  1. Any uodate on your cases? My interview was May 9 and was given the form 221g due a mistake in my CENOMAR. Sent it with my passport ont the 16th. Case was under AP immigrant for three weeks and changed to AP non immigrant on June 10. It has been that way since then. Called USEM several times and the only thing they could say is to wait and nobody can explain what is going on.

    Second, is no knows why your file seems to go and return like a yo-yo. But, the action that you can take is to call weekly and get either a tier 2 or supervisor. They are the only ones who have any authority to look further into your file. Now, have said that, it doesn't mean you are going to get an answer or that you are going to get an answer that you want to hear. Be very civil and at best explain your frustration of not being able to get a clear answer of where your file is, when will it return to NVC and when will case number be assign so that the file can be sent to USEM.

     

    Third, we just happen to know your embassy is manila because you said so but if the page changed I wouldn't know where you are interviewing with what embassy. Many of our answers are predicated on the information you supply in your profile. When we look at the left column and can't determine your timeline OR your Embassy it's hard for us to give you a factual answer. If you look at the profile of others here, they have a flag for their country, so it makes it easy for us to reply as we can quickly determine your Embassy. Our answers will sometimes be tailored to a specific Embassy hence the reason for you to complete your profile.

     

    So, if you could help yourself out and complete your profile that sure would help us out when we want to reply to your question with factual information.

    Fourth there is a possibility that USCIS did not close out your file properly and NVC will catch those records and return them for USCIS to complete the adjudication process. They look for a red stamp (completion stamp) and the check that ALL three security questions were answered in the I-129f. If they weren't they are sent back.

    Our NVC case number was given to us November 24, around this time we filed for g884 to get some of our original documents back to be used for the Manila interview. So we thought the first return could be because of that. USCIS first requested our file back on December 11 and NVC sent it to them December 14. We called USCIS several times to ask for update until they told us they sent the file back to NVC on December 28. This is where the problem started. We called NVC several times in January and they have given us different dates on when they received the file back from USCIS. And lastly, end of January we were told USCIS is requesting it back again. We called USCIS and we were told they already approved us and its not gonna change, and also that they did not request our file back. We asked help from the office of the congressman and  NVC told them our file is "being prepared for a return to USCIS" two weeks later after they told us its been shipped back there already.

    If you higher a lawyer and they try and sue USCIS for a decision, 100% of the time they will close the case and send your lawyer a DENIED letter. I know this is frustrating and I have a little idea of your battle. But your case is being further adjudicated for some reason and NO ONE can tell you why and NO ONE is going to tell you why. You are in a tight spot but all you can do is wait.

     

    There have been other "stories" from VJ'rs that waited more than a year, some two years even a case that took 4 years. I wish I had better news for you. :thumbs:

    Thank you @Greenbaum. Appreciate your response. One more question, will it be okay to withdraw this case and get married, then file for marriage visa instead? Will that change anything somehow? I mean we dont mind waiting if it takes years but we dont know whether we should wait or NVC/USCIS is just letting our case die down. 

  5. I could not find any reference on the internet about our case. But neither USCIS and NVC is telling us what's going on. We filed April 2018, got approved on October 2018, got our case number Novemeber 2018 and then our case hasnt reached Manila upto this day. NVC sent the file back to USCIS in December for "administrative processing." USCIS signed off on it and sent it back to NVC in January and then now its being returned to USCIS again. This will be the 3rd time USCIS will have our case and nobody is explaining why. We contacted a congressman already but was told they can only make enquires every 60 days and not advocate our case. So it didnt do us anything. We are stuck in this situation. Can anybody help or recommend a high powered lawyer to help us out? Thanks a lot.
