  1. I got a GC through vawa. I want to go visit my country but my passport is expired and my consulate is giving me a hard time renewing it. An option they give is that instead of the passport they can give me a "safe pass" or "safe conduct" which is only good to enter my country once. My question is, would this work?  do I need to show a passport to any US authority when leaving the US? Do I need a passport when i return to the US or just my GC?

  2. hi, I know that after vawa gets approved, my case gets transferred to my local office. After vawa approval, when I check case processing times for I-485 for my local office, does the processing time given there start when the case arrives at the local office AFTER vawa approval?, OR when I FIRST submitted my case? I submitted altogether (I-485, I-131, I-360), and my ex spouse is a citizen. thank you

    Hi, the pattern I've seen here and from my own experience is mostly three months but sometimes it is transferred immediately and it doesn't always reflect on your case status.. you're not always updated! there were some people who had to enquire from their Congressman and found out that their I-485 was already at the local office! Also there's no fixed time to receive courtesy letter some people did not receive it. My VAWA was approved March 2019  and I got the courtesy letter in July 2019! I hope this helps.👍

    thanks. my vawa was approved in october but i'm still waiting for i485. my  case status for i485 still shows "fingerprints were taken" since 2019.  I read in other forums that if I move to a different state, my i485 will go to the back of the line in the office in my new state causing a big delay? do you know if that is true?

    I live in washington state, and hired a lawyer to file all my case files in washington state. if i move to another state will the i485 interview be in the new state? or can it be in washington state?  after i move, I wouldn't mind going back to washington state just for the interview. is that even possible? i would even prefer that because my lawyer would go to the interview with me if it is in washington.

    would changing my address to the new state slow down my waiting time for the i485 interview?

    i filed for vawa i-360 and i-485 at the same time with category c9, my ex husband is a citizen. how long is the i-485 taking nowadays? is the i-485 interview the last step? how long after the i-485 interview the applicant gets the green card?

    I've been reading many posts where the applicant's i-360 was approved but they are still waiting to get their green card.

    (c)(9)( ) is the right one. It's on page 11 of the Instructions, Adjustment of Status Categories, Adjustment Applicant under Section 245 -- (c)(9)

    I-131, 4.a. - No. Re-entry permit is something completely different. It's a passport style document issued to permanent residents who want to leave US for between 1 and 2 years or want a passport-like document but have problems getting one from their country of citizenship. Some countries do accept it in lieu of a passport and will issue visas and entry stamps into it.

    I-131, 4.c. - Since 4.a. is no, this one is not applicable. Disposition in this case essentially means that you either attached the prior re-entry permit or refugee travel document with the I-131 (they don't want you holding onto old ones for some reason), or it's not attached because you lost it, or some other explanation as to why you're not sending it in.

     

    Thank you so much. My lawyer filed these forms the first time and he used his office address as the mailing address, should I use his address or mine this time? does it matter? and should I send both forms together in the same package or separate?

  8. hello, I'm filling forms I-765 and I-131 to renew work and travel permit. I'm still waiting for a decision on i-360.

    There is a question(25) on the form i-765, it asks what is my current immigration status or category. I entered the country with a f1 but it expired long time ago, what should i answer?.

    Also, in question 27 it asks what is my eligibility category, i applied under (c)(9) but i didn't see that option on the form instructions so I'm a little unsure about that one.

    On form i-131 question 4a asks if I have ever been issued a reentry permit, but at the same time the form seems to make a distinction between reentry permit and advance parole, since I have advance parole should i say yes?

    and question 4c is: Disposition (attached, lost, etc): what does that mean?

  10. is it safe to drive through a border patrol checkpoint station in Texas or New Mexico? (not the ones at the border). I'm not going to Mexico, just driving from New Mexico to Texas. I read there are also many checkpoints far from the borderline in those states. I'm still waiting for vawa approval but I have my work permit. would i need to carry that with me? can I get in trouble for driving through one of those stations?

  11. hi, when I filled the form i131 I only wrote my country in the section that asks which countries i will be visiting, but now I would like to visit two other countries that are neighbors to my country(in south america) for just a couple of days, I didn't include those two countries on i131, if I visit those countries can I mess up my vawa? thank you
