Hi fadi, thank you  for sharing your experience! my wife also had an interview on july 17 in casablanca and yesterday I received an email about filling out the form DS-5535. they sent me an attachment as well as questions to be answered in form of an email ( I am assuming that's the form?). how did you fill out the form? copied those questions into microsoft Word?, cause I wasn't able to download the attachment. this is what they said

""As arranged at the end of your immigrant visa interview, please fill out the form below and send it back to us for processing. Attached is the official form sent to you just for informational purposes and NOT to fill it out.""

    thank you!

Where are you supposed to send the form?

So is there where to upload the form?  My husband has never received their email that they say they sent.  We need to know what to do after the form is filled out.  He had his C1 immigrant interview in Casablanca.

It takes about 6 months for the case to be returned and for you to get the NOIR or NOID

Follow the instructions as to what u need to do

for a NOID you need to respond within 33 days with responses to the issues and evidence of those responses

for a NOIR you can appeal with Form EOIR-29 and anappeal to the Court of Appeals (fee $110)/ form should be enclosed with the NOIR

I did an appeal / it took a year / my appeal upheld our marriage as bona fida but told me to refille

Knowing this now, i woud have just reapplied when i got the NOIR and given the evidence with the new application

sorry u r going thru either of these

Thank you so much for the information and I apologize for the late reply.  I called NVC today to see if they received the application back since it has to go through their hands first before USCIS.  THey told me that the consulate sent my husband an application according to their notes.  Do you have any idea what kind of application they could be sending? We have been married for 14 months now as we applied for the CR1.  Doesnt a couple have to been married for 2 years for the IR1?  At this rate, there will not be any conditions.  Oh well, I just wish it would hurry as I miss him very much.  I  lost my sister in June and his being here sure would help the healing process

This worries me. You and I our situations are similar. My husband is also Moroccan. We married on the first visit too.  I just had my second visit with him for 38 days. First trip was 24 days. I already got my ticket to visit again in January 2019 for 2 weeks and also plan to go back for his interview. I have been worried they will deny on basis of marrying on first visit. I hope not. And I hope your case gets reaffirmed so you and your husband can be together soon. It's so unfair how they treat our spouses just because of where they are from.

Yes. I wish that consular officer could talk to the airport when I was on my way there.  That attendant knew it was an important visit.  I have visited four times and hope to go this month as well. When I get extra funds next month, I am booking my next flight so we are not this long without seeing one another.  This VISA process is very stressful.  What's sad is there are things that a Moroccan cannot know because they have not lived here.  It doesnt matter how much two people love each other or talk all day/night, it's impossible to know a culture until one lives it.  It's like when I go there, there are many things that i do not know.  We have plans to live there after my little girl is grown and I am actually excited.  I hope I do not offend you; but the US is not all what people think and one doesnt get rich here, etc.  It takes everything one makes many times just to make it week to week.  I am ready to slow down and smell the air instead of living such a fast pace life. :)

Thank you, I'm not worried about the consulate or CO they could be as rude as they want it's their job and i wouldnt expect them to go easy on me, they can ask whatever they want mock me however they want, I will answer every single question bcuz what my wife and I have is based on a long love story and nights of talking. what really worries and bugs me is the fact that we will waste more time and we will have to postpone our plans and most importantly my wife i do not want her to go through all of this and she already has enough on her plate.

I appreciate the time taken to write me, good luck to you as well.

You are very sweet and I totally understand. Although our love story is not very long, it is the best love story we both know.  It is a very stressful time is all I can say.  I hope he receives whatever email/mail was sent to him so we know what to do now.  Supposedly some sort of application , according to NVC.  I have no idea as I have researched it and can't find a clue.

do you have any idea of  why it happened? as long as i know, after nvc it is suppose to go to the us embassy at the benefitiary countrt

We have no idea why?  It went to the consulate/embassy in Morocco.  I called today and supposedly they kept it and emailed my husband some sort of application.  I have no idea what this could be; but maybe this is good news since it didnt come back.

then you have to check with the embassy you have all right as you are the petitioner ask them if they already send it back or not yet they suppose to tell you really...

I have emailed the consulate and followed all directions.  They are negligent in providing an explanation.  USCIS informed to file a g639 with no initial cost.  I am the petitioner and in beginning, I offered to meet with them, if needed.  When they did respond, it was "we do not meet with the spouses..."  Why not?  If there are questions, they can see first hand our interaction with one another.   As others have seen, it's like we have known each other our whole lives :)

I really don't want to be negative in your situation as I really do wish you the best.  Just be ready for anything is all I can say.

Yes.  There's no tracking of the application being returned as they say.  We did marry in Morocco and yes, our first meet; but we knew that we wanted to be married and spoke of it before visit.  We were married mid July and applied last August.  I wish I could have stayed as I would have; but I have a 12 year daughter that cannot be there with me at the moment.  We do plan on living in Morocco once she is grown and the officer just mocked my husband when he answered some of his questions.  Yes, he answered all questions good and honest from the heart.

I have spoken with USCIS and they are advising as to what paperwork that i need to find out why the application has not been sent back yet.  We had all of our paperwork in order from the beginning.  NVC only requested one document when it was sent there.  I am a business manager so attention to detail is a big part of my job.  The whole application was very much in order as many of the suggestions online.

USCIS will send you a letter also the report of why immigration officer refused him, you have to respond with more evidence for reaffirmation then they will send back the file to US embassy for another interview, its going to take some time for that, did you marry first time you met in person ? after you married did you apply right away ? my wife is living with me in Morocco since 2015 and she still here with me, we did not marry first time she came til the second time, did your husband answer all questions good ?

    correct, Thanks

Dont feel bad about only meeting once.  This is unheard of for a US citizen for the most part; but Muslims really do not date as to not fornicate.  We married on our first meeting and have been married for one year now; but we have visited four times and I plan on going again next month.  The consulate is very rude and mocking.  They do not help with anything as far as answering questions, etc. They do not get in a rush for anything.   Good luck is all I can say and one never knows as to what they decide.

sorry to hear that, what country your husband was interviewed ? after the interview what immigration officer told him ? is it the case returned to USCIS ?

My husband is from Morocco and had his interview in Casablanca in July 2018.  We filed for visitor visa last December 2017; but it was refused due to our immigration paperwork in process.  All the immigration officer told him was the application was being returned to USCIS and for him to call there and find the reasoning.  It's a crock of ####### as we were married in Morocco... We have had four visits in Morocco and I am planning my fifth next month.  We have joint accounts, etc.  I am not quite sure what they are looking for or the reason as they did not give any reasons.  NVC and USCIS has been more than helpful in this situation and they have been very patient with my questions.

  12. Good luck is all I can say.  We got approved through USCIS and NVC and my husband had his interview in less than one year from filing and we were put in administrative processing with no reason.  The application still has not come back to USCIS and it's been over 60 days.  I had to file another type of form today to get my records.  When I visit my husband next month, we will file the same form for him.
