Yeah, affidavits are definitely not required and are considered a weak method of proof compared to tax returns, joint healthcare, etc. I submitted my I751 w/o affidavits, although I did ask people to write them and I'll probably send them in...also found some more insurance docs that I'm going to submit too. So I say go ahead and submit it and then you can always send in the letters later if you want to. Just make sure you have a evidence like tax docs, rental/mortgage agreements, health insurance, car docs, etc that show joint owning and cohabitation. I submitted joint tax filings, copies of our insurance cards, bank statements, pay stubs showing our joint address, fotos, a couple christmas cards addressed to the both of us.. not too much but the burden of proof is on them. If its a real marriage then there really isnt too much to worry about as long as you file properly and include the major forms of proof.... good luck!

  2. Hi All!!

    Been a long long time since I posted. Been busy with moving, getting new jobs, etc. Anyhow, we had our interview yesterday in downtown LA. We were of course approved. The guy was a bit of a jerk at first until he realized that he used to attend the church that I work for (I work at a church school), lol. After that he was nice and started stamping everything approved. Never looked at any fotos, just wanted to see things like our rental contracts with both names on it, bank cards, health insurance stuff. Okay, back to work. Approved approved. yay! BTW, DO NOT park in the Fedral Building parking. I payed $16 for like 2 hrs and then right down the street it was only $6 for the entire day, boo. but who cares, we're done for 2 years!!

  3. Hi simbafuzz, based on the Sept filers averages, we should start seeing some AOS approvals for those who were transferred to CSC.

    Their averages are:

    Transfer to AOS approval: 43 days (7 approvals)

    NOA to AOS approval: 64 days (11 approvals which includes 4 approvals after interviews)

    Well this means we should start seeing some AOS approvals very soon! How exciting! :dance: These first few weeks of December should be busy for all of us.

    BTW, Greg that is such bummer about what happened at DMV. I didnt even know they could do that. Seems like same name and same b-day wouldnt be so unheard of that they dont have some sort of protocol for this (I found someone on facebook with my same name and birthday AND we went to the same University!) So what has to be done to release the license? That doesn't seem fair. Good luck with that and keep us posted. My husband is going to take the test in English tomorrow.

  4. Forgot to mention that we are going to go try to get my husbands Drivers license this week. In CA you can get a DL valid for the length of the EAD card. This is probably the most important part for my husband, lol.

    He has been studying the handbook in English but I read on VJ somewhere that he can do an audio version of the test in Portugues! So I will be reporting back to all of you on how the DMV experience goes.

    Any of the people who already have EAD get a DL?

    Also, I am thinking that with the DL he will be able to go to school and not have to pay those astronomical non-resident fees. My husband wants to go to culinary school but the prices for non-residents was crazy. For a class that would normally be just $60 he had to pay something like $1,300 - insane. But since it was expensive because he was a non-resident and EAD establishes residency and he'll have the DL which also establishes residency I think it may work. So I will also report back to you regarding the cost going to school with EAD or DL.

    anybody here received their EAD card without having the approval or touch?

    I didn't have any touches on my EAD and then one day I got the card production email and a few days later it was in the mailbox!

    I really wouldn't worry about touches. Back in the K1 process I rarely got touched but mine was processed at the same speed as everyone elses. But I know, it is nice to see the little numbers change, lol - its all we've got when we're just waiting and waiting and waiting.

    Djhon, seems like you should get your approval notice for AP/EAD early this week. Most people it seems to take about one to two weeks.

    I'm sure yours will come early next week or who knows, you might get the mail today and *bam* there it is. We can estimate when things should be happening but I'd say give it at least a two week buffer on each side. My approvals came just within the two week mark (only counting business days) and a bit over if you count weekends. And remember that online status means nothing. I'm wondering if there is a pattern of people at CSC who are not getting online updates, I've noticed a few but havent taken the time to see if there is a real pattern.

  7. I've determined that my EAD will be approved without being updated online first. I was lurking in the September filers forum and saw several cases of cards arriving in mail after no touches and then AFTER getting EAD card uscis.gov updates, lol.

    So just because nothing is happening with your case online doesn't mean nothing is happening behind the scenes.

    Hi! I just received my hard copy of transfer notice today too but I am so confused because only the I-485 was transfered to CSC, how about my I-765 and 131? Anyway, I had a biometrics appointment this morning.

    Hi abbynorm1, congrats on your transfer and completing your bio today. BTW, what is the notice date on your transfer notice?

    Maybe someone else who was transferred to CSC can comment on the transfer on only the I-485. Maybe only the I-485's are transferred to CSC?

    K-1's I-485 are transferred to CSC...other visa categories are like more like to transfer to NBC to have initial interview.

  9. You need EAD, final answer. K-1 cannot legally work without EAD or green card.

    SSN can be issued to a K-1 visa holder without EAD or green card but has black print " VALID FOR WORK ONLY WITH DHS AUTHORIZATION ".

    Once you get your EAD you can work with SSN. Once you get your green card you must go in to SSN office and get your SSN changed.

    Is this something new for 2009? Because I know back in 2008 when we came to the US through JFK we got a 3 month EAD stamp on the I94. Employment authorized for three full months. We did get the SSN and yes, the card does have that awful "valid for work only with dhs authorization" thing on it but the EAD stamp in passport is DHS authorization. Are they no longer giving the EAD stamp at POE?
