  1. Proof that you are married??? did you not submit a marriage certificate... sometimes I am a little slow.. But to me that is what it is sounding like wha they need.. I would definitely send in affidavites from family and friends that have witnessed your wedding and seen yall as a happy married couple. As far as other evidence, If you have bank account info and tax return info.. I agree with the others... DL with same address and the like... I would just like to know If you sent in a marriage certificate or not.... and then maybe we could help you better

    I submitted the copy of my marriage certificate when I filed I130 after I got married. My wife also showed the original marriage certificate when she had her interview.

  2. Thank you all for the excellent advice. Initially, I sent them online printouts of our two joint bank accounts and copies of the joint tax returns that we filed last year. I also sent them a copy of the iterinary of our trip to India this summer. I am in the process of gathering all the evidence that shows that we are married. I can send copies of our driver licenses, our car insurance policies, school records that show same address. I am also adding my wife's name to the cell phone plan since we have a family plan. I was thinking about getting affadavits from my parents but they are outside of the country right now and this makes a little bit difficult. I only have until December 17 to submit all the evidence. . I would appreciate if I can get some suggestions on other types of evidence.

  3. I filed I-751 for my wife on September 14. She had her biometrics taken on October 19. When I submitted the I-751, I submitted evidence of our marriage such as joint tax returns and statements of two bank accounts that we have jointly. We both work part-time and did file joint income tax returns last year.

    Today, I received I-751 Request for Evidence that asks for evidence by December 17 or the claim will be denied. I don't really have any other evidence besides the one that I submitted initially. We do have a lot of pictures but I don't know how much credibilty is given to pictures. We don't really have any property that we own or lease together. We do not have a great deal of evidence since we are both full time students and live with my parents. We also don't have any children together. How typical is it to receive such a notice. Is it something to worry about?

    Thank you for your inquiry.

    If the passport has an observation made with surname and given name printed - then the visa will be printed in that way .She will not have FNU on the surname column.

    So now that they changed my wife's surname on the second page is that the "observation made".

    Yes if an observation is made, she should be fine. However, make sure that you tell the embassy people on the interview date that this observation has been made.

  5. Here are the different responses I received from different agencies in order.

    Called USCIS (Nov 9) - told me that I have to contact U.S. Customs and Border Protection.

    Called US. Customs and Border Protection:(Nov 9) Told me to contact local I-94 office.

    Called local I-94 office:(Nov 13): Told me that there is nothing they can do. They told me to contact the USCIS so that they can make this correction on the greencard.

    Called USCIS (Nov 14)- Told me to contact the State Department Visa Service since they can only issue greencard to the name as it is listed on visa.

    Called State Department Visa Service (Nov 14): Told me that they also can't do anything since they put the name on the visa exactly as it shows on passport. I asked the lady whether I can get my wife's passport fixed with her correct name and she said that they still wouldn't be able to correct the name since the visa has already been issued.

    This is really a nightmare. I wonder if my wife has no choice other than to go with the first name "FNU". I think that all of this effort is worthless and will waste a lot of time. Can anybody give some advice? Thanks in advance. :crying:

  6. My wife came on CR-1 visa on October 27. She did not have any problem entering the United States but there is a problem that I noticed after seeing her visa. Her visa has her first name listed as FNU (which stands for First Name Unknown) and her whole name(First and Last) in the Surname field. I think that the reason they did this is because on her Indian passport her whole name is listed in the given name section and the surname field is left blank. We went to the social security office and they told us that my wife's first name is FNU in their record and they cannot issue a number for a different name. On telling them the situation, they told me that they will issue her a card on the correct name which will be valid for a year but I will have to get it corrected to get a card after a year.

    I haven't been to the DMV but I guess the same thing will happen there. My wife hasn't received her green card yet but I am sure that it will also come with the first name as FNU. I was told to contact the USCIS by the social security office. I called them and they told me to contact U.S Customs and Border Inspection. I called them and they told me to contact the local I-94 office which I will contact tomorrow since it is only opened 3 days a week. My wife has no option other than to wait to fix this problem to go by the first name "FNU". I later found this information on American embassy in Delhi that they will issue visa with the name FNU if the first name and the last name are not listed separately. I contacted my lawyer and he said to wait until greencard arrives and they we can send an application to get this fixed. :help:

    Whew. This all started when the new passport was not inspected and corrected. You're on the right track but don't be surprised if you have to go all the way back to getting a new passport and corrected visa stamp before this is corrected for good.

    CBP and I-94 people can do a lot of things. My wife and daughter needed new I-94s because the dumbass agent stamped them with an entry date of August 39, 2006. He also didn't keep the sealed brown envelope like he was supposed to.

    Even so, they can't correct the name in a passport or on a visa.

    That's an interesting question. I suppose the answer is specific to CR or IR visas. Perhaps they don't get I-94's stapled to their passports because they are immediately permanent residents. In which case, I don't see the I-94 office (didn't know there was such a thing) being any help. In our case, the CBP supervisor in the POE closest to our home is the one who corrected things for us because the errors were CBP created.

    Once again I was thinking about it I prepared recently dated document such as employment letter & I864 but do i need to ask my co-sponser for recently dated I 864 and bank statement as well????

    My co-sponser feels that once submitting to NVC its not needed to prepare again..

    what abt i-134?i get mixed opinions for that as well.is it a must for cr-1 visa ?

    I134 is not required for CR-1 visa. It is only required for non-immigrant visas such as K3 or K-1.

    I have a very important question. I wanted to know that for K-3 who else can be a joint sponser besides parents/sis or bro/uncle or aunt. Can it be someone you just know as a very close friend, but not your relative? thanks

    As far as I know, the joint sponsor can be anybody as long as the person is in United States legally and meets the income requirements.

  12. Hey all, as per your advise I submitted some of the paper work. I went to the Nehru place VFS office in Delhi today to submit some docs.

    I submitted the following:

    -Photocopy of Passport

    -Photos

    -Birth Certificate (Original & 1 Copy)

    -Marriage Certificate (Original & 1 Copy)

    -Proof of Relationship (I submitted the wedding card and a couple of emails. I figured I will bring most of the evidence at the interview)

    -Police Report from Her Local Passport Office

    -DS156

    -Medical Report

    I did not have the following:

    -DS230 Part I & II

    -Local Area Police Report

    -DS156K

    -Affidavit of Support (I thought I would just submit this at the interview with up to date infomation)

    Here is the problem. Do I have to submit DS230? Because my packet 4 doesn't even list that as a requirement. I never had my wife get the Local Are Police Report, I didn't know we needed it. We did get the report from her local Passport office, I thought that was all which was needed. DS156k? We submitted DS156, what the heck is the one with the K, and what is the difference. Again Packet 4 only lists DS156 as a requirement and does not list DS156K.

    If your wife's passport was issued within the last six months, you only need to get the police certificate from the local passport office.

  13. When submitting documents to VFS prior to interview and during the interview does one need another (recently dated) items of petetioner

    -Affidavit Support I 864

    -Employment Letter

    -Bank Statement

    Or is it okay to submit the copies of documents that were previously submitted to NVC during which were prepared & dated by 3 months previously?

    I'm getting mix personal messages from friends & family members that Mumbai requires recently dated documents!

    I'm leaving to India prior to interview and in process of having all documents ready from my end, i'm a little confused thinking I'll get there and then a request of recently dated information might be needed....

    They might ask you for the updated employment letter and the bank statement. I sent my wife the updated employment letter but they didn't ask for the updated letter. I would send it just in case because it is better to have too many things than too little.

    from what i have read for cr1 we do have to pay courier fee in cash at our local vfs office when we submit the docs. 1 week or 10 days before the interview .......i dont know whether we need to pay anything besides this......would appreciate if seniors could help!!!

    The only fee that CR1/IR1 people need to pay in India is the medical fee and the courier fee at the VFS office 10 days before the interview. The other fees are paid in the United States to the NVC. And this is assuming that the petition was filed in the United States and it was not a Direct Consular Filing.

    Nebraska service centre is faster than california service centre. MY case has just been completed. we both have applied the same day i.e Feb 2.

    Thanks for all the support. Jigi, my I-130 petition was transfered from Nebraska Service Center to California Service Center few days after I filed it. So it seems that Nebraska is just a place to send the petition and the petition is actually processed at CSC. And one-way ticket prices are very expensive compared to the round trip prices. The same airline ticket which costs about $1200-1250 roundtrip is about $850-$900 for one way. I was searching for airline tickets in about 2 weeks and the cheapest I was able to find was over $800 for one way trip.

  16. My wife had her interview yesterday at Delhi embassy and the visa was approved. :dance: She was was only asked one question and that was whether I am using my parents as joint sponsors. She said that she was interviewed by a Caucasian man who spoke Hindi and an Indian man who spoke English (ironic). She was done with the interview by 10 A.M. The process was much easier than I ever thought it would be. I would like to thank all the Visa Journey members for their help in this long journey.

  17. guys my husband has to submit all the documents by this wednesday to vfs and I am not sure if my dhl will make it on time. Can he submit rest of the documents and take the I-134 with him to the visa interview or does he have to submit everything together. :wacko:

    The only thing that your husband is required to submit by Wednesday is the Rs. 365 Courier fee. He can submit any or all of the documents on the interview day. However, it is recommended that he submits as many documents as possible to avoid additional delays on the interview date.

    My case is complete... Just waiting to get the interview date. Will i get some letter from Embassy saying they have got my case.. which is callled Pack 4. When do i have to do my medical. How much will it cost. Has any one in here done their medical in recent past. Please help me guys... I am really nervous... in this last leg of the journey.

    If your case is completed today, it will take NVC about 5-6 days to forward the case to embassy. When the embassy receives your case, they will schedule the interview and send you Packet 4. When you receive the Packet 4, you take that with you to get the medical done. My wife's medical cost about Rs 3000 in Delhi. Right now, gather all the documents that are required for the interview

  19. You dont really need the letter from the Consulate to get Medical done as long as you got your interview date, just PRINT the PDF for it.

    As long as its in Appointments, you can get Medical done, PRINT the PDF, you can always get Local and Passport Police Clearence with out any appointment.

    This is my experience from I-130 I did for my parents, they didnt get interview letter, but had the date in Appointment section so they got medical and PC done.

    My wife got her medical done about 3 weeks ago in Delhi. She was informed by the doctor that she needs to get an appointment letter before she can get the medical done. She hadn't received the appointment letter from Delhi embassy so she had to go and get duplicate appointment letter to get the medical done.

  20. Hey all, I had a couple of questions. Here is my current situation:

    As of Oct 4th. NVC sent out the docs to the consulate/embassy. In your experience, how long does it take for the embassy to receive the paper work? What I want to do is go over to line 1 between 4-5pm to talk to them to see if they can do something for us because my wife is in her 7th month of pregnancy. When do you think they will receive the paper work? I have already sent an email to them. Should I call or just go to Line 1 everyday until they receive my paper work? Also I got the papers from the embassy itself which says Packet Four. I basically went to the embassy yesterday and spoke to someone and they hadn't received the paper work as of yet but they gave me this paper work for reference to go by. Should I use this and go get the medical done now? I have already gotten the Police Report done. Anything else I can do to expedite things.

    Any suggestions would be great and help me, my wife and our future baby. Thanks.

    I takes about a week for the embassy to receive the paper work. In order for you to get the medical done, you need to get the actual appointment letter which has your interview date. Another thing is that you need the police certificate from both the district police station and the regional passport office. You can start gathering the proof of relationship and the updated job verification letter.

    DCF -- you have to be outside the U.S.A

    Counselor Processing - its something you can request when filing i-130 .... how effective ?? i don't know ... form the post above i am understanding that its only for K-3

    I have never heard of such a thing. If you file in the United States, it first has to be processed by the USCIS and then NVC, in case of CR-1. It only processes at the consulate is if you do DCF.

    The OP's question does not relate to DCF in any way. These answers are ust confusing the point.

    Requesting Consular processing on an I-130 is something K3 filers do when they don't want their I-130 held for AOS. USCIS routinely holds I-130's when an I-129F for spouse has been approved. Successfully requesting Consular Processing does not circumvent USCIS processing, it just gets the petition forwarded to NVC and the Consulate so an immigrant visa can be the result instead of stateside status adjustment.

    If no I-129F is filed or contemplated, the I-130 will receive "Consular Processing" after USCIS approval, like any other "visa" process.

    I agree with what you say. I know that the original question does not relate to DCF. The OP seems to believe that there is a way in which one can file in the United States and then request it to be processed by Consulate rather than the USCIS. My response is that this is not possible. If one files in the United States, it must go through USCIS. There is no way that one can avoid USCIS and request for "consular processing" when filing in the United States.
