  1. My fiance and step-son recently had their interview in Frankfurt. Everything was fine until they came to the topic of custody of her 10-year-old son. (Both my fiance and step-son have German passports although my step-son was born in London, England. My fiance and his father have been separated for almost 9 years.)

    Basically, the immigration officer said that she needed something proving that she has custody of her son otherwise the consulate would view it as "kidnapping her son to America" - they actually said that! The thing is under German law, if the father hasn't been around and the child lives continuously with the mother then custody is automatic. She knew this, but went to a legal assistant to check anyway. They told her the same thing.

    So she did two things to try to get this proof. First, she went to the court (I can't remember the exact name she gave) and asked them for some documentation of this, and their reply was that they couldn't give her proof of something that was already in effect. In other words, yes she had custody; no, they couldn't give her a document to show that. Next, she went to social services and asked for a similar document. They couldn't help her either because her son wasn't born in Germany.

    The only thing that she thinks she can use is a letter from her son's father stating that he's aware of their move to the United States and grants them permission to do so. This may be enough for the consulate, but I'm concerned that it may not be enough for the border officers.

    Does anyone have any ideas what could be done in this situation? I was proud to get this far without a lawyer but I'm feeling like I may have to do that to be safe... :huh:

    I am a mother who has just succeeded in getting my K3 and a K4 for my daughter.

    I was divorced before my child was born but just incase I had her father sign a letter stating that I was allowed to take her and reside in another country.

    The letter included the date, his full names and ID number (SSN), my full names nad my ID number and my daughters full names and her birth number.

    We got that witnessed and notarised. I wasn't even asked for anything like that but I supplied it anyway.

    Wow...I am impressed that from your NOA-1 date of March 28th to your interview date is slightly less than 6 months!! Of course, you are being processed through the VSC while many of us are being processed through CSC. I would be thrilled if Karina got an interview date in December. Our NOA-1 date on the I-130 is June 19th.

    Relax and enjoy the interview. From what I have heard...and read, it is best to "be yourself" and relax. The greater percentage of petitions are approved. So...best wishes on your interview. You will be just fine!!

    I bet she will have her papers sorted and processed in no time! It would be terrible not to spend christmas with your loved one! So lets be optimistic and hope for the best!!!

  3. everything you will be required to bring, will be listed in pack 3

    make sure you bring additional copies of everything

    every consul is different

    and every CO will adjudicate differently

    if you have all required documentation, you will do just fine

    I went to fetch the pack 3 myself and it states obtain the following doccuments for your interview which pertain to your case... The officer didn't tick anything and I cant get through to them so....

    But thank you for the advise!!!!

  4. Which Affidavit of Support is needed for the K3 interview?

    K3 needs I-134 form for each beneficiary, not the I-864.

    Are the I-130 and I-129F NOA2's requested at the interview?

    Nope. The embassy gets the approved I-129F (if you are going K3 all the way) from NVC. YOu don't need to bring a copy either, but you need to know (by heart) the info encoded by the USC spouse. The embassy interviewers will verify these.

    Do you need a copy of the full pack of paperwork sent in for the I-130 and I-129F for your K3 interview?

    No. Refer to the previous answer. All you will bring are the required documents in you Packet 3/4. Bring all original/certified copies except of ITR or tax transcripts ( a copy will do).

    I would just like to know the following:

  6. I was just called by the Consulate in Johannesburg South Africa to go and collect my package 3. Will be doing that tomorrow! Woo Hoo!!!!

    Finally things are happening!!!!!

    I have opted to carry on at my company until the End Sept so I wont be able to fly out until the 1st October! That is only 6 1/2 weeks away!!!

    And then my life changes forever! I have a wonderful Husband waiting for me and I cant wait to go HOME!!!

    I changed everyone's name to lowercase, so I could remove some duplicate records from my list.

    Also, I wanted to get back into the limelight, so I increased the number of NOA2s that are shown. I am now #18 on the NOA2 list.

  8. Go the k3 route, my wife was here for 4 months before the i-130 was approved. The visa is $100 for the k3, and the k4 child is free when traveling with the mother. Also you wont need another i-130 for the kid, and adjustment of status if different too, once here, k3 will be $1000, and k4 will be $600. Dont worry! Get the visa first, it will cover them both, then worry about AOS after they are here for a while. You can put off AOS until 90 days before the expiration of the visa, which is two years from the interview. GO K3!!!!!!!!!!!!!!!!!!!!!!

    My issue is that I want to work as soon as I get into the country. And what about driving? I need an SS and to get that the AOS has to be done..... Can I file EAD without AOS? I dont think so.... That is my issue...

    Yes I want to be with my husband more than anything but I also dont want to get there and with my daughter and become a burden. Yes my husband has ample income but I am an independant woman and cannot be unemployed otherwise I go nuts!!!

    If you arrive on a K3 visa it will be a minimum of 3 to 4 months before you can be authorized to work. On a CR1 visa, you are authorized to work upon arrival but won't have a Social Security number for a couple weeks. My wife filed EAD without AOS but now it is all included in the same fee. They can be issued separately but you are still looking at 3-4 months.

    Do you know if the states let you drive on an international drivers licence? I will be moving to Virginia.... I would probably need to contact their DMV....

    Do you know what the AOS is for my daughter? I tried looking at the fees structure but it is confusing cause where the fee is for me $1000 there it says children under 17 $0.....

    Wow, this is so full of errors, I would just delete it if I could. Shudder.

    Yodrak already made the corrections but I can't find anything that is correct above except perhaps that skinman569's wife was here 4 months before the I-130 was approved. You've confused so many different facts from so many different places that it is mind boggling.

    Well my I-130 and I-129 are already approved...

    My delemma is that if I want to go CR1 I need to wait for my childs I-130 (currently waiting on the RFE) to approve which was sent in the same time as mine in March.

    With the K3 I am scared I get there and cannot drive around until I get an SS which is what 3-6 months...... and the work is an issue for me I need to stay busy....

    Man this is such a decision to make! I dont want to get there and become a burden and put unneccessary pressure on my marriage because I have to wait to work but on the other hand I want to get there asap!... Oh man!!!!!

    Do you submit a whole new EAD for the K4 or do the fall under the K3 the entire time?

    - Is the Visa fee $100 each for the K3 and K4?

    Man this is really mind boggeling!!!!

    Can anyone say with an estimate how much longer the CR1 can be than the K3?

    My I-130 is sittting with the NVC and has been assigned a case number already.

    Dont know where my I-129 is as it is not yet at my embassy.

    I filled both I-130s at the same time in March and mine was approved on the 31 July whereas they sent a mail with an RFE for my daighters.

  13. i posted in k-3 this same topic i would like to know how much the iv bill and the aos bill is from nvc and any ideas how much the medical and delabros fees are thank you for the help would just like to know so i can keep the money in checking and not have to try to transfer and cause a days delay in sending back to nvc thank you

    Is the CR1/IR1 cheaper than the K3?

    Does anyone know what paperwork there is left to do once in the US on a CR1?

  14. If you enter on a K3 you will need to file for a Employment Authorization Document and SSN, it takes about 90 days to get the EAD and then once you have that you can apply for a SSN...

    If you enter on a CR1/IR1 then you can work from the day you enter the US but you will need a SSN and it will take about 2 - 4 weeks to get...

    Yes, I think you should call. What I mean is that some people dont update their timelines... so we have no idea. Perhaps i am just wishfully thinking I am not really # 25.

    And just when all hope is down I got my approval on email from CRIS for my I-130 today!!!!!!!

    I am still calling for the I-129 though

  17. Yep, right on, but let me add Business First, engaged people next, families LAST. Got to love the gov't's family values.
    The key word here is values. We as a nation are loosing the core values that made us what we are today. Just like the Roman empire we will fall under the weight of our own wealth and immorality. Bringing spouses or families together is LOW priority with our government. Business FIRST - Families LAST !!!!

    even before business... they value the holders of H1B and H1 visa. Just recently a family friend who is here on a H visa went back to India and got married to a girl from there. She was able to come with him within 2 months. USCIS explain that to meeee.......... :angry:

    So true... I have a couple of H1 friends/co-workers who went to India and practically came back WITH their wives in a couple of weeks after they got married there.. As I said I m really really happy for them... As a matter of fact I am real good friends with all of 'em and in reality its NOT their fault. I do understand that they do that since they CAN. My gripe is why CANT I, as a US Citizen, do/follow the same procedure so that my wife can also be here like theirs... I feel so sad, cheated and hurt over this matter... lets try to forget it.. I m not goin to ruin my day over something I DONT have control over... but Oh yes I M SO MAD :angry:
