  1. I did ask about student visa as I was about to enroll my CPA course. As it is US course thought it would be better to do it there. After a quite a bit of research I enrolled here in my home country where I can take up my exams in USA. So it’s all about learning about opportunities I see in front of me and inquiring to understand better doesn’t seems to be fraudulent anyway.

When I visited last time I did return to my home country way before expiration of my I94. I am completely new to this and when people speak about different routes I just wanted to know more about it. That’s my intention. I knew this process is so painful and depressing sometimes. Still we all are strong to hold our love to get united with our loved ones soon. I appreciate your insight about my thoughts. Thanks a lot.

Nothing stopping you applying - but be realistic about it, especially when it’s a course that you don’t need to be physically present in the US for. I know a number of people who took various US qualifying exams from overseas and mostly they studied at home and then flew to the US to take the exams. My other concern is that if you are denied a F1 visa, then they might (might, not certain) cancel your B visa too and you wouldn’t even be able to visit.

Yes i understand that. Now I have decided to enroll here in India and write exams either in Middle East or USA. Coz I don’t want to give a chance to deny or delay my F2A process. I wanna visit my husband as he is not able to travel due to his recent job change. But still I got a fear that port of entry can be denied. So until I get my petition processed I have to be patient and pray god to move things faster.

  3. thanks for your inputs. I don’t want to take a risk of applying and getting denied for student visa. I pray my spouse visa process to move faster. In-between I will try to visit my husband and he can visit. Also I have planned to join online CPA prep and write exams either in Middle East or USA. For writing exams I hope there shouldn’t be any problem as I will have notice to schedule in hand.

  4. Dear All,

My husband is LPR he applied for F2A for me and I live in India he lives in Texas. I have valid tourist visa for 10 years. We recently got married in USA by August and I came to my home country by Oct end. Now I would like to pursue my CPA in US. Is it possible for me to get student visa while I130 is in process. If yes what is the procedure to be followed. Thanks in advance.

So the job isn't really a reason to go back as you wouldn't be currently working there.

It's a bit of playing devil's advocate, but you need to look at how they will view it. Any ties that will be abandoned in the near future aren't really ties.

That said, the hard part is getting a visa. You already have that. CBP can deny entry still, but aren't likely to raise a fuss so long as you don't spend too much time in the US. The recent 5 month visit would be the biggest factor in that area, but if the plan is to travel in late 2019 then that may be fine.

Wow I understand. Fingers crossed and it’s upto officer to let me in. I wish this visa process to get sooner so that all can be with their loved ones without any hassle. Thanks so much for all your guidance

  7. Dear all,

My spouse is LPR and we applied for F2A in Nov 2018. I knew we have long wait. He planned to visit me and family during May 2019. After that his parents is going to visit him around July and stay till sep. I hold B1/B2 Visa valid for 10 years with multiple entries. I visited states for first time in 2016 for a month for business reason and 5 months in 2018 to spend time with my friends and fiancée that time now he is my spouse. We got married when I was in states in  aug 2018 and I came back to home country in oct 2018. So my question is whether I can travel with my visitor visa and stay for few months in end of 2019?

I have read read other threads which few told they travellled with no issues but some thread I read if they deny entry at port then my b2 Visa will be revoked and I will get an entry ban. So how this works. Thanks in advance.

What app is that? I know uscis has official website case trackers but wasn’t aware they had any apps? What does your actual case status online say? https://egov.uscis.gov/casestatus/landing.do

This is the app. I found in App Store. May be not real app but I don’t know. In online it says as received only and mine is 2018 pd so I have long wait. Just curious to know this app. So posted.

This confusion arised coz his employer filed a petition meanwhile they got married and tried to fast track the process but as his pd became current with employer petition itself. Thanks all for taking time and advising me. I am now relieved much
