  1. feyser,

i recently married my thai fiance who came here on a k1 fiance visa. she was granted a k1 fiance visa even though she never really aquired a 100% correct document (as far as i can tell). i didn't find out about this until just a few days ago. check out yesterday/today's posts on the aos forum.

anyway ... was your wife born in a hospital? if so, they should have it. if not i believe she must go to the amphur in her birth town. they should have a record of it. if not, your fiance will have to gather some witnesses together, take them to the local amphur, and they will make a birth certificate for you.

make sure they include the important information on it. hopefully, it will have the words birth certificate. the names of her mother and father. the date she was born.

    hope this helps you some.

i don't really have a full answer for you, but make sure you come to the states with a good original birth certificate and make sure you get it translated to english!!

make sure you read the english translation just to make sure that it has the proper info.

i'm currently ready to file for aos/ap/ead; but ran into this bc snafu two days ago. do not come to the states without it!!

  2. i'm assuming her bc has her parent's names and her dob? lol. make sure you read the english translation when you get it (if you haven't already done so). i never bothered because it never occurred to me (even with all my experience in thailand) to actually read it before we left for the states using her k1.

how did you get the bc from her uncle?

one more thing, my wife had her "bc" made in bangkok, ..... not her hometown (5 hours away). maybe that's why she got some ify document. do you know if the official bc has to come from her hometown? i'm now thinking that it does. what do you think?

thanks for all of you help. we're envious of ya'll being in thailand!! have a great time

  3. thanks john,

that's not a bad idea. she has her thai i.d. here. it has her d.o.b. and it's in english.

there are a few options we're considering and yours is now one of them.

i'm wondering about the timing of things, about consequenses, and hoping for some more help here.

i'm wondering if the aos documentation has to be accounted for before ap will be granted? i'm thinking it might be a possibility to send her back to thailand for another birth certificate before her aos interview?? yes? no?

i'm also wondering how long one has to fulfill a rfe?

and what happens if you aren't able to?

    thanks again for any thoughts.

  4. i got my answer. her "birth certificate", at best, is a very bad one. (it doesn't have her parent's names or her actual birth date on it like a normal birth certificate would have from thailand or anywhere else!!!)

however, the darn thing made it past the staff at the embassy in bangkok. i wish they would have caught it.

if i use the original incomplete birth certificate and i get an rfe about it., how long to i have to fix the problem??? if i don't fix the problem in the apropriate time ..... what are the consequences? lose the fee? are all requests denied (ap, ead, and aos) or only aos???? etc?

i hope someone can advise me here so that i know what i'll be risking.

    thanks

  5. My wife came here a few months ago on a k1 fiance visa. She’s from Thailand. She was not born in a hospital and had to have her birth certificate “made”. It’s a process where you take a few “witnesses” to a “county clerk’s office”, they swear to the facts of the birth, and the office then makes the certificate. We used this certificate at the k1 visa interview.

So … yesterday … I got around to reading the English copy for the first time. It says nothing about the date of her birth. It simply mentions her name, the year she was born, her id number, and the area of Thailand where she was born. The entire document is worded as if it’s simply trying to prove where she was born

Now … I’m wondering if this document will suffice for aos. It doesn’t have a birthdate at all. I’m all ready to send everything in for aos , but I don’t want to run into problems if the birth certificate is deemed to be incomplete.

I’m especially worried that the document will be accepted in the beginning and then possibly rejected at the interview. I don’t know how long it will take to have a more complete document “made” and sent here to the states.

Is there anybody out there in my wife’s situation regarding this type of birth certificate from Thailand?

Does your birth certificate have a date of birth???

I know it’s a funny question ….. but … if you have a thai wife you're probably not too suprised by it. ;-)

    Thanks for any responses

  6. amalia,

i was under the understanding that you do not need to file a i-130 if the child will follow to join within 12 months. the embassy told us that when we are ready, to simply send in the packet 3 materials to the embassy for her daughter to start the interview process.

i'm just wondering if my wife's application to adjust status would effect the above in any way. it sounds like it does not. what do you think?

    thanks for your reply

  7. hello,

my wife came to the states on a fiance visa back in july. we married 3 weeks ago (well within the 90 day window). we have plans to bring her daughter to the states in the very near future. we included her daughter in all of the paperwork for my now wife's k1 fiance visa. (checking the planning to follow box. etc.)

today, i heard that we cannot bring her daughter here on a k2 visa once we have started the adjustment of status process for my wife. is this true? should we get her daughter to the states first and then apply to adjust my wife's status (+ her daughter's)??

i hope this makes sense and that someone here can clarify the process.

    thanks,

  9. thanks for all of the responses.

this morning, while searching vj i ran across a few posts that seemed to indicate that you cannot start the process of bringing your fiance's children to the usa on a k2 once you've married, applied for aos, ead, and ap. etc. the posts were old and could be a little outdated. also, they not 100% clear in thier meaning. as you can tell by my questions. ;-) sorry.

is there anything i need to worry about regarding the timing of when we marry, when we apply for aos, ead, ap .... in conjuntion with keeping the ability to get her daughter over here on a k2? we want to be able to bring my fiance's daughter here on a k2 and not have to go down a different road.

    thanks,

  10. hello,

my fiance is here in the states on a finace visa. she's been here 3 weeks and we have not married yet. we plan to bring her daughter here in the very near future and have included her in all of the paperwork from the beginning. checking the planning to follow box. etc.

today, i heard that we cannot bring her daughter here on a k2 visa after we marry. is this true??

if this is true ... what do we have to do in order to bring her daughter here on a k2? (send in packet 3 to the embassy .... before we marry????)

i hope this makes sense and that someone here can clarify the process.

  11. hello,

i appreciate all of the sound advice given today. thanks so much.

    yodrak,

    section 2. results

the box vaccine history incomplete is checked.

the box applicant may be eligible for blanket waiver(s) because vaccinations not medically appropriate (as indicated above) is checked.

no other box is checked besides those two.

my fiance isn't home at the moment, but it looks like she was given a shot for Td, mr, mmr, and rubella. she already had the completed series for chicken pox. all of the other vaccines are checked not age appropriate. it looks like each of the mentioned vaccines were given on the date of the exam and the column labled insufficient time interval is checked next to each of these vaccinations. i assume she needs to complete them, but i didn't know if she needs shots beyond these once she enters the u.s.a.

my plan, as it stands now, is to have her complete the series of shots because the other posters have advized me that it will be necessary. is this plan complete though? am i missing something?

    thanks

  12. i'm currently in bangkok and will be here for a few more weeks. one of the questions i've been trying to find the answer to is; will my fiance need more shots in texas when she applies for aos? my fiance basically had no history of shots and only has the medical exam paper (ds-3025) she got for the interview. i've looked and looked, but i have not been able to figure this out.

for her interview; she had her medical exam. the ds-3025 says they gave her a shot for Td, measles, mumps, and rubella. my fiance isn't much help and says she can't remember what they did (the interview was in january).

i'd like to avoid paying texas doctors for shots that i need when i may be able to get them here.

    thanks for any thoughts

  14. Hello....My fiancee already has her K1 visa in hand and will be in the states next month. In our original application we listed her 6 year old daughter and included her in all the paperwork but we did not ask for a visa on her behalf. At our interview the consulate told us that we had 1 year to get her daugheer the visa...NE1 know what the actually process is? is there a certain form we file?

i wrote the thai embassy last week with this same question regarding my fiance's daughter. they said to simply start from the packet 3 point. mail the embassy what packet 3 says to immediately mail and then start getting the paperwork taken care of (medical, police records, affidavit of support, ... )

    hope this helps.

you may want to write the embassy. they were very helpful. they included the packet 3 checklist and all of the forms in the emai too.

    good luck

  15. hi,

my fiance recieved her k1 visa last month and we are currently in bangkok. we will be heading to the usa in july. her vaccination records were not complete and we'd like to make sure that they are complete before she enters. i think it will be cheaper and a good idea to have it done here.

is there a link or does someone know what vaccines the usa will ultimately require of her (thai)?

    thank you for any advice

    david

  16. hello all,

i'm in bangkok and will be here until toom and i leave for the u.s.a. in early july. if anyone is here or coming here that would like to meet up for a drink, talk about this experience, and have something different to do. please drop me a message.

    best,

    david

  17. my fiance has never been married and she has a daughter. after reading this site, we went ahead and had the "single paper" produced; just in case they asked for it. i don't know if they did, but they kept the paper.

    she was asked 3 questions.

    1. how did we meet?

    2. when was the last time that she saw me?

    3. how long did he stay? she answered incorrectly by a mile. i don't know what she was thinking, but they didn't flinch at the answer.

if you have been careful, proofread, checked and triple checked the documents; i believe that you will be fine.

i prepared a checklist for my fiance to use. i'll send it to you if you want to look at it. private message me if you'd like it.

  18. goontar,

a little background .... from the beginning of the process, we included my fiance's daughter in all of the paperwork and somewhere along the line (i believe in packet 3) we stated that she would follow at a later date. maybe this will help you though.

we had the same question as you regarding if the fiance's children must attend the interview. the packet 4 interview paper states that all family members must attend. so .... we wrote the embassy and i asked them if her daughter needs to be present since she intends to follow at a later date. here is the response -

    Dear Sir,

If the applicant's daughter will follow to join the applicant later,

provided that it is within one year, the daughter is not required to

appear on the interview date. The K-1 interview will be conducted with the principal applicant only.

    Regards,

    Correspondence Unit

hope this helps you. good luck next week.

  19. Congrats dvd. How long before they let you pick up the visa. I already booked the airfare and don't really have a full week to wait.

    goontar

it's difficult to make heads or tails of the current process behind scheduling visa pick-up dates. i don't know how they are currently being scheduled. i don't know if they've changed or if they have run into some unforseen variables. my fiance's pick-up date was scheduled two days after the interview. a friend of mine; his fiance's pick-up date was scheduled 6 days after the interview (which took place last week)

    good luck

  20. hello all

this website has been invaluable. some great news; my fiance had her interview yesterday and was approved. thanks to all who have contributed here. i can't imagine going through this process without it. there are so many small questions that pop up and i don't know what we would have done without it. most likely we would have gone much crazier, but thanks to this site we only went crazy. ha. thankyou thankyou thankyou
