  1. Hello Everyone, After a very sleepless night, If you have been reading my post, you will see that 1. I was giving wrong information from the start by USCIS. 2. Sent the wrong petition in. They have sent me NOA-1 and I have check my bank the check has been cashed. Now after sitting thinking of what to do I have can to this conclusion.

    I will send the I-130, also included I-129F will all the copies again. Also including a copy of NOA, with a letter explain they mix-up of information that I was given, (lucky I have the persons name and ID) at USCIS and like they say so are recorded. So this might help.

    When I called the person explained, after pulling my file up that my I-129F shows that this is for spouse, and I should send the I-130 in so this can be approved.

    Does anyone one have input or opinion to this?

    I'm afraid that this could delay every considerablly

  2. Did you get married in a legally binding ceremony, registered and recognized by the Nigerian gov't? Have you checked with any other US/Nigeria couples here (the US half) to see if what you did is a legal marriage? Is your marriage certificate in English?

    I am not sure exactly what you mean in your first post here, but if you filed I-129f for a fiance (because you thought you were not legally married) you can not change that now by sending them additional documents. While it is the same form, it is not completed the same for a fiance as for a spouse.

    If it is the 1-800 people who told you you could just add on the I-130, you should take that information with a grain of salt--it is not called the Mis Information Line for nothing.

    If you are legally married, you can change your name any time you like. I really think that you should review what you are doing and make sure you've got the right forms going to the right places. And make sure you're legally married under Nigerian (not cultural) law.

    Yes I was married by a legally binding ceremony that is recognized by the Nigerian gov't. and was done as in the US. I found out that it was legal here but another member that is also was married there. This is what had me start questioning what I was told by the person USCIS. Now I am worried. I call the number on the NOA I-797 that I got in the mail and called and was told to send the I-130 with a brief explaination of what happened. But now I see that I should con't with putting my maiden name as I did on the I-129f for I don't confuse matter any further. Also as I have talked to my husband and he said wait till he arrived to change all my ID as this is a considerable expence and needs all my attention to do this correct so there will be no delays.

    i hope your journey isnt a slow one with no RFE (request of further evidence) and you have found prob the best site on the net to help you through this process..

    Thank You for your help, this is why I love this site... Maybe you could help with a futher inquiring question???? I am filling these document and now that I know that our marriage is recondnized here in the United State should I be putting my husband name now?.... I haven't as of yet had any of my identification changed. So should I be using my married name or maiden? Help Please.

  4. :help: Hello everyone, I am glad that I came to this website after going to others and was given the wrong information so far the information that I have received has adverted a catastophy in filing my documents. I was told to file the I-129F first, that the United States didn't recondnize Nigerian marriages ( this was info was given by someone at CS for USCIS) needless to say I sent it in. Then coming here found this to be very wrong info. With members support here I called and was told to wait till I recieved notice a I-797 which I just got today. I called right away, they said to send the I-130 as soon as possible with a letter of explaining that there was a I-129F already there. So now I am filling out the document and don't want to make any further mistakes in this complicated process. So I'm a little confused with Q. 13-14, I have checked (Birth in the U.S.) Should I be putting my BC # anywhere? 14a is understandable to for 14b according to the on here on this site I don't answer it but I'm thinking I should aswer No.... I this correct?????

  5. Hello to everyone. I contacted the USCIS and the State Department, before starting all the petition process...But now by reading all the sites I think both have given me very confusing and wrong information.

    I was married in Nigeria, Africa

    Before starting I asked and was told by both if married in Nigeria, Africa is it recondnized in the US... There response was no they are not and that I would have to petition for I-129 for fiance'. Not the I-130 since it was not recodnized here.

    Through long research and reading I think now I should have sent I-130 first and then it is followed by the I-129,K-3, I-,485, and many other forms.

    A person I spoke to at USCIS said this will be ok as long as I sent all the document required for the I-130 which I did...But what I am think now is should I efile the I-130 to USCIS while they are processing the I-129. or wait and see when they send the I-797 to submitt the I-130 and fee.

    Also will this delay my petitioning process..

    Then when talking to a friend which is going through the same process but is not married, told me that she was told to have her fiance file for K-1 visa while I-129 is being process to make time shorter.... I this right should I have my husband all do this? Him and I are already getting all the papers ready for his interview sometime in the future.

    I am really confused now.
