Don't worry too much, @Nikki123. If you don't do anything wrong, you are OK and you won't be deported.

The sooner you file the safer you are. However, collect the needed documents as many as you can.

Right now, the AOS process is very slow. If you get some RFE, it will cost you more time. Read the forum and search,

    you are good to go.

Thank you so much @Iaufune, we've been stressing so much for the last couple of days , we just don't want to make any costly mistakes by rushing it, thank you so much for your reply

For AOS, no. We just included our marriage certificate. Evidence will be brought to the interview. My husband already has his EAD card/AP card so we were fine. Double check on what you need for the I-130 or the overstay waiver though.

RFE is the note you receive from the USCIS if you are missing or misfiled a form. If there is an issue, you give them whatever they want, and as long as it's okay, you will continue moving on in the process.

    Thank you

What evidence? For AOS you need the marriage certificate. The forms aren't that long or that complicated. A lot of it is your name/address/basic info. You can do it all in one afternoon. Fill it out, have someone proofread it, then send it along. Seriously, it took us a day. We did it the week of the wedding and we never got an RFE or anything. You don't need affidavits and even if you wanted to include them, it takes 1-2 days to send mail between states.

Are you not suppose to include sone evidence of your marriage in your packet or is that just for the interview? Excuse my ignorance but What does RFE mean ?

Why don't you just file now? My husband and I literally put it together in one day the week we got married. You are deportable at any moment until you get that filed. Why wait?

Because I've read some horrible stories about things being denied based on mistakes, in extremely paranoid about getting correct and gathering as much evidence as possible, his don't live in the same state and I'm waiting on them to get thier affidavit to me.

You invalidated your visa as soon as you overstayed.

Should I be very worried about being immediately deported?

Your visa was actually revoked under INA 222(g) the moment you overstayed.

As others have said, file for AoS and it shouldn't be an issue.

So that's normal practice for an overstay? Forgive my ignorance, I'm not the sharpest tool in the box. I was very concerned with being deported immediately. We are working on getting our AoS completed as soon as possible. Thank you for your reply.

  6. Hey all, please advise , I came to the US on vacation in 2017 and ended up marrying my US citizen boyfriend, a month before I was due to return home sometime came up and we decided that it would be better for me to stay , so I did. It's taken me forever to get some documents I needed from back home including my birth certificate which I have finally received. I have overstayed  my B2 Visa by a year and 2 months , my husband and I will be ready to file my AOS in the next month as we now have the money and documents I needed , however I received an email yesterday from the US consulate back home informing me my b2 Visa has been revoked , we are extremely worried that I will be deported before being able to file my AOS. Please can anyone advise , we are sick with worry. Thank you
