  1. Was the recording on during the interview? If yes then it will most probably to go the supervisor to review the file. The officer who took your interview was not able to make a decision. So this will go another officer and or a supervisor to review and approve it. If it was recorded the clips will be played multiple times to make an assessment. Not trying to scare you but this one is familiar.
  2. That may be true but with my personal experience we wasted a month and a half to update the address. AR-11 was sent twice and nothing nada happened. I had to call and make the address update and it was effective immediately since my EAD did actually get delivered to correct address. I made 2 calls first is to make the change and second to confirm the change. The agents does not proceed till you match all details that’s on file as part of validation. I called and gave them the updated address on call 2 and that verified me that it was actually updated.
  3. Congratulations. I’ll let the experts comment too. But let it play out and have patience. Since you had waited for so long wait for few more months and not irritate them or irritate yourself. Address change for Vawa is very tight. Filing online is not possible, you or attorney may have to send AR-11 which usually gets lost in transition. Calling uscis is the best way and it’s effective immediately on address change.

  7. When did you file i360? Earlier before SCOPS existed all vawa applications used to go to Vermont. Now 485 always goes to local field office.
  8. Congrats. The application would be transferred to local office and depending on the local office work load it will get scheduled. What month did you file in 2022?
  9. It was no fees earlier. Do not know if that has changed. Best and quick option will be spend few money and have a virtual call with an attorney to the most accurate result. A call with an attorney for a 30 mins will cost you 100-250. And I would advise that just sending the application will not result in anything. You have to send proofs. If an application is only been sent it may denied initially and no prima facie will get issued. So be cautious don’t rush get attorneys advise.

  11. This is just my pure assumption coming from experiencing situations faced. This appears to be a standard template of response. But good news is since it being 43 months as a standard time to process 80% of VAWA cases on their website you are very close and most probably they are reviewing your case and is close to finish line with a positive news. Because if something was found or a reason to deny they would have escalated and done so by now. I believe it does go through multiple hierarchy of approvals so it will take time. But seems to be in the right direction. If you are August filer then 6-7 more months for a decision.

  17. I have heard from an attorney that they had updated citizenship forms and have added more tricky questions. Earlier it was not like this but the application form have a new version. Anyone please correct me if I am wrong.
  18. Hello, I received a Prima Facie extension of 6 month last week, and I do not think my lawyer asked for extension. So I received the first Prima Facie in mid 2022 for 1 year and then nothing after that, till last week I got one which expires in Sept 2025. Is this normal?

  21. So running both in parallel EOIR 42B with court, and I-360 with USCIS will have different out comes. Lets say the individual is in removal, and if the I-360 gets approved, then what? Who should 485 should be filed with? My assumption is USCIS but it would not adjudicate it until removal is taken off. So for removal it has to have EOIR 42B approved which will result in termination of removal. And then file 485 with USCIS. The times with USCIS is faster than court I believe, as court may give verbal approval but due to limited number of GC it will take years to actually get one. Given that attorney had filed under category C10 then the 4000 GC Cap does not apply as per the chart below
  22. Gotcha so this will go through court. So step 1 will be EOIR 42, then court may on discretion grant verbal approval and then after many years get a Green Card. Is the assumption correct?
  23. Hello posting a scenario so see what are everybody's thoughts. Given that an individual had a legal status, got married filed i130 and it got denied, now the individual fell out of legal status and was put on removals and had court date and filed EOIR-42B. Filed vawa and given that vawa gets approved, will the individual have to get the 485 with the court or USCIS?
