I would research the half-brother's history because if he wasn't mentioned, his history is important.  I hope he's a regular guy with no ties the US will frown upon.

I did and it turned out that I didn't get it right. She did listed him but the CO neglected to go over that piece of information at the time  of the interview so they called her to check him out.

I've met the guy,  a regular dude taking care of his mom.

This topic is outlined thoroughly on the USCIS website found here: Search (state.gov)

If you failed to list a key item in your I-129f, Petition for Alien Fiancé(e) and or at the interview then you will be in AP for the length of time that the CO needs to vet your application with this newfound information. If the information checks out without any issues, then you will move forward. But, if the CO deems the information adds additional questions to the applicant's intentions as the CO views it, the visa can be refused.

If you have no issues, then your visa will go through AP which is normally the CO having to tie up any loose ends before issuing the visa.

No one with any certainty can tell you when yours will finish adjudication. Being a student of VJ, as I am, I have learned that AP can be as little as 2 hours and some more than a year. No one can explain why that is other than what we read in the regulations from USCIS.

Is it fair? In your eyes no it is not. In the eyes of the CO, it's a necessary step in the process to issue a visa. CO's do not want a case to go "bad" once the applicant arrives in the US. A good example is the San Bernadino terrorist attach a few years back.

After going over this half-brother issue with my fiance  it turned out that she did listed him on the I-129F,( my bad)  however; according with the subsequent phone call from the embassy , the CO forgot to go over some questions about him at the time of the interview, and that was what the phone was all about: to corroborate existing information and to  get more if possible.

    thanks

You've got nothing to worry about. I'm in the same position. The status went from  "Administrative processing" to "refused". Been doing some research myself. I even sent an email to the embassy. I suggest you do so too if that makes you more at ease. I think they may have you retake you medical examination as your last one should have expired by now. The pandemic slowed the process down. Its not supposed to take this long.

I thought so too. Besides medical papers I'm expecting to be asked for  a new AOS , bank statements etc.

    Thanks

Judging by the trend of the responses and I thank you guys for your input .The consensus seems to be the lack of clarity  over the changes on  legal language; however, after an interview who leaves you in good spirits (9/30/19)  this length of time seems to be the exception and not the norm.

I'm confused.  Did they tell you at the interview there was an approval?  Did they give you something about abuse and steps to retrieve passport? It's strange to be sitting on it for year.  After a few months and told I was approved, I would have got a lawyer.

There are cases where they keep your passport and do not give you a 221g if they are sending something back to the USCIS for security checks of something, but this is rare.

The good news is they still have the passport.  And you are fortunate to get into CEAC.  That site never works for me.

What my fiance  was told by the officer was " I have the intention of approving your visa"   She did get information regarding abuse and such;   A few days later she  got a call regarding her half brother relationship with her and why wasn't he listed as a relative, she went on to explain that as a half brother didn't grow up close to him . Last contact t was another call to verify contact information.

Then Covid came and I don't know if that has any bearing on the story.

This topic is like a dog chasing its tail. Let me explain what is happening with "refused" conditions.

Having applied for US Visa and received 221g Administrative Processing for your case, you would have checked your visa status on CEAC website. When you check the status, you used to see status of “Administrative processing”, but that would have changed to “refused” from March 3, 2020. Many users have reported and its verified as well that most of the 221g Cases status has changed to “Refused”, even when there was no real update on their ‘Case Last Updated Date’ or anything has changed. One key thing to note is the text under it has changed. It reads like below now.

“A U.S. Consular Officer has adjudicated and refused your visa application. Please follow any instructions provided by the consular officer. If you were informed by the consular officer that your case was refused for administrative processing, your case will remain refused while undergoing such processing. You will receive another adjudication once such processing is complete. Please be advised that the processing time varies and that you will be contacted if additional information is needed. For more information, please visit TRAVEL.STATE.GOV or the website for the Embassy or Consulate at which you made your visa application. For more information, please visit U.S. Consulate General <Consulate name>”

Pay close attention to the bold text, it basically tells that, if you were given Administrative processing, then it will be processed in administrative processing.

    thanks !!!

    hmmm thanks for the reply.

We think we have the answer. That is common reply for everyone. This is normal. They are finishing the final steps prior to issuing the visa. As a K1, when checking your case online at CEAC.state.gov you must select "immigrant visa" as it is treated as such even though it is a "non-immigrant visa". Once you can no longer see any information for your case using "immigrant visa" choose non-immigrant and you will see the status. When it changes from one to the other your visa is almost ready for "issue". Keep watching and when it reaches "issue" status you will soon be contacted by the Embassy to receive your passport with visa intact.

    got it thank you much!!

  9. " A US consular officer has adjudicated and refused your visa application . Please follow any instructions provided by the consular officer. this what I found on CEAC today. is it over ? or the case is being investigated further? what do you guys think?

  10. my fiance  had her  visa  interview at the Bogota Embassy back in sept 2019, she was told then by the counselor   " I have the intent to approve your visa"

they kept her passport and  a couple of weeks later she  got a phone call to verify her contact information and nothing ever since. Is the AP this long? when I check the status of the case at CEAC shows a march 24 2020 as last revision and a ready status . Also we have a baby boy whom by virtue of being the son of an american citizen already has his passport and citizenship, which we processed without any problem.

    any thoughts?

    Thanks

  11. My fiancé had her visa interview at the Bogota embassy on oct 30 2019. at the time of the interview she was told by the official  "have the intention of giving you the visa",  She got an email days later requesting confirmation of address and phone numbers followed by a phone call regarding her immediate family, after that it's been radio silence. As of now it's been almost 2 months since the interview. Any ideas? Thanks guys
