As others have stated this is not a problem for you to move forward. The exceptions have been noted. I would like to add an item to consider. If your divorce was initiated by the "other party" then you can file the paperwork for it to wind it's way through the court system in the Philippines to where it will be recognized. If you filed the papers to divorce him then all bets are off and I would suggest getting naturalized as soon as possible so you can have the new passport from the "new" country which I am assuming is USA.

    Hi Greenbaum,

So I initiated the divorce here as he refused an annulment. Thank you very much, very kind of you.

    Yup...no issue with US immigration.

It can technically be considered bigamy while in PH, though. You won't be able to obtain a passport in a new name until you register the new marriage, which shouldn't be possible with an existing marriage (but has happened somehow) without having the divorce recognized there or getting an annulment there.

    Okay, thank you very much!

  3. Hi,

Hope anyone can help out. I was married in the Philippines but now reside in the UK (2 yrs now). I have been granted a divorce decree in the UK.

My boyfriend is a USC serving in the armed forces. We're now researching on how best to go about the fiance visa application. So technically, main thing is, im still a Philippine Citizen and not divorced/annulled in the Philippines because they don't recognize divorces there. But the divorce i was granted is def valid in the UK.

Will he be able to apply for a K1 visa for me considering the circumstances?

If anyone knows, would really appreciate the help.
