thorough USPS and they have always been delivered but they take about 2 weeks. And I am talking about regular airmail which costs about $3. On the other hand, DHL takes about 3 days and I am able to track the progress on website. So it is up to you. DHL is expensive but extremely fast and reliable.

  6. I have recently read many posts where people are complaining about the fact they haven't received there NOA1 for I-130. This is a crucial notice since it is required to file for I-129F. I myself sent in my I-130 in the beginning of February and it was received on February 07, 2007. I have called USCIS about four times and have receive four different answer. First, I was told that the notice was sent on February 08, 2007 and it is probably at my post office since the post office doesn't deliver government mail if I don't have my last name on my mail box. Second time, I was told that it should have been received and I was made to feel like it was my fault. I called couple days ago and I was told that it is still within processing time and I should receive my notice soon. I think that this is all BS on the part of USCIS. I always receive my mail even when it is from other countries. How many other people are having this problem with USCIS not sending receipt notices and then making it seem like it is our fault for them not sending the notice? I am very frustrated at USCIS. The process is already very long and stressfull. It seems that they are doing everything possible to make it even more long and stressfull.

  7. I contacted USCIS today and told them that I haven't received the notice. First they told me that I don't need one since I have the receipt number. Then I told them that I need the copy of the receipt in order to file I-129 F. Then they told me that they would "try to send me another one" and even if did come, it would take more than a month. It has been over a month since I filed I-130 and it more than a month to get the receipt, I think that I am going to just forget about K3 and go with I-130 visa. Has anyone filed I-130 for India recently and could tell me how long it took them to finish the process? Thanks in advance

  8. I also believe that USCIS never sent me the NOA1. I always recieve my mail so it is impossible that it was lost in the mailing process. I was able to get the case status search from the USCIS website by my receipt number and it shows that my application was received on Feb 7. I wond if I can print this case status and send this in with my I-129. Also i send in my I-130 to Nebraska Service Center since that is the one I was suppose to send it to. But my case status shows that it is at California Service Center. Anyway, this is a very complicated and stressful process. Thanks for the help.

  9. I got married in India on January 15, 2007 and had to come back to U.S. on January 24, 2007 because of my work. I hired a lawyer and he told me to file for the K3 visa. I sent in the I-130 in the beginning of February but never received a receipt from USCIS. The check that I sent them was cashed few days after I sent in the I-130. My lawyer told me to look at the back of the cancelled check to get the receipt number. I was able to get the receipt number from the back of the check and I confirmed with USCIS that my I-130 was received by them on February 7, 2007. I asked why I never received the receipt and USCIS told me that I need to check with my mail carrier. I figured that was useless and since I have the receipt number, I don't need the notice itself. Now it has been over a month and I realize from this website that I also need to file the I-129F right after I file I-130. This makes me angry for many reasons. I paid my lawyer over 600 dollars and he haven't even contacted me even one to tell me that I need to file I-129F. :angry: I also found out that I need to have the proof that I filed I-130. I have the receipt number but I do not have the notice itself so I don't know what can I do. Can anybody give me any suggestions?
